Stock called the meeting to order. - Present were Mayor Stock, Council

membe.rs Schweich, Scott, Busse, Thorkelson, City Manager McGuire; City
'
Engineer Anderson and City Planner Graser.
Mayor Stock asked everyone to please rise for the pledge of allegiance.
MINUTES
The minutes of March 7, 1983 were reviewed.
The following correction is to be made to the minutes of March 7, 1983:
Page 1: Paragraph: 19 Delete: "Ulrich" Add: "Aldridge"
Motion..by Thorkelson to approve the minutes of March 7, 1983 as amended,
seconded by Busse and upon a taken it was duly passed.

The next item on the agendawas to discuss the upcoming meeting.on the

Minnesota River Crossing.
Mayor Stock updated the Council and stated that the final hearing will be

on March 22, 1983 to be at the Hennepin Technical Center on the South
Campus. Open house will begin at 6:30 PM:and the Public Hearing will
follow at 7:30 PM, he encouraged the,Councii and Public to attend.
MTC LEGISLATION
"The next item on the agenda was to discuss the status of the Metro.-Transit
Legislation.'
City Manager McGuire reviewed the status for the Council stafI6g f hat Mayor.,__,_
Stock, Hank S i nda, John Anderson and h i m s e l f appeared before the Senate
Transportation'Committee last Tuesday and requested that the Legislation
being onsidered not be
g ..passed, which woul,d,be closings "loop hole" in
the 1982 Legislation. He further stated that the intent of the law would
,.
be that any money that waS left over between the system that Prior Lake
would set up would go back to the MTC. He then stated that the way the

law turned out reading was all the money that was left over would be left
in the as a savings to the tax payers.

There was general discussion by Council.
Mayor Stock stated that the next item would be discussion on the Reservation
RESERVATION Ii`
'Annexation:
ANNEXATIbN
City Manager McGuire reviewed the annexation for the Council. He stated
that approximately six months ago the City was notified by the Bureau of
Indian :Affairs that the Reservation was requesting annexation of 40 acres
into the Reservation. The annexation would have the same status as the
Reservation land and would be put into a trust. The annexation is for 40
acres and for approximately 10 single family dwelling units.' It was approved
even though the City voiced their objections on the annexations because it
was not an area scheduled for development, and concerns were shown on the

use of septic systems.

Motion by Thorkelson to authorize Ci:ty McGuire to contact the City

Attorney's office to inquire about their expertise in this area and if

they would have a recommendation and that the authorize pursing
the annexation that has been finalized by the Bureau of Indian Affairs,

City Manager g r McGuire reviewed the Original Park Annexation for the
Council stating that Louis Stassen requested approximately two years g
agg that his property be included in the Original Park Annexation.. t

Mayor, Stock directed City Manager McGuire to contact the City Attorney
on the impact of future liability and to express the City's concerns.

CITY HALL City Manager updated the Council on the remodeling of City Hall. i.
REMODELING

¢ It was finally ordered that the Stassen property would become part
of the City!of Pri Lake, there are several conditions, one`I there
must be a direct,road access from Tower Street to the Stassen Property
somewhere by the bowling alley so all traffic would not be on Mlzsh-
town'road. He further stated 'that it has been approved and it is

approximately 18 acres and the date of the order was March 10 1983.
There was general discussion by the Council.
DEVELOPMENT
The next item that was brought up for discussion was the Island 'View
ISLAND 'VIEW
residents concerns on the development in their_ neighborhood.
Mayor Stock stated that on March 11, 1983 met with Denny McWilliams,
`
the "developer for `that area and the residents of Island View and
discussed the development. The stipulations were ail presented by
Denny McWilliams, they also addressed the development for the ake-
shore for the back lots and how they were to be developed.' The
assurances were given by the developer and the residents,:of Island
View felt satisfied with the comments "from the `developer and what he
proposed for that neighborhood.
-LAKESIDE
The next item on the agenda was to continue discussion on Lakeside
MARINA
Marina.
City Planner Graser reviewed Jim Dunn's request for additional dock -`
age at Lakeside Marina for the Council. He stated that the Marina is
still a non - conforming use in the opinion of'the City Attorney and
therefore must foitOw the procedure set forth in the 'Prior Lake City
Code 5 -3 -4. HelUrther stated that Mr. Dunn must present his request
to the Planning Commission for review. The other option Mr. Dunn has

is to submit under the Conidtional Use section of the City Code.
Mr. Dunn commented and stated that he probably would not continue
under the non- conforming use and would go through the procedure of

the conditional use.
There was general discussion by Council and Staff.'`.
OUTLET - WATER
Mayor Stock brought up to the Counc'il's attention that the gate
SHED
to the outlet on Prior Lake was opened today by the Watershed District
and the Watershed District was proposing some daming on some upstream
takes.
Cleve Mickley was present for questions ar, = comments.

Mr. Mickley stated that under Chapter 1.12 which the Watershed District
operates under, states that they have to have facts and Engineering
data before they can do anything. He stated that they did meet and
declared an emergency. Following the data they pursued to open the
gate, The other steps that were taken was to place temporary dams
on the lakes of'Sutton and Fish, "they were unable to dam Spring due to
the water being. too high.
Mayor Stock stated his concerns on the fact that the City does have a
Joint Powers Agreement along with the City of Shakopee and the Water -
shed District that the City was suppose to endorse the opening of the
ate and the did not have the o

of the Agreement.
