III.OLDBUSINESS A.PAHOrdinanceUpdateRossBintner,WaterResourcesEngineer,informedthe LACCommitteethatthePriorLakeCityCouncilapprovedaPAHbanordinance attheApril18,2011CityCouncilMeeting.Bintneraddedthattheordinance wasmodeledaftertheWhiteBearLakeordinance. AlcornrequestedBintnertoreviewthehighlevelbenefitsofaPAHban ordinanceandtoexplaintheadvantagestothecommunityandspecificallyhow itwillaffectthelake.Bintnertalkedaboutthecoaltarderivativesandasphalt emulsionsthatarecurrentlybeingusedasdrivewaysealersthatmake drivewaysappearblacker.BintnerreiteratedthatcoaltarshedsPAHmaterials andtheseingredientsareknowntobepotentialhumancarcinogens.Hesaid thatwhencitypondswererecentlytested,resultsshowedhigherthannormal levelsofPAHincontaminatedsediment.Bintnerexplainedthatpondsare meanttocleanoutnutrientsandsediments;however,pondscanalsotrap exotictypesofchemicals.Thesechemicalsdirectlyaffectourponds,lakesand streams. ViceChairMankowskiinquiredwhethertherewasanalternativeproductthat couldbeusedandwhattheeffectwereonbusinessesthathadusedthat productbeforetheban.Bintneraddedthatmostbusinesseshadalready stoppedsellingtheproductbecauseofliabilityreasons.Mankowskiaddedthat thetypeofasphaltsealersthathomeownersbuyfromlocalhardwarestoresto sealtheirdrivewaysaresafeandcanstillbeusedbythegeneralpublic. 1 B.OTHERBUSINESSʹTherewasnootherbusiness. ChairMankowskiinquiredwhatthecurrentlakelevelwas.Bintnerresponded 903.58andthatthelakelevelwasdropping.Weningerinquiredaboutthe͞EŽ WakeŽŶĞ͟height.Bintnersaidthata͞EŽWakeŽŶĞ͟levelǁĂƐŶ͛ƚset becausetherewasnotthreedaysata904elevation.ChairMankowskistated thatweŚĂĚŶ͛ƚreceivedthepredictedrainsothereforea͞EŽWakeŽŶĞ͟was neverputinplace.Bintnerencouragedallboaterstotravelslowlytoavoid shoreerosionthatcanhappeninhigherwaters.Alcornreiteratedthatthelake levelhastobeata904elevationforthreeconsecutivedaysandthattheCity thenpostsitonthewebsiteandnotifiestheproperauthoritiesbutcurrentlythe lakelevelisdecreasingandtheoutletisopen. IV. STAFFUPDATE GRANTPROJECTSUPDATEʹŝŶƚŶĞƌexplainedthatthecitycurrentlyhasfive activegrantprojectsgoingwithvariouspartners.Twoarepartneredwiththe EPA,MPCAandtheUniversityofMinnesota.TheyaretheMinnesotaFilter,Iron SandFiltrationSystemwhichtargetstheintensivestreetsweepingstudy.A coupleoftheprojectsarealsopartneredwiththePriorLake/SpringLake WatershedDistrict.TheCountyRoad12Improvementsarestillunder constructionandtheŽƵĚŝŶ͛ƐNeighborhoodWaterQualityRetrofitwhichwill begininthespring.TheotherprojectisthePondsParkWaterUseandis partneredwiththeScottWMO. Bintnergaveashortpictorialpresentationonhowthedetentionpondswere designed,built,andtheirfunction.Hesaidthattenretentionpondswerebeing builtonvarioussiteswithintheCity.HeaddedthattheUniversityofMinnesota willbesettingupmonitoringsystemstoevaluatetheefficiencyofremoving phosphorus. ChairMankowskiquestionedthelifeexpectancyoftheironfilterandhowitwas cleaned.Bintnersaidthatbasedonconstructioncosts,replacingfiltermedia ǁŽƵůĚŶ͛ƚbeadealbreakerevenafteryear10orsofortheefficienciesthatwe areseeingintheprototypestudy. VollaskedhowBintnerwasmonitoringthevariousefficienciesfromtheproject. BintnersaidthattheUniversityofMinnesotawasourpartnerintheFederal319 ResearchandDemonstrationGrantandwillbesettingupmonitoringonthree ofthetensitesandgrabsampletypemonitoringwillbedoneontheothersites forthreeseasons,2011,2012&2013.Thedatawillbepresentedin2014.Voll askedifthatdatawillbebeneficialinacquiringadditionalgrantprojects. Bintnersaiditwouldtakeafewyearstoseewhatotherprojectscouldspinoff ofpresentprojectsandthatthefiltrationbodyofknowledgewilldefinitelybe helpful.Weningeraskedwhatthreeareaswouldbeintenselymonitored. BintneransweredSpringLakeRoadnexttoStemmerRidgeDevelopmentnear SpringLakeRegionalPark,WestburyPondsandoneothersitenotyet determined. 