motion passed unanimously.
: The Council then returned to Item #3 on the agenda to review the bids for ttie
bond sale. Mr. Mattson reooammerded awarding the bid to the ➢ oW biddei, Merrill`
Lynch. Finance Director ftwt er indicated that if that bid was accepted, the
interest- rate on the assessments, would be 8.5%. Discussion by the Council
followed.

The next its cn the agenda was to discuss a settlement offer for them Richard
Menke assessment appeal. City Engineer Anderson briefly gave the background on
the three lots\, owned by M_Menke and the drainage problem on the lots. City
Attorney reseal informed the Council that Mr. Henke's attorney Was proposing a
re&ction in the total assessments of $6,118.40 for Tract G Tract H and Outlot
A by $3.000.00,. .An appraisal provided by Mr. Menke's attorney indicated that
the value of Tract G had not increased in value by the improvement.
Comments.. were made by the audience favoring no reduction in assessments.
Discussion by the Council followed.

Council on February 24, 1986.
A fifteen minute room was then called.
Mr. Mattson asked�l;he Council for time, to review the Merrill Lynch bid.
Time Council then moved to the next item on the agenda Which Was to consider a
Resolution authorizing First Frame Inc. to submit an application for revenue
bonds. Economic Development Director Urmacht distributed copies of the

resolution and application as prepared by Briggs and Morgan. The bonds would be
for the renovation of Prior Place. Mr. ihmacht stated that on the Application
U,
the land acquisition cost should be $25,000 and the property development cost
should be $150,000; and on page 5, #5 of the resolution 'Mayor or Clerk-
Treasurer' should be changed to "Mayor or Manager ". Normally a public hearing
Would be held prior to Owl application being submitted, however, because the
state may not allocate funds for a, sports facility, they are requesting
authorization to submit the application_ first to determine: if funding will, be

issued. Discussion by the Council followed.

The next item on,,the agenda Was to consider 'the proposed outline for the Council
By- Lars. Each item of the outline was reviewed by, City Manager McGuire and
discussed by the audience and Council.` Staff will "prepare a draft copy of the
Council By -Lars from the outline incorporating the changes, and recommendations

Mayor Andren called the meeting back, to order at 11:00 p.m.
The next item on the agenda was to consider a special assessment abatement.
City Manager McGuire explained that Parcel #25 926 026 0 was purchased by Dr.
Donald Abrams at the County's tax, forfeiture sale in 1985 and the special
s. assessments were not canceled. Therefore, an abatement is necessary according
to Minnesota Statute. 282.07.

The next item on the agenda Was discussion of a ooanmuuty'`.plan. Councilmember>

Fitzgerald reviewed the' framework in It was intended to' provide a
means for long -range planning and establishing`a community identity. It was the
general consensus of the Council that this is something the City needs and
Councilber Fitzgerald and Staff-are to select a committee to begin working on
it

Mayor Andren distributed copies of a request free Joe Speiker for a four -gray
stop at Franklin Trail and County Road 44. Discussion by Council -And Staff
followed. Staff was requested to conduct a preliminary study of the pedestrian
traffic area at that intersection and to contact Scott County ERA for their
eonoenns and report back to the Council in a couple of weeks.
City Manager McGuire distributed copies of a letter from Jack Oakes to the
Co�urcil for their information. n.
The next Council meeting will be Monday, February 10, 1986 at 7:30 pm.
There being no further business, the meeting adjourned at 12:14 a.m, by general
consent of the Council.
