SUBJ: Minutes From 75-6 Meeting
DATE: April 16, 1975
The Park Board held Meeting 75-6 at the City Hall on April 10, 1975 at
7:30 PM. Members present, were; Devitt, Patchin and Williams -- absent;
Kalton. Guests were; W. Sullivan, Louise Anderson, Larry Wiemken and
Bob Singewald.
Patchin called meeting to order. Minutes from 75-5 Meeting were approved-~~
I. Lake Front Park
A. Tree Planting Project - Sullivan reviewed the tree planting plans
(see attachment}. Even with the recent snowy weather, trees are
still anticipated to be available April 25. Saturday, April 12
the planting areas will be staked. Because of the availability
of volunteer help, a question was raised as to whether the prep-
aration of the grounds should be done a week ahead of time or
coincide with the planting. SUllivan to pursue with the group
leaders that shovels for ground preparation are needed and that
the shovels should be identified with name and telephone number. ~
Plowing up nursery area is being coordinated with J. Kop.
M/S/P Williams/Devitt - Sullivan to rent two satellites for the
planting weekend of Apri-1 26.
B. Water Quality Study of pOnd -
M/S/P Williams/Patchin - To accept ~aterson Engineering Assoc.
pond study proposal as defined in the attached document. Costs ~
are not to exceed $1800.00 without Park Board authorization. ~
Sullivan to generate an acceptance letter to B. Paterson and also
invite him to the April 24 Park Board Meeting to clarify points
of the study and answer any questions.
Williams to present pond study project e'nd costs to the City
Council for approval.
C. Snowmobile Trail Problem - Singewald and Wiemken reviewed pro-
gress from the snowmobile committee meeting of March 25. Commit-~
tee emphasis to date has been placed mostly on the County Trail
System and very little attention given to the snowmobile problems ~
in Lake Front Park. ~
Snowmobile trail discussion was tabled until the committee has
had an opportunity ~o address the problems in the City Parks.
D. Improvement Plans -
M/S/P Devitt/Williams - Sullivan to have City Engineer and C.
Tooker prepare an implementation program, with costs, for the
baseball fields, hockey rinks, tennis courts, rest rooms, utility
building {vandal proof} with concession stand, lighting, etc. by ·
the May 8th Park Board Meeting. Israelsons layout of the facility .
area for project 74-15 should be used as an initial point of
reference. Implementation costs should be broken down by category
(baseball fields, hockey rinks, etc.). Current plans are to let
bids on specific projects within a couple of months.
E. Other - No discussion.
II. Willows Park - No discussion.
III. Memorial Park - No discussion.
IV. Boudin's Manor Park
A. M/S/P Williams/Patchin - Sullivan to have City Engineer and
Tooker prepare finalized grading plans for the Park so excess
fill from the sewer project in the area can be used, if need
be.
B. Warming House Will be Moved - Sullivan to remove stove from
inside warming house ASAP to prevent any destruction by vandal-
ism.
V. Other Business
A. Candidates for New Park Board Positions - Candidates for the
new Park Board positions were reviewed. A technicality exists
with L. Anderson because she lives outside the City limits.
M/S/P Williams/Devitt - Table Park Board appointments until the
April 24 meeting. Legal advice on L. Anderson to be received
by then. Sullivan to obtain clarification on L. Anderson from
City Attorney.
B. Purchase of Vehicle Restriction Signs - Twenty-five {25) signs
at $6.10 per sign have,been purchased-~ Sullivan to purchase
100 steel posts for erection of the vehicle restriction and
Park property signs. ~.
C. Lease 'of Beach Property - No discussion.
D. Green Oaks Property Dedication - Sullivan to inform C. Tooker
that title has been received and he should prepare preliminary
plans for this Park.
E. Boudins Manor - The Ci__~ has received ownership of Lot 50 and
the East half of Lot 51 in Boudins Manor. Since ownership of
these Lots are provided with lake access thru a 10 ft. strip of
property in the original Boudins Manor area, does this now mean
that any Cit____y resident can access the lake via the same 10 ft.
strip?
Sullivan to present the above question to the City Attorney for
legal clarification. ~'
Next Park Bord meeting is Thursday, April 24 at~:30 PM i~n the City
Council Chambers.

