HomeMy WebLinkAbout90-02CENSUS '90 RESOLUTION 90-02 EDA RESOLUTION OF THE PRIOR LAKE ECONOMIC DEVELOPMENT AUTHORITY APPROVING REDEVELOPMENT PROJECT NO. 2 PLAN MOTIONED BY ANDREN SECONDED BY BARSNESS WHEREAS, the City Council of the City of Prior Lake, Minnesota (the "City"), established the Prior Lake Economic Development Authority (the "Authority") which has the powers contained in Minnesota Statutes, Section 469.090 to 469.108, the powers of a housing and redevelopment authority under Minnesota Statutes, Sections 469.001 to 469.047 or other law, and the powers of a city under Minnesota Statutes, Sections 469.124 to 469.134 or other law; and WHEREAS, it is desirable and in the public interest that the Authority undertake and carryout establishment to a redevelopment plan pursuant to Minnesota Statutes, Sections 469.001 to 469.047, encompassing the area which is more particularly described on Exhibit A attached hereto and make a part hereof, (which area is herein called "City of Prior Lake, Minnesota, Economic Development Authority Redevelopment Project" or the "Project"); and WHEREAS, the Authority has reviewed "City of Prior Lake, Minnesota, Economic Development Authority Redevelopment Project Plan, dated February 20, 1990," (the "Plan"), which sets forth a redevelopment plan for the Project; and WHEREAS, pursuant to Minnesota Statutes, Section 469.027, the City's Planning Commission has been consulted with concerning the establishment of the Project and adoption of the Plan; and WHEREAS, pursuant to Minnesota Statutes, Section 469.028, Subd. 1 the Authority after determination that the Project should be undertaken shall apply to the City for approval of said Plan; and WHEREAS, there was presented to this meeting of the Authority for its consideration and approval a copy of the Plan. NOW THEREFORE BE IT RESOLVED by the Prior Lake Development Authority, as follows.' Economic Section 1. That the area described in the Plan is a Redevelopment Project within the meaning of Minnesota Statutes, Section 469.002, Subd. 14. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372 / Ph. (612) 447-4230 / Fax (612) 447-4245 Section 2. Section 3. Section 4. Section 5. Section 6. Section 7. That said Plan and Project will carry out the purpose and policy of the Minnesota Statutes, Sections 469.001 to 469.047. That said Plan in all respects is approved and the secretary is hereby directed to file said Plan with the minutes of this meeting. That application is hereby made to the City Council of the City of Prior Lake for approval of said Plan and the staff of the Authority is directed to transmit a copy of the Plan along with a copy of this resolution to the City Council. That the City Council was previously requested to hold a public hearing on the Plan after giving published notice of the date, time, place and purpose of such hearing in a newspaper of general circulation in Prior Lake, such notice to be published at least ten days and no more than thirty days prior to the date of the hearing. That the City Council is hereby requested to approve said Plan and Project and to find by resolution that: (A) the land in the Project area would not be made available for redevelopment without the financial aid to be sought; (B) the Plan for the Project area in the locality will afford maximum opportunity, consistent with the sound needs of the locality as a whole, for the redevelopment of such area by private enterprise; and (C) the Plan conforms to a general plan for the development of the city as a whole. That the staff of the Authority is directed to transmit to the State of Minnesota Department of Trade and Economic Development a copy of the Plan as required by Minnesota Statutes, Section 469.012, Gend White President Adopted this 20th day of February, 1990. EST: D~vid J: Uh~'~c~ S~cretary EXHIBIT A TO PRIOR LAKE ECONOMIC DEVELOPMENT AUTHORITY RESOLUTION NO. 90-02 The boundaries of the City of Prior Lake, Minnesota, Economic Development Authority Redevelopment Project are identified as follows: Commencing at the intersection of the northwest right-of-way line of Trunk Highway 13 and the south right-of-way line of 170th Street; thence northeasterly along said northwest right-of-way line of Trunk Highway 13 to an intersection with the west right-of-way line of Duluth Avenue; thence north along said west right-of-way line of Duluth Avenue an intersection with the north ri~ht-of-way line of Anna Trail; thence east along said north right-of-way line of Anna Trail continuing to an intersection with the west right-of-way line of Brunswick Avenue; thence south along said west right-of-way line of Brunswick Avenue to an intersection with the north boundary line of the Colonial Estates Subdivisions to an intersection with the east boundary line of Parcel # 25-902-042-0; thence south along said east boundary line of Parcel # 25-902-042-0 and continuing south to an intersection with the south section line of Section 2, Townshi~ 114, Range 22; thence west along said south section line to an intersection with the northwest right-of-way line of Trunk Highway 13 and there terminating.
