However, this planting plan points to the need for such a standard in that the restaurant will be situated on a three quarter acre lot, eighty percent of which will either be paved or include a structure. The large mass of paving has few planting pockets that could both break up the paving and provide opportunities for shade. The City of Bloomington has a well developed set of standards that specifies among other things, that every business development will Include street trees with a minimum spacing of 25 to 30 feet. This particular proposal would be enhanced considerably by the addition of nine 2L. to 3" caliper balled and burlaped trees, five of which could be skyline locust with four Norway Maple. The attached draw- ing suggests approximate locations. Other suggestions would include breaking up the static row of amur maples along the east property line with addi_ional Mugho pine and perhaps even some shade trees for the parking lot. Without the second access on County 44 it also should be possible to include additional shrubbery pockets close to both street frontagee rather than to convert the entire space to off street parking. A last point concerns the recommendation for four Japanese Yews on the southside of the restaurant. Winter am can be particularly hard on these plants ultimately requiring their replacement. SOX 369 PRIOR 7..AKE, MINNESOTA 56372 84 CITY OF PRIOR LAKE M E M O R A N D U M TO: PLANNING COMMISSION FROM: STAFF RE: BURGER KING CONDITIONAL USE DATE; FEBRUARY 13, 1984 The primary reasons for Conditional uses is to allow flexibility in a district and -ontrol uses which have a significant impact on an area. The B-3 zone has been labled Prior Lakes highway commercial zone because of it's proximity along Highway 13 and large lots sug- gesting a vehicular mode of transportation to gain access to these uses. Over the years however, the three business zones have grown similar in the permitted use category. Instead of having defined and restricted zones for businesses and their different needs, the conditional use permit is used to assimilate the business into the district. The Burger King site is one acre located in the northeast quadrant of intersection Co. Rd. 44 and Hwy. 13. This intersection will receive signals in the summer of 1984. It is a highly visable site. The property directly to the south is zoned R -2 and developed with older homes. The adjacent lot to the east is vacant and zoned B -3. This site is part of the commercial mode bordered by Hwy. 13, Co. Rd. 44 and Franklin Trail. Highway 13 is Prior Lakes' main artery which links this node to the mat of the business centers and pro- vides the necessary daily traffic to warrant a fast food operation on the scale of Burger King. Access will be from Co. Rd. 44 which is a collector facility and can handle the traffic generated by Burger King. The westerly access to the site was not approved by MDOT and must be illinimated. The applicant will have an alternate site plan at the hearing showing only the easterly access. Forty six parking spaces are provided which meets the code requirements. Drainage is to the north into a culvert dumping into Hwy 13 ditch. The grading plan indicates a finished elevation difference of 6 feet from Co. Rd. 44 and the north end of the site. The knoll to the west of the site will be lowered by about 4 feet to increase visability. In general this site is similar to the Mc Donald's site at the other end of the Hwy. 13 commercial strip. The proposal conforms to the district in terms of vehicular organization, site design, landscaping and overall height and bulk. This use does not result in any conditions which may be dangerous, injurious or noxious to other property in the area. It produces a visual impression consistent with the area. In the interim the applicant must revise his lot plan to show the one acre lot size and only one access. The comments from the engineering department are attached and their stip- ulations be conditions of the Conditonal Use permit. 84 -02 CITY OF PRIOR LAKE TO: PLANNING FROM: ENGINEERING RE: BURGER KING DEVELOPMENT DATE: JANUARY 25, 1984 The site of the proposed Burger King restaurant in the northeast quadrant of T.H. 13 and CSAR 44 is served by sewer and watermains In the T.R. 13 R.O.W. and to the west of the site. A sewer main also exists in the CSAH 44 R.O.W. with a service line stubbed out rear the southeast corner of the site. The depth and size of the service are not called out on the plan but the main is shown 19 feet deep at the service stub. The sanitary sewer manhole cover an water gate valve box in the westerly exit must be adjusted to W" below the top of the bituminous driveway. No water service stub Is indicated on any of the adjacent watermains. The main wear the west property line appears to be the most convenient to connect to. Where the proposed grades will reduce the cover over this main, it must be exposed to determine if lowering or in- sulating will be necessary. The directives of the "Soil Erosion Notes" on Sheet C -4 must be strictly adhered to. Also, tmrf establishment must follow closely behind excavation. Permits will have to be obtained from the Minnesota Department of Transportation and the Scott County High- way Department, in addition to those required by the City of Ptior Lake. The next item on the agenda was to consider the Burger King Prelimi- nary Plat. City Planner Gra reviewed this for the Council. He stated that the Planning Commission held a Public Hearing on this on February 16, 1984 at which time this application was consid- ered. The recommendation of the Planning Commission was to approve the subdivision with 7 contingencies. (The tape is the legal record of the meeting and will be kept on file in the City Managers Office). He then reviewed Staff's memo dated February 13, 1984. He stated that it would be Staff's recommendation to approve the preliminary plat. The representative for Burger King was present and commented. There was discussion by Council and Staff. I Motion by Busse to approve the Preliminary Plat contingent upon the necessary documents received by the City and approved, and that the contingencies set forth by the Planning Commission be met, seconded by Thorkelson and upon a vote taken it was duly passed. The next item on the agenda was to consider the request from Burger d King for a Conditional Use. City Planner Graser reviewed this � for the Council. Huemoeller, motion by Busse to deny the request because of the potential of the Scots County lots being landlocked and Council's policy on not vacating any streets Intersecting with Prior and Sprinq Lakes, seconded by Thorkelson and upon a vote taken it was duly passed. City Manager McGuire read for the record the legal notice that was published in the Prior Lake American. aotion by Thorkelson to adjourn the Public Hearing, seconded by Schweich and upon a vote taken this Public Hearing was adjourned t at 8:54 PM. Mayor Johnson Lhen called the Road Vacation Public Hearing for aarger :ring to order. The published notice was read for the record. i City Planner Graser reviewed this for the Council. He stated that Burger Ring Corporation has petitioned for the vacation of 33 feet of roadway acquired through use located adjacent to the westerly property line of the parcel being subdivided. The roadway easement was acquired through use dating back many years. State law established a 4 rod road easement over a traveled or used road. Many County road easements were acquired this way. The City :.as no need for the 53 feet of right -of -way as road purposes. I� Item II, Conditional Use request by Burger King. Bill Ranek representative was present to answer questions. Mr. Ranek commented on the egress and ingress, parking stalls, drainage, Planting, deliveries, and lighting. City Planner Maser commented per memorandum dated February 13, 1984. Also reviewing the Staff New on Planting and Engineering. Audience input was taken at this time. Jim Vallez owner of the Laker Center commented on the ingress and egress in conjunction with his Center. The Planning Commissioners had concerns regarding traffic, deliveries and semi turn- around, drainage, and burning. Motion by Roseth to approve the Conditional Use request by Burger King for Parcel A based on the following contingencies. A. Engineering 1. Turf establishment must follow closely behind excavation. 2.
