CALL TO ORDER The Lake Advisory Committee (LAC) was called to order on Wednesday, July 15, 1998 at 6:42 p.m. Members present: Marianne Breitbach, Kate Haggerty, Tom Kearney, Doug Larson and Rick Warner. Others present: Scott County Sheriff Bill Nevin, Rob and Janet Bradach, Lenny Gephardt, Dave and Gail Lind, Jim Peterson and Lani Leichty. Members absent: Roger Soderstrom and Paul Trapp. II. CONSIDER APPROVAL OF PREVIOUS MEETING MINUTES The first item on the agenda was to approve the minutes of the meeting for June 17, 1998. MOTION BY HAGGERTY, SECONDED BY WARNER TO APPROVE THE MEETING MINUTES OF JUNE 17, 1998. MOTION PASSED UNANIMOUSL Y. III. SURFACE WATER ORDINANCE ENFORCEMENT The next item on the agenda was discussions with Scott County Sheriff Bill Nevin about enforcement of the surface water ordinance and the recent boating accident on Prior Lake. Sheriff Nevin stated that during the month of June, 11 tickets and 47 warnings were issued on Prior Lake by enforcement officers. During the weekend of July 11, 4 BWI's were issued. He also stated that Yamaha will be donating 2 personal water craft to Scott County for patrol use through a loan program. The Sheriff was asked if lowering the no-wake elevation would make his job easier. He said that it did not really matter what elevation it was at, that enforcement would occur at any elevation. ~ Rob Bradach commented that he was told by someone at the Sheriffs Department that Prior Lake was patrolled only after 2:00 p.m. each day. He added that he would like to see the lake lowered from its current elevation. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER IV. LAKE LEVEL MANAGEMENT AND NO-WAKE ZONE The next agenda item discussed was the lake level and no-wake zone. Lenny Gephardt spoke about his concern with the high lake elevation and lack of aggressiveness concerning this issue. He mentioned that Lake Marion, in Lakeville, was very aggressive in changing the Ordinary High Water Level when the water was high in that lake. He was concerned about the short term and long term resolutions to high water levels. Larson mentioned that the outlet is for maintenance purposes only and that its intent was never for flood control. Larson also mentioned that the watershed is being proactive addressing upstream ponding and water quality issues. The LAC directed the water resources coordinator to get a letter from the DNR stating the process to be followed in changing the ordinary and normal water levels on Prior Lake. MOTION BY HAGGERTY SECONDED BY WARNER TO HA VE THE WATER RESOURCES COORDINA TOR INVESTlGA TE WHA T ACTION WOULD HA VE TO BE TAKEN TO HA VE THE DNR MODIFY/CHANGE THE NORMAL WATER LEVEL MORE THAN 1.5 FEET BELOW THE ORDINARY HIGH WA TER LEVEL. MOTION PASSED UNANlMOUSL Y. MOTION BY LARSON SECONDED BY WARNER TO STUDY THE NO-WAKE ZONE AS DIRECTED BY COUNCIL. MOTION PASSED UNANIMOUSL Y. The committee discussed what course to take in addressing the no-wake zone elevation. Because of the magnitude of this issue, it was decided that it would be best to acquire opinions from as large a segment of the community as possible. The committee determined that a questionnaire placed in the July 25, 1998 Prior Lake American would be the best way to do this. Along with the questionnaire, a paragraph should be added saying that a public informational meeting mayor may not be held, depending on the results of the survey. Leichty agreed to draft six questions related to the no-wake zone elevation and if the public would like to see it raised or lowered. The questions will be faxed to the members for additional input before going to the paper for publication. v. NOTIFICATION PROCESS FOR CLOSURE OF CITY LAKE ACCESSES The next item of business was to address the closure of City owned accesses and the process to be followed for this eventuality. After discussions of the different scenarios involved with closing the lake to the public and/or closing only City accesses to the lake, it was decided that it would be best to close all accesses to the lake at the same time or to keep all of them open. The thought was that it would be confusing to the public if City accesses were closed and the DNR accesses were left open to the lake. MOTION BY LARSON SECONDED BY HAGGERTY TO TAKE NO ACTION IN REGARDS TO THIS ISSUE. CITY OWNED LAKE ACCESSES WOULD NOT BE CLOSED UNLESS THE DNR ACCESSES WERE CLOSED AND THE NOTIFICA TION PROCESS TO BE FOLLOWED WOULD BE THE SAME AS THE UNSAFE LAKE CONDITION PUBLIC NOTIFICA TION PROCESS. MOTION PASSED UNA NIMO USL Y. VI. NEW BUSINESS Dave and Gail Lind, residents of Prior Lake, were present to share their thoughts and experience from a boating accident on July 1, 1998. While boating they were broad-sided by a personal watercraft. Ms. Lind read a letter that she had prepared in advance. The Lind's would like to see an increase in enforcement of existing laws on the lake. They mentioned that the City can set tougher ordinances on the lake than required by the State. Mr. Lind said that posting the basic ordinances at the accesses may help. Larson mentioned that people do not read the signs at the accesses, but that education needs to begin at home and it starts with a $700.00 ticket! Mr. Lind stated that he believes enforcement needs to be increased on the lake. Ms. Lind asked the question, "Is there was adequate enforcement on the lake?" She thought that this needed to be looked at further and hopes that their experience speeds up regulations regarding this issue. VII. If you have not listened to the audio tape of the City Council meeting when this directive was formulated, you may find such action useful. I believe that the City Council is seeking the Lake Advisory Committee's input on the following areas: 1. Can any action be taken to reduce the 902.5 or 904 water levels established by the D.N.R.? 2. What additional information can be provided to lakeshore owners to help them protect their shoreline and comply with lake-related regulations? 3. Based upon a review of the lake enforcement regulations currently in place, the actual violations taking place on the lake, and any other inputs, should steps be taken to enhance surface water enforcement? Examples include: a) Can/should the City try tq have a level ofless than 904 for No Wake implementation? b) Should/can the City add restrictions for Personal Watercraft? c) Can/should hours of skiiing, personal watercraft use, high speed watercraft use, etc. be established daily for the lake? d) What other additions/deletions or modifications are required in the ordinance to improve safety? 4. Are there enforcement measures that could be added to the existing enforcement activities to enhance the effort? The LAC seems to have addressed 1 and 2 but not 3 and 4.
