DISCUSSION:
Introduction
DBOW Properties and Crest Exteriors LLC have applied for approval of an
amendment to the Planned Unit Development (PUD) known as Crystal Bay on
property located south of CSAH 82, directly east of Fremont Avenue and ap-
proximately'/2 mile west of CSAH 21.
History
The Crystal Bay Planned Unit Development (PUD) was approved by the City
Council on December 1, 2003. The approved PUD Plan included 24 townhouse
units in 12 buildings. The proposed townhouses were a 3 -story walkout, at-
tached single family style dwelling with an attached garage. Each of the units in
these buildings included a 3 -car garage, rear yard decks, and approximately
4,610 square feet of floor area. The buildings are 34' high at the front, with
exteriors consisting of a combination of brick and stucco.
In October of 2004, the City Council granted a minor amendment to the origi-
nally approved PUD. The proposed amendment affected the style, size and
exterior elevations of the townhouse units. The 3 -story walkout buildings were
replaced with a rambler style unit, with a 3 -car attached garage, a rear yard
deck and a four season porch. The exterior of the building consisted of Hardie
Board siding and shakes, rather than stucco and brick. The ground floor area
of the units remained approximately the same, and the units fit into the existing
envelope lots.
In 2008 and 2012, the City Council granted other amendments to the PUD
which allowed for the remaining residential lots to change construction styles to
detached single-family units and then again to the attached twin -home units.
ISSUES: The current request involves a major amendment to redesign of the 4 twin
home units near the center of the development from attached twin homes to 3
separate detached single-family units. Grading and site plans that were previ-
ously approved with the 2004 PUD Amendment would be altered slightly for
the reduction of 1 unit. The proposed impervious surface amounts for the area
would be lowered by over 4,800 square feet (26% reduction) over the previ-
ously approved amounts for the 4 lots. The exact impervious surface square
footage will be reviewed for compliance with these newly proposed amounts
with each individual building permit.
Section 1106.607 of the Zoning Ordinance allows the City Council to approve
minor amendments to an approved PUD Plan by resolution following notifica-
tion of all owners of property within the PUD. A major amendment include
"changes in approved use classifications, changes to the approved final plat,
increase in residential density, leasable floor area, building height, and/or re-
quired parking, reductions in useable open space, and any changes that are
anticipated to result in off-site impacts as determined by the Zoning Administra-
tor. "
The main issue is whether or not the proposed amendment will change the
character of the PUD. The proposed amendment does decrease the amount
of impervious surface by approximately 332 square feet. It should also be
noted that the proposed single-family homes will contain the same design,
color palette, materials, and scale, with the exception of having space between
the individual units. The spacing between the proposed single-family homes
will have over a 10 foot separation.
Conclusion
The Planning Commission must review the proposed amendment to the Final
PUD and make a recommendation to the City Council. City Staff believes the
attached townhome design will maintain the existing character of the Planned
Unit Development. No other changes to the approved PUD Plan are proposed
which would impact streets or utilities. An adjustment of the existing drainage
and utility easement description will need to be made since the lot lines would
adjust with the proposed plat. Therefore, City Staff recommends approval of
the PUD Amendment subject to the following conditions of approval:
1. The developer must obtain the required permits from any other state or local
agency prior to any work on the site.
2. The final plat is subject to the approval of a drainage and utility easement
vacation by the City Council.
3. The developer shall comply with a request by CenterPoint Energy to provide
suitable easement rights for location of a nearby gas main.
4. Heating and cooling units may encroach into the required side yard setbacks
and building separation.
ALTERNATIVES: 1. Motion and a second to recommend approval of the PUD Amendment sub-
ject to any listed conditions as identified by the Planning Commission.
2. Motion and a second to table this item to another meeting and provide the
developer with direction on the issues that have been discussed.
3. Motion and a second to recommend denial of the request.
