MINUTES OF THE LAKE ADVISORY COMl\u.'rrEE
July 21, 1993
The Lake Advisory Committee meeting was called to order on Wednesday, July 21,
1993 at 6:35 p.m. Members present were: Dave Moran, Bill Packer, Peter Patchin, Jody
Stroh, Tom Watkins, and John Wmgard. City staff members present were: Water Resources
Coordinator Joel Rutherford. Members absent were: Dave Vmlove.
The first item on the agenda was to approve the minutes of the June 16, 1993.
MOTION BY WATKINS, SECONDED BY MORAN TO APPROVE THE JUNE 16,
1993 MINUTES. MOTION CARRIED UNANIMOUSLY:
The first item on the agenda was a discussion of the lake's high water. Watkins presented
information on the history of the lake, describing the effects the Highway 13 ditch may
have on recent episodes of high water. He indicated the original plan of the watershed was:
(1) construct an outlet to allow water to runoff of the lakes, and (2) create holding areas
upstream to slow down runoff from getting to the lakes. He felt it is important to assure
the outlet's channel is maintained, so that its capacity is not reduced by the lack of
maintenance.
Other members discussed the effectiveness of the No Wake Ordinance. Members agreed it
is working very well, and that the Sheriff's Department is doing a good job enforcing it.
There were some questions relating to the DNR's involvement in this ordinance, with some
comments expressing disappointment in the DNR's actions of removing signs, originally
posted when the lake first went above 904.
This discussion led to another discussion, relating to the DNR's involvement with signs
posted for the original eurasian watermilfoil ordinance. Members again expressed
disappointment with the cooperation received by the DNR. Rutherford updated members
on the new rules the DNR is adopting for EWM. These new rules, which are proposed to be
adopted by August 1, include limiting boating in areas with eurasian watermilfoil. The new
EWM coordinator, Chip Welling, has told Rutherford that Prior Lake is not included in the
list of lakes proposed for enforcement of these new rules. Prior Lake has not been included
because the 220 acres currently infested on Prior Lake, is higher than the maximum 75
acres allowed by their established criteria. They have set this acreage, with the belief that
lakes with higher infestations will not be helped by limiting boating in these areas. Welling
also indicated that he felt the DNR would not approve an ordinance, adopted by the City,
that would restrict boating on Prior Lake, unless a survey showed less than 75 acres of
infestation.
Members agreed to continue pursuing the amended ordinance, discussed in previous
meetings, to limit boating in infested areas.

The next item on the agenda was a continuation of the discussion on ways to improve safety
on the lake. The process the DNR requires was discussed, along with how any proposals
should be recommended to the City Council. After discussing the ordinance adopted by the
City of Lakeville for Orchard Lake, members motioned the following recommendations:

AQUAPLANE, OR SIMILAR DEVICE BY THE MOST DIRECT ROUTE TO OPEN
WATER OR SHORE. MOTION CARRIED UNANIMOUSLY':
MOTION BY PATCHIN, SECONDED BY PACKER, TO RECOMMEND TO THE
CITY COUNCn.., TO ADOPI' AN ORDINANCE SO THAT NO PERSON SHALL USE
AN UNTETHERED INFLATABLE WATERTOY, AIR MATl'RESS, OR INNERTUBE
MORE THAN 150' FROM SHORE. MOTION CARRIED UNANIMOUSLY':
The next item was to review the proposed Capital Improvement Program for 1994 thru
1998. Members discussed the purpose of storm water utility fee, and their concerns that the
funds generated will be used for worthwhile projects, that can be reported in the Lake
Advisory Committee's annual report.
MOTION BY MORAN, SECONDED BY PATCHIN, TO APPROVE THE PROPOSED
CAPITAL IMPROVEMENT PROGRAM. MOTION CARRIED UNANIMOUSLY.
The meeting of the LAC was adjourned at 8:30 PM.

Re: City of Prior Lake Code Section 9-3-10 -
Eurasian Water Milfoil Ordinance
Dear Frank and Joel:
City of Prior Lake Code Section 9-3-10(d) provides that the City
will consider amendments to conform with any appropriate
legislation on the milfoil matter for the 1993 boating season.
I have enclosed a copy of the Minnesota Rules, 96110.1500
referenced in the ordinance, as well as Chapter 235 of the
Minnesota Laws, 1993.
I would suggest that the eurasian water milfoil ordinance be
amended to pick up the citation and penalty provisions of Section
2 of Chapter 235. As you will see from Chapter 235, we do not
have a provision regarding transporting milfoil on public roads
and our penalty provisions exceed those spelled out for the
various violations in Section 2, subd. 2.
