CALL TO ORDER The Lake Advisory Committee (LAC) Meeting was called to order at 6:30 P.M. Members present: Dan O'Keefe, Harry Alcorn, Marv Mirsch, and Donna Mankowski. Members absent: Brad Beneke, Others present: Chad LeMair, City Council, Sue McDermott, City Engineer, Larry Poppler; Assistant City Engineer. II. CONSIDER APPROVAL MEETING MINUTES r III. r OLD BUSINESS a. Election of a new Chairperson Mirsch nominated Harry Alcorn for the position of LAC Chairperson. Alcorn declined the nomination and nominated Dan O'Keefe citing Dan's longevity with the LAC, O'Keefe accepted the nomination, After a unanimous vote by the LAC members, Dan O'Keefe was voted to be the LAC Chairperson. b. Regulation of Docks O'Keefe stated that after talking with a number of people, he feels that there is no dock issue and that legislation of docks by the City would be a bad idea, The City does not have enforcement The existing regulations that are in place are enough. Mankowski mentioned that the DNR no longer regulates the residential docks, After reviewing the Mitchell Pond Homeowners Association literature regarding their application for additional slips, the existing regulations for associations are more than enough, but for individuals something needs to be put into place. www.cityoflfiorlake.com Phone 952,447,4230 / Fax 952,447,4245 r-- , Mirsch added that he agrees that not a lot of regulation is needed, but that a setback is needed. O'Keefe stated that during periods where the water level is low, converging lot lines may create a situation where a certain lot will not be able to meet a setback. That is one example, but new regulations may provide many more challenges to the City than expected. Mirsch mentioned that if we always take the measurement of the setback from the high water line. converging lot lines would not be an issue, leMair asked who would regulate this issue. Mirsch answered that residents would call the City and state that a neighbor is encroaching on the dock setback. City personnel would then have to possibly survey the lot lines to determine if that person is encroaching, Realistically the issue would never get to that point Situations exist on Prior lake where a person has placed their dock on the lot line and that situation, unless agreed upon, limits the neighbor's use of the lake and placement of their own dock. Alcorn asked how many lots are 50 feet or less. r Mankowski answered that her experience as a realtor, two thirds of the lots on Prior lake are 50 feet or less. Many 50 foot lots combine docks so that it doesn't take up as much space on the beach, For a 50 foot lot, a ten foot setback on both sides limits the amount of beach for a homeowner. If two riparian lot owners agree to have docking not meeting setbacks that should be an option for people. Alcorn asked if the City should review association covenants to see if associations are following their covenants on the number of boat slips allowed. The LAC took a brief recess to attend the Prior lake Spring lake Watershed District Volunteer Appreciation Reception, Mirsch stated that the dock issue could be a safety issue, For example, if a homeowner places their dock on the property line adjacent the neighbor's swimming beach, boats using that dock would be closer in proximity to potential swimmers, Mankowski mentioned that the DNR should be contacted to see what type of phone calls they receive on this issue, Maybe even the planning department or the police department should be contacted. Mankowski will contact the sheriff's department r , McDermott mentioned the Don Rye the Community Development Director is writing a work plan regarding docks. The LAC will be involved in 2 r , r r providing input for the work plan. McDermott will talk with Don Rye to get an update on the status of the work plan. IV. NEW BUSINESS V. OTHER BUSINESS a. Meeting times and dates were discussed. Alcorn mentioned that he would like to see a schedule put together for the 2004 LAC meeting dates, Mirsch stated that the meeting dates are set as the third Tuesday of the month, Exceptions to this are made as needed. O'Keefe mentioned that in the winter a conflict exists for him on Tuesdays and was inquiring with the other LAC members if the date or time can be changed for the next two meetings. After discussing the matter the time for the next two meetings (December 16th and January 20th) will begin at 5:00 pm, b. Alcorn mentioned that the LAC should be informed on the DNR south access improvements. Alcorn asked if this project has moved ahead any further. McDermott stated that nothing has come in to the City from the DNR for the access improvements and that when it does the LAC will be made aware of the plan, VI. ANNOUNCEMENTS a. McDermott announced that the City has hired a consultant (Bonestroo) to do the surface water management plan, wetland inventory, and natural resource management plan, These items are to be completed by the end of 2004. b, McDermott would like the LAC to review private shoreline erosion projects, c. Alcorn asked who could help get information out on the website regarding some of these issues. Maybe Captain Jacks or the Marina could be used for placement of flyers, McDermott responded that the City now has a new Communications Coordinator (Nathan Oster) and that maybe Nathan can come to one of the meetings to discuss these issues or even set up articles for the Wavelength. 3 ,..-.