Gentlemen'
RE' Sanitary Sewer service to the Lakefront Park ballfields.
Mr. Williams has asked us to look into the possibility of
serving the ballfield area with sanitary sewer service. We
have reviewed the area and find that the ballfield area could
be served by gravity sewer through the North along the route
of the watermain to Red Oaks Road.
Depending on the competitiveness of the bidders, the install-
ation total cost should run between $14,000 and $16,000.
If the Park Board is contemplating this.facility within
next few years, it would be wise to have this installed
before the parking lot and roadways are paved.

this time we would like to beg the councils indulgence in giving
us time to form this corporation.

Park Board this petition as follows:
We request the Park Board to not consider any disposition of
the above described property to anyone but our corporation.
We also request the Park Board to make recommendation to the
Prior Lake City Council to vacate and dedicate the above described
property to our corporation.
The undivided one~welveth~ portion of this property would become
a part of each owners Certificate of Title and would therefore
change ownership along with the titled property.

DATE: April 28, 1975
The Park Board held Meeting 75-7 at the City Hall on April
24, 1975 at 7:30 PM. Members present were; Devitt, Kalton,
Patchin, Williams. Guests were; W. Sullivan, D. Watzl, E-
Watzl, G. Fredrickson, S. Callaway, M. Myster, R. Myster,
D. Benson, R. Peterson, B. Paterson, W. Green, G. Griffith,
E. Mortenson, R. Buckeye, C. Buckeye, E. Duoos and D. Duoos.
Patchin called meeting to order. Minutes from 75-6 meeting
were approved.
Lake Front Park
A. Tree Planting Project -
Sullivan reported that everything is go for this
weekend (April 26). City Maintenance crew is
scheduled to pick up the trees. Kop to plow the
nursery area {if ground not too wet} on Friday,
April 25. Areas 5,6,16,17,19,20 and 21 are to be
planted. Satellites-are to be relocated. Plant-
ing machine to be used in the nursery area.
Jaycees are to haul the trees tq~ the planting areas.
Sullivan to have parents and leaders park in the
Gravel Washer area and Methodist Church.
B. Water Quality Study of Pond -
1.Approved by Council - Council approved study of
pond by Paterson.
2. Hire Paterson - Paterson, of Paterson Engineering
Assoc., answered questions on the study. Park
Board reviewed the contract presented by Paterson.
M/S/P Williams/Devitt - Move the completion dead-
line for the pond study to November 15, 1975 in-
stead of 45 days after beginning of work. Paterson
was very receptive to the change.
Sullivan to present contract to the City Attorney
for legal re~iewal and if O.K. ~o~tain proper sig-
natures and return to Paterson by May 5, 1975.
NOTE: After reviewing the agreement on Friday morning
following our Park Board Meeting, I noticed that
compensation of $1825.00 was the cost of the
study. An earlier memo from Paterson had quoted
$1100.00 to $1825.00. Sullivan has been instruct-
ed to find out why the cost has gone to $1825.00
before contract with Paterson is signed.
C. Snowmobile Trail Problem -
M/S/P Kalton/Williams - The snowmobile trail is to be
relocated so it has an entry/exit point in the Gravel
Wash area, travels west across the pond to west avenue
and then north along park property to the lake.
This proposal does not provide snowmobiling in the
park area but only a trail between the City and the
lake. Sullivan to place map of modified trail system
in the local paper for two consecutive weeks.
Sullivan to place notice in paper for informational
hearing on new trail system at the May 22nd meeting.
Devitt to find out if park trail system is part of the
charter of the snowmobile committee. If it is to make
the above recommendation to them.
2. Entry Signs, Markers and Fences - No discussion.
D. Boating Access -
A limited discussion was held on providing a public
