HomeMy WebLinkAbout11-107 Chrisitie Registered Land Survey 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 11 - 107 A RESOLUTION APPROVING A REGISTERED LAND SURVEY FOR TWO SINGLE FAMILY RESIDENTIAL PROPERTIES ALONG 150 STREET NE AND SETTING FORTH CONDITIONS TO BE MET PR IOR TO th RELEASE OF THE REGISTERED LAND SURVEY Motion By: Keeney Second By: Erick son WHEREAS, The Prior Lake Planning Commission c onducte d a public hearing on August 22 , 20 11 , to consider an application from David Coker and Carter Christie for registered land survey; and WHEREAS, Notice of the public hearing on said registered land survey has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS, All persons interested in this issue were afforded the opportunity to present their views and objections related to the registered land survey for the record at the public hearing conducted by the Planning Commission; and WHEREAS, The Planning Commission and City Council have reviewed the registered land survey according to the applicable provisions of the Prior Lake Zon ing and Subdivision Ordinances and found said registered land survey to be consistent with the provisions of said ordinances; and WHEREAS, The Prior Lake City Council considered an application for such registered land survey on September 6, 2011 ; and WHE REAS, The City Council has the authority to impose reasonable conditions on a registered land survey . NOW THEREFORE , BE IT HEREBY RESOLVE D BY THE CITY COUNCI L OF PRIOR LAKE, MIN NESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. T he registered land survey is approved at properties located at 5994 150 Street NE and 6002 150 Street NE th th subject to the conditions set forth in this resolution . 3. The registered land survey is subject to the following conditions, which shall be met prio r to release of and recording of the registered land survey : a) The registered land survey approval is subject to approval of variances from the minimum lot width , which the Planning Commission approved on August 22, 2011 . b) The applicant must provide proof of installation of all subdivision monumentation within one (1) year from the date of recording the registered land survey , or prior to issuance of a building permit, whichever occurs first. c) The applicant shall obtain any applicable required permits from all applicable governmental agencies. d) The registered land survey shall be recorded at Scott County within 60 days of approval by the City Council. Failure to record the documents by November 6 , 20 11 , will render the registered land survey null and void.
