The C=on Council of the City of Prior Lake not in regular session on Monday
September 15, 1986 at 7:30 p.m. in the City Council Chambers. Present were Mayor
3 Andren, Councilmeabers Busse, FitageraVA, Scott, White, City Manager FbOuire,
3 City Wgineer Anderson, City Planner Graser, Assistant City MonagoVloonmic
Development Director Otieacht, Assistant City Engineer Loney, Intern Garross and
City Attorney Nelson. Finance Director Ten deer arrived at 8 :03 p.m.
Mayor Andren- called the weeting to order and asked everyone to rise for the
pledge of allegiance.
The minutes of the September 8 1986 meeting were reviewed by Council.

Upon a vote taken ayes by Andrea, Busse, Fitzgerald. Scott, and White, the
motion passed unanimously.
The invoices scheduled for payment on Tuesday, September 16, 1986 were reviewed
by Council.

Plan amen3rni regarding Raspberry Ridge. Greg Ropischke stated that as a
remlt of a useting held with the neigbborhood, the developer was proposing a
revised ptelininny plat. This revised: plat now consisted of 91 lots instead of
93, four lots were ramowed in the development at the end of Raspberry Ridge Rand
to prawzve the wetlands ad it is proposed to dedicate this laid to the City
for park purposes`with C-1 zoning. The developer, Wart WbIgh, read for the
record a letter outlining restrictions for the development that were agreed upon
by the neigbborbood and the developer.
City Plainer Graserr commented on the letters received free the Department of
Ittural Aesourcen and the Sail Conservation Service regarding the preservation
of the wetlands. Mr. Grayer presented three different exhibits for lots at the

opposition. to the Comprehensive Plan amendment. He further stated they would
agree to a minimum frontage of 95' for the lots facing Manitou Road if those
ham had a minim= setback of 30 feet.
Discussion by the Council followed regarding the plat, the procedure to follow
since preliminary plat approval had been given by the Council before, and if
consideration of the preliminary plat should be, delayed a week to allow wore
time to review the new proposed plat. City Attorney Nelson advised that the
Council has the authority to approve the revised preliminary plat without taking
it back to the Planning Ca■ mission. It was the consensus of the Council to
consider the plat at this time and not delay it a week.

Upon a vote taken, ayes by Andren, Busse, Fitzgerald, Scott, and White, the
motion passed unanimously.
A five. minute reoeRs Was then called. -
Mayor Andren called the meeting back to order at 8:54 p.m. Mayor Andren stated
that the next item on the agenda was the assessment hearing for Project 82 -3
North Shore Trunk Sewer and ►rater and because she was a property owner involved
in this project she would be vacating the chair. Acting Mayor Scott then
presided at the meeting.
Acting Mayor Scott called the assessment hearing for Project 82 -3, North Shore
Trust Sewer and Nntenmain to order at 8:55 p.m. and read for the record the
notice of the public hearing as it appeared in the Prior Lake American on Proj. 82-3
September 1, 1986. The tape will be kept on file in the Office of the Cityiwth
Manager as the official record of the public hearing. an

Finance Director der reviewed the project 'cost_, summary stating that the Hmrft
total cost of the „project is $2,416,.374 and the assesamrent rate is $124.42 per
front foot. $2,097,429.88 or, 88% of the project is being assessed which
includes connection fees. '$?92,344.i2 or 12% of the project (which - excludes
Green Acres special levy) is�to be paid by ad valorem tax. Mr. Teacher
explained the City's assessment pol icy, showed samples of assessments and annual
payments, informed the property owners of alternate methods of payment, and
reviewed the fees for connection to the utility system.
City Engineer Anderson reported.on the effect of not paving Beach Street. The,,
rate would be reduced by $1.10 per foot if Beach Street was not paved and from a
cost/benefit analysis, it would not appear to be in the best interest of the
residents to not pave Beach Street. Mr. Anderson also reported on the rate of
the acreage: charge. He explained that the reason for the acreage charge was to
equalise the asse+eaeent between large and small parcels with _different frontages
and to 'reflect trunk charges for sewer and eater facilities- to the
neighborhoods. Um calculating the actual trunk charges within this project,
the cost was less than $2,500 per acre, and, therefore, an increase in the cost
was not reooammended.

002 0> because of removing all the trees abutting the lots and twitting a storm
sever pond in that area. Discussion of the Council followed.

addressed the Council opposing the amount of the indefinite deferred assessment.
Finance Director Tesch►er explained that the pareel`is not a buildable parcel at
this tine. The special assessment would never have to
be paid as 'long as the
parcel is left as it is. The amount of the indefinite deferred assessment is on
the assessment roll so that if the parcel is ever sold in the future, the buyer
of the parcel would be'aware of the special assessment on the parcel. There was
discussion by Council on dais - and the other two ,parcels with indefinite
deferred assessments and if those amounts should appear on the assessment roll.

There was further discussion by the Council on the three parcels With the
indefinite deferred assessments. City Engineer Anderson pointed out that the
Cushing parcel was assessed a paving amount that was not deferred and this was
inconsistent with the assessment of the other parcels. Discussion followed.

The next itik on the agenda was to continue the discussion on the Titus II
Addition. This its was tabled at the Anguat 18, 1986 meeting to get an opinion.

pimided stating the plat wee asended by the road vacation and no substantial
**cal activity and investment has occurred in the plat for over two years.
In order to develop the plat, the applicant would be required to comply with the
current plat subdia{s on requirements and would have to resubmit the
plat for review and approval.