boating access facilities on Prior Lake. No action
taken.
E. Improvements -
1. Report on Grading Project - Area has been staked
by contractor.
2. Athletic Area PIWns - No activity. Sullivan to
follow-up on completion of the plans.
3. Sewer Service - Reviewed Isrmelson's letter on
costs to provide sewer service to Lake Front Park.
Sullivan to ensure sewer service is part of the
development plans.
F. Land Acquisition -
1. State Grant - Our State grant has been raised from
$105,000.00 to $120,000.00. Monies should be re-
ceived in June.
2. Re-appraisal of Watzl Property -
M/S/P Williams/Kalton - F. Wicker to re-appraise
Watzl property.
3. Condemnation Resolution -
M/S/P Williams/Devitt - City Attorney to begin
condemnation-proceedings on the Watzl property if
negotiations have not begun within 90 days after
Watzls have been sent a copy of the re-appraisal.
Sullivan to ensure the Council is aware of the
possible condemnation proceedings on the Watzl
property. Watzls' were present at the meeting and
are aware of it.
Patchin to look into the possibility of Watzls' re-
ceiving partial reimbursement for their appraisal
costs.
Patchin to have Wicker include the business income
from the Watzl property in the re-appraisal.
G. Other -
1. M/S/P Kalton/Williams - For=Kalt°n' Williams,
Patchin; Against=Devitt - Sullivan to authorize
City engineer to have hill along Red Oaks road
{by park sign} cut back to reduce snow drifting
onto road and beautify area. 50% of the costs to
be accepted by City Maintenance Department.
Williams to present the above resolution to D.
Busse (Commissioner of Streets}.
If acceptable, Sullivan should have Israelson pro-
vide a change order to Project 74-15 so this area
is included in the total grading and seeding pro-
gram. There will be fill available for the re-
creation area from this cut back.
II. Williows Park - Tooker not present - No discussion.
III. Green Oaks Park - Tooker not present - No discussion.
IV. Boudins Manor Park -
1. Fill has been placed in the area. Grading is about to
begin. Sullivan to have warming house moved.
V. Memorial Park - No discussion.
VI. Other Business -
1. Pixie Pt. Rd. Access Problem -
Cheryl Buckeye presented a petition from the property
owners of lots A through N of RLS1 of Eastwood, to have
the public roadway vacated and dedicated to their
corporation {which has not been legally formed yet}.
L. Griffith, attorney for W. Green informed the Board
that the only decision to be made was whether we (Park
Board} wanted the property as a Park. If not and the
City wants to vacate the property, it would revert back
to the abutting property owners.
Don Zywicki, representing Green Oaks area, stated the
people in Green Oaks were told they could use this lake
access when they purchased their h~mes. He and other
Green Oak home owners have been using this 'access to
the lake for swimming.
Comments were also received from R Peterson, D. Benson,
W. Green and E. Mortenson.
M/S/P Williams/Devitt - Refer the Eastwood Public Road-
way situation back to the Council with the information
that the roadway in question is not acceptable as park
property.
Sullivan to ensure the above is presented at the next
Council meeting.
2. Candidates for New Park Board Positions -
A. Letter from Mark Sullivan concerning L. Anderson -
city Attorney recommended no appointment because
she lives outside the City limits.
B. Appointment of C. Arnold - M/S/P Kalton/Patchin -
Recommended the appointment of C. Arnold to the
Park Board.
Sullivan to have recommendation presented for
approval at next Council meeting.
3. Possible Lease of Beach Site - No discussion.
4. Park Maintenance - I. Clemens has Ween hired by the
City as a full time Park Maintenance employee. There
is some question as to where the funds are to come
from since there was none budgeted for 1975.
Next meeting is Thursday, May 8th in the City Hall Council Chambers
at 7:30 PM.