2 V.NEWBUSINESS A.2012WaterQualityBudgetʹBintnerexplainedthebudgetprocessandasset managementthatwasdoneforthe2011budgetprocessandtheJanuaryworkshop. HedidanoverviewpresentationandsolicitedLACfeedback. ChairMankowskiviewedtheTransportationPlanandinquiredifthe$150,000was beingusedforŽƵĚŝŶ͛ƐImprovementsandtheArcadia/CR21. WeningerquestionedwhytheWaterQualityFundamountwaslowerforCR12 th PhaseIVversusTH13and150Street.Shementionedthattherewereareasalong CR12,specifically,SunsetAvenuethatneedednewsewer,water,etc.Bintner offeredthatunlesstheCR12areaincludedSunsetAvenue,thatareaǁŽƵůĚŶ͛ƚneed waterqualityimprovementsbarringachangeofrulesfromtheWatershedDistrict. ChairMankowskiaskedifŝŶƚŶĞƌ͛Ɛpresentationincludedacompletebudget recommendationfor2012.Binteraddedhisrecommendations,talkedaboutthe 2030visionprocess,andaskedforLACinputregardingutilityincreases.Hetalked aboutpartneringwiththeWatershed,County,andTownshiptocleanupSpring Lake,andUpperandLowerPriorLakewithinthenext10yearsandwhatthecost wouldbetodoso.Alcornaskedhowwearedefining͞ĐůĞĂŶƵƉ͘͟Bintner respondedsothatwearerequiredtomeetStatestandardsandwhenlakesareno longerimpaired. AlcornaskedhowmanylakesinMinnesotameetthecurrentstandardandwhere PriorLakestoodincomparison.Bintnerrespondedabout40%areimpaired,that Spring>ĂŬĞ͛Ɛstandardis60microgramsperleaderandthatfiguresometimes doubledortripledandbecauseUpperPriorLakeisshallow,theconcentrationis sometimesashighasSpringLake.Alcornaskediftheimpairmentisprimarily judgedbyphosphorous.Bintneranswerednutrientimpairments,chlorophyll contents,clarityofwater,andphosphorusconcentrationsplayafactorinit. Weningeraskedifditchcleanupiscurrentlyworking.Bintneraskedhowmuchthe CityofPriorLakecansolvealoneespeciallywhencountyandtownshipditchesrun intoSpringLake. 20122016CapitalImprovementPlanBintnerexplainedthatinthe2030Vision, PriorLakeresidentsstatedtheyvaluethelake,careaboutourwatersandwantto protectthem.Hesaidthatthequalityofourwateraffectsthequalityofourhealth andthusthequalityofourlives.Anotherreasontomanagewaterisfloodcontrol. /ƚ͛Ɛalsoimportanttobeeconomicallyproactivenowforfuturegenerations.We explainedthattheCityisalsomandatedbythestateandfederallawandtheClean WaterActrequiringthecitytohaveaproperplaninplace.Alcornsaidthatthecity needstobeaccountableandaskediftherewereanystatefinancialpenaltiesthat wewouldbeheldresponsibleforifweĚŽŶ͛ƚmeettherequirementsforwater quality.BintnersaidthattheMS4permithascertainobligationsthathavetobe 3 metbythecityandaddedthattheCityofPriorLakehasbeenaboveaveragein implementingwaterqualityandwedonotriskgettingfinesatthistime. VollquestionedBintnerwhethertheTMDLstandardsaresetbytheMPCA.Bintner saidtheTMDListheplanforonewaterbody.IfitisunworkableorĚŽĞƐŶ͛ƚmeet standards,theTMDLcanbereopened.Bintnerthenpresentedagraphdepicting currentinfrastructureandpollutantreductionquality.Thefollowingprioritieswere recommended: 1)Maintaincurrentsystem 2)Enhanceexistingcleanwatersystemcapacity 3)Buildingnewcleanwaterinfrastructure Herecommendedthatthebudgetformonitoringcleanwateroutcomesberaised from$3,750to$10,000.Bintneraskedforinputregardingthecurrentstrategy. BintnersaidthattheStormwaterUtilityrateisscheduledtogoupfrom$7.50to $9.00pertwomonthperiodin2012butthatitĚŽĞƐŶ͛ƚgoupeachyear.He explainedthatitisasteptypeincreaseinthattherategoesaboutonceeveryfive