PRIOR LAKE PARK ADVISORY BOARD MINUTES
March 10, 1975
The Park Advisory Board of the City of Prior Lake held meeting #76-5
at the City Councii Chambers on March 10, 1976. Meeting was caiied
to order at 7:45 P.M. by Pete Patchin in the absence of Chairman
3ohn Kaiton, with C. Buckeye acting as secretary. Members present
were: C. Arnoid, P. Patchin, C. Buckeye, D. WiIiiams and H. Graser.
Absent, 3. Kaiton.
· The minutes of the previous meeting were approved as submitted.
Presentations and Request.s
On February 26, 1976, Dennis McWilliams presented a preliminary plat
of a 38 acre portion of the Fisher Farm. A 5 acre park dedication
was offered at the corner of County Roads #21 and 83. Suitabiiity
of site for a park was discussed. Motion made by Buckeye, seconded
by Arnoid, not to accept said dedication. Motion passed 3-0.
Sand Point Beach
Motion was made by Patchin, seconded by ArnoId that we accept the
deveiopment pian as submitted by City Planner Charies Tooker with
the foiiowing exceptions:
a. Main parking iot would come off of Crest Avenue and occupy
aiready graded area, which is the westerly haif of area
designated as "open area."
b. That the access and parking Iot off of Shady Beach TraiI wouid
not be deveioped at this time and wouid be biocked off.
Motion carried 3-0.
H. Graser is directed to implement this plan previousiy adopted by
doing the foIIowing:
a. Grading and graveiing of entrance and parking iot off Crest
Avenue.
b. Grading, seeding and sanding of cove area.
c. Secure beach equipment (boat, rope, bouys, Iifeguard tower etc.)
d. Remodei existing wood buiiding into temporary beach house and
concession.
e. Erect "no parkin9" signs on adjacent portions of Shady 8each
Trail and Crest Avenue
f. Put up disclaimer si9ns.
9. Put up admission sign.
h. Lease or purchase, as economics dictate, satelite toilets.
i. Proceed with clearance and cle~.H~ ~ ~~ ~ ~ ~
buildin9s not in use.
THE CENTER OF LAKE COUNTRY
Motion made by C. Buckeye, seconded by Arnold to direct H. Graser
to carry out the above. Motion carried 3-0.
A directive, with the concensus of the board, was made to have H.
Graser prepare a lifeguard and admissions proposal based on the
followin9 criteria.
a. g hour days.
h. $5.00 per hour to secure adequate personnel.
c. Admissions personnel at $2.25 per hour.
d. To formulate admission policy based on $1.00 per car and/or
.25¢ a head.
Reports
Maintenance and DeveIopment- C. Buckeye
The VFW was asked to heip purchase refreshments for cien-up days at
Sand Point Beach. They complied with a check for'$50.O0 to be
accepted at a later date, with thanks accordingly.
Acquisition - P. Patchin
A brief appraisal of Brooks on the Lake plat, (setting value at
approximateiy $100,000.) has been filed with H. Graser. It then wii1
be reiayed to City Councii and Pianning Advisory Commission.
Nature and Wildlife - C. Arnold
Louise Anderson will attend Trail and Dutch Elm Workshop~on Ma~ch~11~?

Recreation - 3. Kalton - absent.
Park Commissioner - D. Williams - no report.
Park Planner - H. Graser - no report.
Motion by C. Buckeye, seconded by Arnold to adjourn. Meeting adjourned
at 9:40 P.M.
Next meeting has not been scheduIed at this time.

L__egql aspects of lifequardinq
Judges in various states have found owners, operahors~ supervisors or
lifeguards legally liable for drownings in all of the following situations:
where (1) there was failUre %o provide a lifeguard; ..(2) although lifeguards
were provided, %hey were found %o be insufficient in number or insufficiently
skilled; (3) %he operators failed %o provide resuscitation equipment or per-
sons skilled in artificial respiration; (4) the lifeguards, al%hough suf-
ficient in number and properly qualified, were in attentive) (5) i% was

shown %hah %he proper efforts were not undertaken or were not undertaken
promptly; (6) %he lifeguard failed %o prevent boisterous play.
The question of responsibility more often involves personal injury raqher
%tan death. Courts have repeatedly found %he opera%or or lifeguard liable
in these situations, amoung others: where (1) a diver injures a swimmer
by s%riking him·(this is perhaps %he mos% dramatic and common example of the
effects of lack of controlover the patrons by the lifeguard on du%y~%hese
are not cases of a spontaneous leap into the wa%er by a patron but are sub-
~stant~ated by testimony of consistent and continued lack of control by the
personel on duty) (2) there is continued runntng~ pushing and.horseplay
(here again %he lifeguard has the affirmative duty of controlling the patrons
so that they do not hurt themselves or Others); (3) there ~s defective play
equipment.