THIS AGREE]X~ENT~ made and entered into this day of

reEistered professional engineer licensed to practice in and under the
la~'s of the State of ]V[innesota and hereinafter referred %o as PATERSON,
and the Park Board of the City of Prior Lake, Minnesota, hereinafter
referred to as the CITY,
1NITNESSETH;
WHEREAS, the CITY is in the process of planning for the
development of Lakefront Community Park and wishes to include the
various uses of the pond as a part of the overall park development' and,
1ArHEREAS, the CITY desires that a study be performed in and
adjacent to the pond to determine the conditions in the pond, the factors
responsible for these conditions, and the methods for improx~ng the
overall condition of the pond in relation to its possible use in conjunction
~ith the recreational needs of the park; and,
WHEREAS, several letters of proposal have been sent to CITY by
PATERSON expressin~ his desire to perform~cer~ain biological and physical
procedures to determine the aforesaid conditions and to prepare and to
present a written report of all findings and recommendations res{~lting
f-rom the testing procedures,
NOW THEREFORE, IT IS AGREED by and between the parties
hereto as follows'
1. AUTttORiTY & RESPONSIBILITY: All work necessary to the
performance and completion of the investigation, study, and report under
this Agreement sha]J be performed by PATERSON or ~mder his direct
supervision;
2. USE OF TECHNICAL ASSISTANCE: Nothing contained herein
shall be construed so as to restrain PATERSON :from employing such
expert assistance as he deems necessary so as to compile a final report
~.kich is as accurate and comprehensive as practicable;
3. STUDY PHASING: This Agreement, un]ess otherwise modified
in writing with the mutual consent of all of the parties hereto, shall be
for the performence of the initial, or Phase I, study and report. If,
after completion of the initial study, it is deemed desirable to perform
additional work, a letter of authorization shall be prepared by the CITY

outlining the work to be performed and the compensation therefore;
4. INCLUSION OF LETTER OF PROPOSAL: A letter of proposal
dated 28 March, 1975, siF. ned by PATERSON and addressed to CITY which
explains h~ detail the methods and procedures to be used is hereby made
a pa~ of this Agreement as {~ fully set out ]~ere~, ~a[d ]e~er a~ac]~0d
hereto;
5. INVESTIGATIVE PROCEDURE' The procedures to be used by
PATERSON in the gathering oF data shall be as follows'
a) POND BED: A physical and biological investigation shall
be made of the bed of the pond in from six (6) to ten (10)
locations to determine silt depth, type of bed material,
water depth at the sampling locations, biological classification
of plant and animal life livinf~ in and on the bed, chemical
analysis of concentrations of various metals, and bacterial
analysis and classification of micro-organisms;
b) DUMP SITE: A physical and biological examination of
materials shall be made by means of analysis of the water
obtained in two observation borings to determine whether
the existence of undesirable elements exist as the result
of the past use of the area as a disposal site;
c) POND WATER QUALITY: An analysis will be made of a
composite sample of the pond water to determine whether
detrimental elements exist and what effect these elements
may have in 1/uniting the use of the pond for recreational
purposes. The bio-chemical profile of the pond water will
be established through a series of tests, including, but not
necessarily limited to, Dissolved Oxygen, Chemical Oxygen
Demand, Biological Oxygen Demand, coliform Bacteria,
cklorophyll, phosphates, nitrates, turbidity, and algal speci
identification.
At the conclusion of this initial investigative phase, a final report
will be prepared and presented to the CITY;
6. T1]qE FOR BEGINNING & COMPLETION: All work to be
performed under thc terms o£ this Agreement shM1 be commenced at such
a time as thc water temperature is at an optimum for the fullest
disclosure of information, such date shall be not later than May 15, 1975,
assuming that all necessary contractual arrangements have been completed
to the mutual satisfaction of all of the parties hereto prior to May 5th.
A final report shall be completed and for~varded to the CITY within forty-
five (45) days after the date of the beginning of the work.

