MINUTES OF THE LAKE ADVISORY COMMITTEE
March 19, 1997
I. CALL TO ORDER
The Lake Advisory Committee meeting was called to order by vice-chair Tom Kearney on
Wednesday, March 19, 1997 at 6:37 p.m. Members present:, Marianne Breitbach, Kate
Haggerty, Tom Kearney, Doug Larson, Paul Trapp and Rick Warner. Others present were
Water Resources Coordinator Lani Leichty. Members absent: Chair Jody Stroh.
II. CONSIDER APPROVAL OF MINUTES OF MEETING
The first item on the agenda was to approve the Minutes of the meeting for February 19,
1997.
MOTION BY BREITBACH, SECONDED BY TRAPP TO APPROVE THE FEBRUARY 19,
1997 MEETING MINUTES. MOTION PASSED UNANIMOUSLY.
III. 1997 MILFOIL TREATMENT
The first item of discussion was to be a presentation from Clear Water Technologies. The
president of the firm called earlier in the day to cancel the appointment. The DNR and
MPCA wants more research done on this new method of treating milfoil before the
approve of the process.
The next item of business was to determine what areas on Prior Lake should be treated for
milfoil with DNR grant money in 1997. The committee decided on the following criteria
to rank lake channels for determining how DNR funds would be spent: 1) conformance
with DNR criteria, 2) navigational uses, and 3) public use. The channels were ranked
accordingly:
I ) Wagon Bridge
2) Wagon Bridge (railroad channel)
3) South of Reeds Island
4) Lords Street Bridge
5) Grainwood channel
6) Dewitte channel
7) East of Twin Isle
8) West of Twin Isle
9) Lake Front Park
10) Candy Cove
11) Old Boudins
12) Kneafsey's Cove
13) New Boudin's
14) Crystal Bay
15) North side of Government Island
16) Breezy Point
The above channels will be treated for milfoil in descending order according to the amount
of milfoillocated at each site.

The third item of the night related to milfoil was to prepare a 1997 budget for submittal
and approval by the watershed district. The following items will be included in this years
budget: 1) a lakeside demonstration project, 2) ads in the Prior Lake American about the
project, 3) fabrication of several W-rake pullers for removing lake weeds, these would be
made available at the rental store for public use.
MOTION BY LARSON, SECONDED BY WARNER NOT TO USE WATERSHED FUNDS
FOR TREATMENT OF MILFOIL ON PRIOR LAKE IN 1997. MOTION PASSED
UNANIMOUSLY.
IV. ORDINANCE RECOMMENDATIONS
Leichty asked the committee if they had any comments regarding changes to the existing
ordinances on wetland setbacks, ponding criteria, etc. No comments were raised at this
time.
V. NEW BUSINESS
The annual meeting with the City Council and LAC will be held April 7, 1997 at 5:30 p.m.
prior to the City Council meeting.
The committee had no comments regarding the preparation of the 1998-2002 CIP program
for the section pertaining to water quality projects.
VI. ADJOURNMENT
MOTION BY WARNER, SECONDED BY LARSON TO ADJOURN THE MEETING AT
8:22 P.M., MOTION PASSED UNANIMOUSLY.

Dear Frank and Paul:
This letter is a follow up to our meeting of March 6, 1997, and my January 7,
1997 correspondence regarding the above matter. Please be advised that I have
reviewed the October 28, 1996 from correspondence Attorney Clinton McLagan
regarding this matter.
Based upon Mr. McLagan's letter and applicable law, it is my opinion that the
Quit Claim Deeds to the Prior Lake Sportsman's Club are of no legal affect. As a
result, the Sportsman's Club has no legal interest in the Beach Lane property. Minn.
Stat. I 541.023 bars the Sportsman's Club from claiming an interest in the Beach
Lane property. In addition, the easement (originally created in 1910) was terminated
when it was separated by conveyance from the benefitting property to the east.
The property was dedicated for public use as a "Beach Lane n in 1953. As a
result of the dedication, the City of Prior Lake was entrusted with control and
maintenance of the Beach Lane for the public benefit. The party who dedicated the

property for public use (Carl Muhlenhardt) was the fee owner of the property at the
time of platting.
The Sport~m~n's Club has represented to the City Council that the Sportsman's
Club has a proprietary interest in Beach Lane. I recommend that the City Council be
advised of the status of this matter and this office' s opinion relative to the City's and
the Sportsman's Club's rights to the Beach Lane. If the City Council concurs, the
Sportsman's Club must be advised accordingly. According to the correspondence
from the Sportsman's Club dated November 12, 1996, it is there position that they
have exclusive rights to Beach Lane which I believe is contrary to the facts provided
me.
If I can be of further assistance on this matter, please advise.
