HomeMy WebLinkAbout4A SMSC RLS Report4646 Dakota Street SE Prior Lake MN 55372 , PLANNING COMMISSION AGENDA REPORT MEETING DATE: MARCH 3, 2014 AGENDA #: 4A PREPARED BY: JEFF MATZKE, PLANNER PUBLIC HEARING: YES AGENDA ITEM: CONSIDER A REQUEST FOR APPROVAL OF A REGISTERED LAND SURVEY DISCUSSION: Introduction The Shakopee Mdewakanton Sioux Community has applied for the approval on a registered land survey on approximately 41 acres of land to define the limits of Torrens designated property under fee ownership. The property is located north of Hwy 82 and east of Hwy 17. PID 25-932-006-0, 25-932-008-1, 25-932-012-0, 25-932-008-2 Current Circumstances The applicant proposes to designate two tracts of land under a registered land survey. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS: Total Site Area: The total site area consists of approximately 41 acres. The current properties contain vacant areas as well as areas that encompass the western portions of the Meadows Golf Course and a residential house site at 15279 Howard Lake Road. Wetlands: Wetlands are located on in the northern part of the property. Access: Access to the property is currently from County Highway 82 (Howard Lake Road). 2030 Comprehensive Plan Designation: The property is designated R-RD and C-NR for Rural Density and Neighborhood Retail Shopping uses on the 2030 Comprehensive Plan Land Use Map. Zoning: The property is located within A Zoning District (Agricultural). Shoreland: The properties are located within the Shoreland District of Howard Lake and are subject to the City’s Shoreland Ordinance. The proposed registered land survey will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. Therefore, staff recommends that the Planning Commission recommend approval of registered land survey subject to the following conditions: The registered land survey shall be recorded at Scott County within 60 days of approval by the City Council. ISSUES: In cooperation with a Scott County District Court case to issue a decree of Registration the Shakopee Mdewakanton Sioux Community has been requested to file a registered land survey (RLS). This registered land survey is intended the delineate the limits of the Torrens property owned in fee title in the City of Prior Lake in a 41 acre which includes a portion of the Meadows Golf Course property and areas west of the golf course. ALTERNATIVES: 1. Recommend approval of the registered land survey subject to conditions. 2. Table this item to a date specific, and provide the applicant with direction on the issues that have been discussed. 3. Recommend denial of the registered land survey request. RECOMMENDED A motion and second recommending approval of a registered land survey for MOTIONS: 41 acres into 2 tracts of land, subject to the above listed conditions. EXHIBITS: 1. Location Map 2.
