The January 15, 1981 meeting of the Prior Lake Planning Commission was called to order
by Chairman Fitzgerald at 7:30 P.M. Present at the meeting were Commissioners Fitzgerald,
Arnold, Wilker, Roseth, Foster, and City Planner Graser. Councilman Bissonett was absent.
The minutes of the December 18, 1980 Prior Fake Planning Commission meeting were re-
viewed. Motion was made by Commissioner Roseth to approve the minutes as written, sec-
onded by Commissioner Foster. Upon a vote taken, the motion was duly passed.
Item I, a request for a road variance by James O'Brien was called to order ly Chairman
Fitzgerald. Mr. O'Brien was present at the meeting to answer questions
City Planner Graser made his presentation to the Planning Commission as ter tiis memorandum
dated January 15, 1981. He noted that Mr. O'Brien is requesting a variance from the zoning:.
code for a private road on his property. Mr. O'Brien owns 120 acres north of County Road
42 and adjacent to Pike Lake. City Planner Graser listed the advantages and disadvantages
for private roads as fol &ows:
Advan
1.. No public investment in either construction or maintenance.
2. No snow removal.
3. Provides more development options.
4. Less expensive for buyer.
S. Taxable resource not otherwise available.
6. Would foster development clusters.
Disadvantages:
1. No public controll over division of land.
2. No public involvement in preservation of adequate right -
of -way for potential future public use.
3. Potential seal off from urban densities because of a re-
luctance to duplice urban services.
4. Agreements establishing right -of -way enforceable only pri-
vately.
5. Once an access is created it is unlikely to change.
6. Zoning ordinance does not yet include provision for private
P.U.D. in agricultural areas.
City Planner Graser stated that staff made a recommendation to postpone a decision until
such a time that this could be incorporated into the new zoning code.

Mr. O'Brien commented on this request. Mr. O'Brien stated that it was his intention
to put a private drive through this property and then to sell it in smaller parcels.
The Planning Commissioners discussed this item. There was concern about the proposed
zoning code and how any decision on this request might have bearing on later provisions
of the zoning code.
Chairman Fitzgerald called for a motion on this request.
At this time Mr. O'Brien asked to withdraw his request so that he would have the option
of appearing before the Planning Commission once the new zoning code has been adopted.
Motion was made by Arnold to adjourn the January 15, 1981 Prior Lake Planning Commission
meeting, seconded by Commissioner Roseth. Upon a vote taken, the motion was duly
passed and the meeting was adjourned at 8:30 P.M.