7. COIX~{PENSATION & SCttEDULE OF PAYI~{ENTS: The CITY shall
compensate PATERSON for work performed herein in the lump sum
amom~t of One-thousand eight hundred hventy-five dollars for the initial
Phase I study and report. Of this total amount, a retainer in the
of Four hrmdred fifty dollars shall be due and payable x~thin fifteen days
a£±er Lhe date of tkis Agreement and, in any case, shall be payable
on or before lX~ay 20, 1975. The remain/a~g amom~ of the lump sum ~ee
shall become due and payable within ten days af~cer the delivery of the
final Phase I report.
8. TER>%INATION OF THIS AGREEMENT: Tkis Agreement shall
not be terminated by the CITY prior to its completion except for the
good and suff/cient cause of non-completion in accordance with the time
schedule stated herein; nor, shall it be terminated prior to completion
by PATERSON except for the good and sufficient cause of non-payment
or untimely payment of fees as stated herein; however, it may be terminated
at any time upon the mutual and written consent of both of the parties
hereto;
9. SUCCESSION: This Agreement shall be binding upon the
parties hereto, and upon the successors, iF any there be, to the members
oF the Park Board o~ the CITY.

not appoint anyone to the Park Board who is not a resident of
the City of Prior Lake.
We, of course, can retain.expert personnel and I am sure the
Park Board would welcome anyone with her experience and background
to counsel them, but the ultimate decision, I believe, must be
restricted to Prior Lake residents.

DATE: April 28, 1975
The Park Board held Meeting 75-7 at the City Hall on April
24, 1975 at 7:30 PM. Members present were; Devitt, Kalton,
Patchin, Williams. Guests were; W. Sullivan, D. Watzl, E-
Watzl, G. Fredrickson, S. Callaway, M. Myster, R. Myster,
D. Benson, R. Peterson, B. Paterson, W. Green, G. Griffith,
E. Mortenson, R. Buckeye, C. Buckeye, E. Duoos and D. Duoos.
Patchin called meeting to order. Minutes from 75-6 meeting
were approved.
I. Lake Front Park
A. Tree Planting Project -
Sullivan reported that everything is go for this
weekend {April 26). City Maintenance crew is
scheduled to pick up the trees. Kop to plow the
nursery area {if ground not too wet} on Friday,
April 25. Areas 5,6,16,17,19,20 and 21 are to be
planted. Satellites-are to be relocated. Plant-
ing machine to be used in the nursery area.
Jaycees are to haul the trees tQ the planting areas.
Sullivan to have parents and leaders park in the
Gravel Washer area and Methodist Church.
B. Water Quality Study of Pond -
1.Approved by Council - Council approved study of
pond by Paterson.
2. Hire Paterson - Paterson, of Paterson Engineering
Assoc., answered questions on the study. Park
Board reviewed the contract presented by Paterson.
M/S/P Williams/Devitt - Move the completion dead-
line for the pond study to November 15, 1975 in-
stead of 45 days after beginning of work. Paterson
was very receptive to the change.
Sullivan to present contract to the City Attorney
for legal re~iewal and if O.K. °~tain proper sig-
natures and return to Paterson by May 5, 1975.
NOTE: After reviewing the agreement on Friday morning
following our Park Board Meeting, I noticed that
compensation of $1825.00 was the cost of the
study. An earlier memo from Paterson had quoted
$1100.00 to$1825.00. Sullivan has been instruct-
ed to find out why the cost has gone to $1825.00
before contract with Paterson is signed.