years.Weningerquestionedtheutilityrateandifitcouldbepaceddifferently. ChairMankowskiaskedforabetterexplanationoftheutilityrate.Bintnersaidall singlefamilyresidentsarechargedat1/3ofanacre.Theycurrentlypay$7.25per everytwomonthsor$43.50peryear.Businessesandmultifamilyunitshave differentrates. Mankowskiaskedifthecountyorwatershedoranyothersourcescouldhelpwith fundingthebudgettocleanupthelakeswithinthenexttenyears.Bintnersaidthat thecounty,watersheddistrictandeveryonethatwantsbetterwaterqualityneedto stepuptohelppayforcleanup. Vollaskedwherethebiggestpollutantloadswerecomingfrom,thatthepublic needstobeinformed,andthereneedstobeateamsolutiontotheproblem. Bintnercommentedaboutthefutureresponsibilityoftheagriculturalcommunity, theproblemofDitch13andtheBuckLakesystem,etc.andsaidthatPrior Lake/SpringLakeWatershedandthecountyneedstotakeleadershiprolesalong withtheCityofPriorLakeinachievingourendgoals.VollcommentedthattheLAC needstofocusonthebiggestsourcesofpollution,communicatewiththecounty andwatershedsothatdollarscanbepooledtoreducepollutionloads.Hefeltthat residentsǁŽƵůĚŶ͛ƚmindanincreaseifthedollarsarespentwisely.Bintnersaid thereneedstobeacollaboratedteamglobalsolutiontotheproblem. Vollaskedwherethechangeshavetohappenʹatthestatelevel,watersheddistrict level,orLAClevel?Bintnerrespondedthatitcouldstartatthewatershedlevel. Weningeraskedifthewatershedhadadvisedhimaboutthechangefromtakingout agriculturallandandaddingmanyhomestothelandscapeandhowitaffectsDitch 13.Bintnersaiditisjustachangeinlandscapegoingonandthatsometimesthatis 4 abenefitbecauseyouhavelawnsversusfieldswherelargeamountsoffertilizerare appliedbutitmaynotbeenoughofachangetomaketheTMDLgoal. ChairMankowskiaskedifthecountyandwatershedhavedD>͛Ɛthattheyhaveto administersinceDitch13runsintoSpringLakeandthePriorLakeLACareaonly goessofar.Bintnerrespondedthatthecountyhadthesameprocessesgoingon andtheyalsohavemanyimpairedbodies.ShesaidthatifPriorLakeresidentsare payingforcleanupthenquestionedifagriculturallandownersshouldalsopaya contributionforcleanupontheircountytaxes.BintnerexplainedthatPrior Lake/SpringLakeWatershedDistrictandtheScottCountyWMOrunoffofad valoremtaxes.Mankowskiaskedifthereisanytalkaboutlegislationfortaxcredits tofarmerswhodogoodfarmingpracticesorifthereareanyregulations.Bintner saidthatalotofleadershipwillbeneededfromthelocalwatermanagersinthe watershed,ScottCountyWMO,etc. WeningerthoughtthattheScottCountyCommissionersshouldtakealookatthis situation.Bintnersaidthattheyareupontheissueandstrugglingwithitaswell. Mankowskiaskediftherewereanyadditionalquestions.Bintnercommented regardingthedraftoffutureLACtopics.HesaidthattheMS4PublicHearing requirementiscomingup.Theotheritemhementionedwasaboatorbustourin Augusttolookatthewaterbody.Bintnerannouncedthattherewillbetwo positionsopenontheLACandthatK͛<ĞĞĨĞ͛ƐandůĐŽƌŶ͛Ɛtermswillbeup. WeningeraskedifitwouldbepossibletotourSpringLakethisyear. Alcornnotedthatthenewoutletwasfunctionalandaskedwhocontrolledthe outlet.BintnerwillgetanupdatefromtheWatershedandwouldliketohavethe watershedtalkaboutthenewwatershedchannelatanupcomingmeeting. Mankowskiaskedifthesheriffshouldalsocometotalkaboutbuoysandtheboat safetyclass.Alcornaskedthenameofthenewsheriffandtheanticipatedhours thathewouldservicethelake.BintnersaidthattheLACshouldinvitehimtoan upcomingmeeting. Jasanbroughtupboatsafetyandwonderediftherewasawaythatmore informationcouldbegiventothepublic.MankowskisaidtheclassisaDNRclass andaskediftherecouldbealinkontheŝƚLJ͛ƐwebsitetotheDNRBoatSafetysite.
