Present were Cmmissioners Arnold, Kedrowski, Loftus, *11s, City Planner Graver, and Assistant City Planner Garross. City Planner Grazer stated that Mr. Bergla d was in the hospital. Also Mr. Graver oomented per memos dated May 17, 1988 and May 19, 1988. At 7:38 P.M. City Manager Dave Utmcht atepped into the Council Chambers to greet the Commissioners. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion passed unanimously. At this time the Planning Commission directed staff to draft a letter to the applicant strictly adhering to the contingencies stipulated at the April 21, 1988, Planning Commission meeting. At this time a 15 minute recess was called. The meeting resumed at 8:15 P.M. ITEM V - DON AND SHARON LVFRSCM VARIANCE RFaUEST Sharon Iverson oommented that they need a 5' west side yard variance for Lot 12 Block 2 North Shore Crest for aesthetic purposes since the garage would Lee in the middle of the lot unless moved over 5 feet. Also there would be no way to move equipment to the hack yard unless the variance is acquired. Assistant City Planner Garross oaamented per memo dated May 19, 1988. The Planning Commissioners discussed this item. Upon a vote taken, ayes by Arnold, Kedrwski, Loftus, Hmseth, Wells; the motion passed unanimously. At this time a 25 minute recess was called. The meeting resumed at 8 :45 P.M. ITEM VI - C HAIa.FS YOUWYORSI' VARIANCE RF XWr Charles Youngvorst commented that he is executor of his mother's estate and would like to acquire 2 building permits for Lots 30, 31, 32 and Part of Lot 33 Lakeside Park. There was a replatting and 2 buildable lots of 13,000 and 14,000 square feet and 2 separate PID numbers were assigned to this property in 1986. But due to the new Shoreland Management District single family waterfront lots in the shoreland district is 15,000 square feet and 2 abutting substandard lots under the same ownership must be combined. Rmaver, if this would be the case here a loss of 840,000 in joining the lots would be a hardship. Since 900 of the single family properties on the lake are less than 15,000 square feet this request would not be out of character. Since there is a buyer for one of the properties, time is a relative element here. Also this new law is discriminatory in who is affected. A recent variance request by the Hedberg's was granted and that was a similar situation. City Planner Graser commented per metro dated May 19, 1988. Also the Hedberg variance was a lot split and variance combination which made that different than this situation. The Planning Commissioners were divided in their feelings on this item. This is a controversial issue and since the City Council is holding a workshop on Tuesday, May 24, 198& to discuss substandard lakeshore lots a continuation would be desirable. Upon a vote taken, ayes by Arnold, Eedrwski, Loftus, Roeeth, Wells; the motion passed unanimously. Matt Nielson discussed the long range planning, transportation, and anticipated development in a westerly direction, both north and south of Com.-, Road 42. The City of Savage is processing approximately 400 housing permits per year compared to Prior Lake's 150. The anticipated growth pattern for the City of Savage is in a westerly direction and will impact Prior Lake in terms of additional students in Prior Lake School District 719 and added traffic on County Road 42 and 13. Mr. Nielson explained that Savage is in the process of reviewing their Ooapnrehensive Plan and zoning regulations. There are no specific policies which address development along the intersection of Highway 13 and 42, however, it is anticipated that same type of intend" oumsarcial use will be likely at that intersection. There are concerns with congestion and safety in all 3 corners of County Sued 42 and 13. Therefore, a joint comamication effort between Savage and Prior take is iWurtant regarding development along County Road 42 and State Highway 13. Ch Hoseth thanked Mr. Nielson and presented him with a Prior Lake lapel pin, paper weight, and thank you card. Present were Commissioners Loftus, Wells, Assistant City Planner Garross, Commissioner Kedrowski arrived at 7:32 P.M. and Commissioner Arnold arrived at 8:16 P.M. ITEM ii - MRS OCCUPATION PEWIT EMM BY MGM BBRENS Edward Berens, 16423 Duluth Avenue SE, commented that he and his wife would like to start a small air conditioning and heating business out of his home. There will be no equipment stored outside around the house, only in his van when he does business. Assistant City Planner Garross commented per memo dated May 5, 1988. Dorothy Bess, 16433 Duluth Avenue SE, objected to the business next door to her hare. She felt it would devalue her property and a fence should be put up. Other area residents felt this business would not be detrimental to the residential area. The Planning Oommissioners discussed the Some Occupation request and felt that if the business expanded or any complaints were received, a review would be necessary. Ms. Schmudlach commented that a hand out would be given to the Commissioners and that she would return at a later date after they had time to review the material. Also, the City Council has approved the Highway 13 Task Force recommendations. The Downtown Development needs input from outside sources. Two major developers are considered at this time. The transportation concern for Prior Lake transit riders will be meeting on Monday at 7:00 P.N. Mother item of concern is the solid waste issue which a workshop is scheduled for. At 8:30 P.M. Chairman Roseth passed the gavel to Vice Chairperson Wells due to another meeting conflict. Due to a conflict with their Planning Commission meeting on the same day and a heavy schedule of item, Mr. Nielson was unable to attend this meeting. He will try to attend the next Planning Commission meeting on My 19, 1988. The Commissioners discussed the Amoco service station development.