C. Snowmobile Trail Problem -
M/S/P Kalton/Williams - The snowmobile trail is to be
relocated so it has an entry/exit point in the Gravel
Wash area, travels west across the pond to west avenue
and then north along park property to the lake.
This proposal does not provide snowmobiling in the
park area but only a trail between the City and the
lake. Sullivan to place map of modified trail system
in the local paper for two consecutive weeks.
Sullivan to place notice in paper for informational
hearing on new trail system at the May 22nd meeting.
Devitt to find out if park trail system is part of the
charter of the snowmobile committee. If it is to make
the above recommendation to them.
2. Entry Signs, Markers and Fences - No discussion.
D. Boating Access -
A limited discussion was held on providing a public
boating access facilities on Prior Lake. No action
taken.
E. Improvements -
1. Report on Grading Project - Area has been staked
by contractor.
2. Athletic Area PIWns - No activity. Sullivan to
follow-up on completion of the plans.
3. Sewer Service - Reviewed Isrmelson's letter on
costs to provide sewer service to Lake Front Park.
Sullivan to ensure sewer service is part of the
development plans.
F. Land Acquisition -
1. State Grant - Our State grant has been raised from
$105,000.00 to $120,000.00. Monies should be re-
ceived in June.
2. Re-appraisal of Watzl Property -
M/S/P Williams/Kalton - F. Wicker to re-appraise
Watzl property.
3. Condemnation Resolution -
·
M/S/P Williams/Devitt - City Attorney to begin
condemnation-proceedings on the Watzl property if
negotiations have not begun within 90 days after
Watzls have been sent a copy of the re-appraisal.
Sullivan to ensure the Council is aware of the
possible condemnation proceedings on the Watzl
property. Watzls' were present at the meeting and
are aware of it.
Patchin to look into the possibility of Watzls' re-
ceiving partial reimbursement for their appraisal
costs.

Patchin to have Wicker include the business income
from the Watzl property in the re-appraisal.
G. Other -
1. M/S/P Kalton/Williams - For=Kalton, Williams,
patchin; Against=Devitt - Sullivan to authorize
city engineer to have hill along Red Oaks road
{by park sign) cut back to reduce snow drifting
onto road and beautify area. 50% of the costs to
be accepted by City Maintenance Department.
Williams to present the above resolution to D.
Busse {Commissioner of Streets}.
If acceptable, Sullivan should have Israelson pro-
vide a change order to Project 74-15 so this area
is included in the total grading and seeding pro-
gram. There will be fill available for the re-
creation area from this cut back.
II. Williows Park - Tooker not present - No discussion.
III. Green Oaks Park - Tooker not present - No discussion.
IV. Boudins Manor Park -
1. Fill has been placed in the area. Grading is about to
begin. Sullivan to have warming heuse moved.

V. Memorial Park - No discussion.
VI. Other Business -
1. Pixie Pt. Rd. Access Problem -
Cheryl Buckeye presented a petition from the property
owners of lots A through N of RLS1 of Eastwood, to have
the public roadway vacated and dedicated to their
corporation {which has not been legally formed yet).
L. Griffith, attorney for W. Green informed the Board
that the only decision to be made was whether we {Park
Board} wanted the property as a park. If not and the
City wants to vacate the property, it would revert back
to the abutting property owners.
Don Zywicki, representing Green Oaks area, stated the
people in Green Oaks were told they could use this lake
access when they purchased their hgmes. He and other
Green Oak home owners have been using this access to
the lake for swimming.
Comments were also received from R. Peterson, D. Benson,
W. Green and E. Mortenson.
M/S/P Williams/Devitt - Refer the Eastwood Public Road-
way situation back to the Council with the information
that the roadway in question is not acceptable as park
property.
Sullivan to ensure the above is presented at the next
Council meeting.

2. Candidates for New Park Board Positions -
A. Letter from Mark Sullivan concerning L. Anderson -
City Attorney recommended no appointment because
she lives outside the City limits.
B. Appointment of C. Arnold - M/S/P Kalton/Patchin -
Recommended the appointment of C. Arnold to the
Park Board.
Sullivan to have recommendation presented for
approval at next Council meeting.
3. Possible Lease of Beach Site - No discussion.
4. Park Maintenance - I. Clemens has been hired by the
City as a full time Park Maintenance employee. There
is some question as to where the funds are to come
from since there was none budgeted for 1975.
Next meeting is Thursday, May 8th in the City Hall Council Chambers
at 7:30 PM.
