The Common Camil of the City of Prior Lake met in regular session on Monday,
May 19, 1986 at 7:30 p.m. in the City Council Chambers. Present were Moycr
Andren, Councilmembers Busse, Fitzgerald, Scott, White, City Manager MaGuirep
City Engineer Anderson, City Planner Graser, Assistant City Manager/Economic
Development Director Unmacht and Intern Garross.
Mayor Andren called the meeting to order and asked everyone to rise for the
pledge of allegiance.,
The minutes of the May 12, 1986 meeting and the invoices scheduled for payment
on Tuesday, My 20, 1986 were reviewed by Council.
City Manager MoGuire indicated that the minutes of April A, 1986 were correct
as submitted, therefore, page 1, paragraph 3 should be omittedL from the minutes
of May 12 1986. ,
Councilumber White indicated that the following, sentence should be added to
pup 2, paragraph 1 of the minutes:
'*Council instructed the Sioux Community to look at the idea of paying for
the entire project and then collecting back later for the oversized costs
out- of hookup charges. a
Counci I ', 1 White also pointed out that there was a discrepancy between page
4, paragraph 9 of the minutes and the agenda report for the May 19, 1986 meting
regarding the addenduis to the zoning certificate for the Marina rvpde. Mr.
White indicated that the minutes did state the notion correctly.

Andrenj the notion passed,
The next itent on the agenda was the continuation of the public hearing for the
J, Steffens Road Vacation and Subdivision. Mayor Andren called the
continuationof thi public hearing to order at 7:36 pm. The tap will be kept
an file , in.the Office of the City Manager as the official record of the public
haaring.

City Planner Graser indicated the continuation of the public hearing was to
allow time for the evaluation of the intersection of Willow Lane and Pershing se
Street. Mr. Grar stated that the developer and Staff net with residents of
Inguadona Beach Circle and the most acceptable alternative to all concerned was
a curve with a 150 foot radius. Lot 50 of Inguadona Beach would have to be
acquired for the road and this would make Lot 1 of Willows 6th buildable.
Approximately 200 feet of Inguadona Beach Circle would have to be realigned for
a right angle intersecti �i
Discussion was opened to the audience. James Terwedo, attorney for the
Inguadona Beach Association, indicated they favored the 150 foot radius curve
and that this alterneit:ve would require the least amount of land lost. He
distributed copies of a letter from the Minnesota Department of Transportation
that supported this design also. Mr. Terwedo also informed the Council that in
1917 a permanent easement along- the present Dreyfus Avenue was given to the
people of Inguadona Beach and is still present today. It is an underlying.
easement and the City could not vacate it. Mr. Terwedo indicated that if the
150 foot radius curve was put in the people of Inguadona Beach would eliminate
the easemment, grant the necessary easements for the road realignment and would
cooperate With the acquisition of Lot °50..
Greg Halling, engineer for the developer, indicated that the developer would
support the 150 foot radius curve, but because the developer has lost several
lots through changes to the plat, he does not feel he should be responsible for
the roadway in another plat.
Discussion by the Council followed regarding the size of Lot ; l, who pays for the
.: road eonrkc:tirg the neighborhoods and ownership and maintenance of the road.

City Manager Md uire asked for a clarification of items #3 and #6. On item #6,
the developer is`to pay for the construction of the road however, the City will
asstae the responsibility of acquiring the road right- of-way" and necessary
easements. On item #3 no construction refers to no house construction.

The next item on the agenda was to consider a� rezoning request -of C.G.T
Properties. Intern Garross presented the request Jt6r 3.5 acres of '0-1 District
1
located east of the intersection of Albany Avenue And Cates Street be rezoned to
R-1 residential use. Ms. Garross informed t4 Council that the planning`

domrmission had denied the request at the May 1, 19:86 public hearing. Staff was
L that appcoxImtely 1.25 acres above: the 921.3 elevation should be
rea!w to R-1 residential use and the land mass lbelow that level remain as
Conservation District.
Mayor Andren read for the record a petition MOW by seventy area residents irv-
opposition to the rezoning. The petition will ! became part of the permanent

files in the Office of the City Manager.
Andrew Franklin, 4294 Pleasant Street S.E., presented slides to the CrA=il
shoring the wildlife living in this conservation area and asked the Council to
consider requiring the developer conduct an envirormental impact study for that
area.

Ted Schweich, representing C.G.T. Properties, indicated the original request
was for 3.5 acres to be rezoned, however, they would agree now with rezoning the
1.25 acres above 921.3 feet.
Other members of the audience addressed the Council supporting that the land
remain as it is.
Discussion by the Council followed concerning the development: of the land if
rezoned and the fact that the land has been assessed for sewer` and water and
probably should be allowed to be developed. Mayor Andren did point out that
one house could be built on, it now with the present zoning. Further discussion
followed.

Discussion followed clarifying rezoning 1.25 acres versus rezoning the land
above the 921.3 foot elevation. Councilmember Fitzgerald specified that he
would ace If t adding "approximately 1.25 acres" to his motion as long as it is
clearly understood that no land under the 921.3 foot elevation be rezoned.
There was further discussion on the subdivision of the land to ensure that no
land under the 921.3 elevation be included. Oouncilaovber Fitzgerald asked
! that Staff watch closely and if any fill is put in, to tamper with the lay of the
land that is to`rawain zoned C-1, the pro be tagged immediately.
Upon a vote taken, ayes by Busse, Fitzgerald, Scott, and white= nay by Andren;
the motion Weed.

variance granted by the Pluming Commission included the mowing of a drainage
pips common to Sidney M*ns' property and Bruce Lindell's Pr rty. The Pipe

will not sign, an easement now. The construction of Mr. Lindell's home has

Mayor Andren called the meeting back to order at 12:10 a.m.
The next item on the agenda was to consider the request of Caboose Cruise Lures.
City Planner Grayer reviewed with the Council the happenings of the previous
sleeting and that Staff was instructed to formulate a manner in which to license
or expand the zoning certificate of Marina Royale to allow Caboose Cruise to
`operate. Mr. Grazer indicated the Zoning Ordinance does give the Board of
t4bustment the poorer to change legal nom conforming uses.
Neyor srdren.read a letter from Loren N. Barta attorney representing a number
of property owners residing adjacent to the Marina Myale, opposing the
operation. of Caboose Cruise Limes on Prior Lake. The letter will be kept as
part of the permanent files in the Office of the-City Manager.
1L Discussion was opened to the audience. Mncine Miller presented copies of. a
petition to the Council from adjacent property owners on the .lake opposing the
operation., This petition will also be kept as part of the penmw* files.
Other 'members of the audience commented. Mr. Rod Stankovich, owner of Caboose
Cruise Line, Inc. was present to answer questions.

zoning certificate if Mr. Dunn concurred, and that he talked with the State
Liquor Control and they indicated a setup license was not necessary if he was,

$12,236.00. Quotes were solicited from five contractors, but only one quote was
received from C. R. Braizere Inc. of rrior Lake for $11,076.75. Braizer
indicated that all work would be colleted by June 2, 1986.
