HomeMy WebLinkAbout041789 AGENDA ITEM : PREPARED BY: SUBJECT: DATE: INTRODUCTION: DISCUSSION: #5 BILL MANGAN, DIRECTOR OF PARKS AND RECREATION PRESENTATION OF SAND POINT BEACH ACCESS PLANS AND AGREEMENT APRIL 17, 1989 This item is on the agenda for the purpose of reviewing and approving the Agreement between the City of Prior Lake and the DNR for construction of a public access on Prior Lake. Staff and the DNR have met several times with the residents of Shore Trail and they are in agreement with the plans. Enclosed is a copy of the Agreement; a drawing of the proposed plan, and a letter from Mike Markell to Dave Unmacht dated March 20, 1989. Staff has met with the DNR, City Attorney and the Attorney General to work out the contents of the Agreement. The Agreement, as prepared, includes items from the Council meeting of March 15, 1982, the 16 points outlined in a letter from Mike Markell to the residents of Shore Trail, and the recommendations that were applicable from the recent Sand Point Beach Access Task Force. The plans, as submitted, include changes from two meetings involving Staff, DNR, and the residents of Shore Trail. Modifications were made to meet the approval of the residents as well as City staff. In regard to the items not included in the Agreement from the March 15, 1982 Council meeting, the 16 points outlined by the DNR, and the Task Force recommendations, those items were determined to be City or County responsibility, not the DNR. In addition, if items were alreadr complied with or completed they were not lncluded in the Agreement. (612) 447-4230 / Fax (612) 447-4245 ~..-..-..,..-~"----t+---_..._---~"_.___~___~ BUDGET IMPACT: ALTERNATIVES: RECOMMENDATION: ACTION REQUIRED: The landscape plans will be completed upon approval of the Agreement and the plans. The landscape plans are subject to the approval of the City Manager. The DNR staff will be at the meeting to present the proposals to you. The construction of the public access will be funded totally by the DNR and will be maintained by the DNR. Staff would anticipate some costs to the City, likely in the area of staff time involved in the supervision and the enforcement of rules and regulations that will be necessary simply because the facility exists next to a City park. There are three alternatives to this proposal: 1. The Council can approve the Agreement and the plans as submitted in addition, this action would permit Staff to pursue items 4,6,7 and 8 of the Task Force recommendations. 2. The Council can approve the Agreement and the plans with any changes or contingencies so identified. 3. The Council can choose to not approve the Agreement and plans. Staff would recommend Alternative #1, to approve the Agreement and the plans as submitted. The plans have met with approval of the staff as well as the residents. The Agreement was prepared jointly by the DNR and the City Attorney and is satisfactory to both parties. A motion to approve Alternative #1 would be in order to approve the Agreement between the City of Prior Lake and the Department of Natural Resources to allow the DNR to construct a public access according to plans as submitted.
