MINUTES
JANUARY 13, 1997
The Parks Advisory Committee meeting was called to order by Tom Reddinger at 6:45
p.m. on Monday, January 13, 1997. Members present were Thea Fluhrer, Pat Heaney,
Tom Reddinger, Bob Rykken, and Tom Schutz. Ron Ceminsky and Kathy Smith were
absent. Pat Heaney left the meeting at 7:20 p.m. Staff members present were Paul
Hokeness, Director of Parks and Recreation, Bret Woodson, Recreation Supervisor and
Nancy McGill, Parks and Recreation Secretary. Pete Schenck was present from the City
Council. Representatives from the Y.D.A.C. (Youth Development Advisory Council)
present included LeAnne Weyrauch, Director of Community Services, student
representatives included Katie Stockinger, Nathan Bong, Sarah Anderson, the
Advisor/Artist, Elaine Pagel. Chris Mosley and Eileen Hill were present from the Friends
of the Library.
The minutes from the December 9, 1996 meeting were reviewed.
THEA FLUHRER MADE A MOTION TO ACCEPT THE DECEMBER 9, 1996
MINUTES. BOB RYKKEN SECONDED THE MOTION. MOTION CARRIED

Members of the Y.D.A.C. (Youth Development Advisory Council) were introduced and
presented their ideas on how they want to improve the community with such projects as
repainting the mural currently located on Dakota and Main Street. They were also
looking for suggestions of other locations for another mural. They have the funding
through the Community Education program and would like to involve youth in grades 7th
and above. Pete Schenck, City Councilmember, indicated that John Fitzgerald is the
owner of that building and perhaps should be contacted.
There was some discussion regarding the councils thoughts on what theme would be used
pertaining to Prior Lake and also the possiblity of using flags/banners to incorporate a
theme.
Nathan Bong from the advisory council stated his concerns about getting a bike path from
County Road 21 to Cleary Lake Park. There was some discussion concerning this; Paul
Hokeness indicated that he would check into this situation.
LeAnne Weyrauch questioned how we could access beautification grant money to use for
such things as banners/flags. She also stated that the Community Values group could
help with this type of project.

Tom asked for Staff Reports.
Paul Hokeness indicated that the City Council presentation and resolution requesting
approval of election, ballot question, election judges, and ways to inform the public will
be held on Tuesday, January 21st at the regular City Council meeting. Presenters will be
Tom Schutz, Pat Heaney and Chris Mosley. $4,000 has been budgeted and approved to
cover the election costs. He indicated that he feels we should get our attorneys input as to
how to word our signage and public notices.
Chris Mosley (FOL) indicated that they have ordered their signs. She also questioned if
we should itemize things on the ballot.
Paul indicated that he felt this was not a good idea because we could possibly be locked
into a figure. The referendum figures will be public information for whoever requests it.
The phone bank assignments were distributed along with a calling sample. Calling dates
were set. The phone bank dates are 1.) Thursday, January 23, 2.) Sunday, February 23
and 3.) Monday, February 24. Chris indicated she knew of other people that were not
listed that would be interested in helping with the calls.

Publicity was discussed. The library has budgeted for two ads in the newspaper. We
have a total of 24 tee-pee signs. A catchy heading was discussed to be used on the signs
and/or in the newspaper to get peoples attention. Friends of the Library (specifically, Lea
Janise) will be in charge of organizing the distribution of the flyers. First delivery will be
made between January 31st and February 2nd and the second delivery on February 22-23.
Paul informed the group that the most recent meeting scheduled with the Kop' s was
canceled. He plans to send a letter stating the advantages to them to enter into a life
estate contract.
Paul met with Mary Gores, real estate agent from Edina Realty, to search for 80-100 acres
of land. There will be no searching fees.
Bret Woodson gave the recreation program update. 86 kids attended the Holidays
Around the World Activity hosted by the S.O.R.R. and was very successful. The
M.R.P.A. grant helped to fund this activity. The Community Sledding Party is planned
for February 1st. The Y.D.A.C. group will be helping with this event. He informed the
group that there were still a few tickets available for the Globetrotters. The skating rink
at Lakefront Park seems to be getting a lot of use this year as well as the neighborhood
park rinks i.e. Indian Ridge, Willows and Sand Point Park. The Spring brochure will
come out February 14th with activities through May.

Dear John and Meda,
Whenever you are ready we would like to talk to you and the family regarding the purchase of
the family farm and explore some of the purchasing options, one of which may be a life-estate. I
think it would be helpful if we all had a better understanding of the life-estate option.
I understand that you were disappointed with the appraisal. I had heard from your real estate
people that Orion Appraisals is a very reputable firm and that they are very thorough and concise.
I can only suggest that you may want to have the appraisal reviewed by your Realtor or perhaps
another appraiser.
From what I understand here are a few of the advantages of selling the property to the City
through a life-estate:
1. If the Parks and Library Referendum passes we could give you one lump sum check, or
perhaps split it into payments, depending on the families preference.
2. You would pay no real estate fees for the sale of the property.
3. All legal work relating to the sale, and life-estate would be handled through our office
and paid for by the City.
4. The City would be responsible for the deferred special assessment which is presently
assessed to the property.
5. John and Meda would be able to live on the property for the rest of their lives.
6. The City would be able to assist in some property maintenance, aside from the house
itself.
7. We could name all, or a portion of the property in honor of your family.

I realize that this is a big step for your family, and as I've said before we do not want to disrupt
your lives. Acquiring this property for a park will be a wonderful benefit for the children and
adults of our community for years to come. We intend to preserve the family farm and the Kop
legacy for the enjoyment of future generations. Please check your calendars so we can arrange a
meeting. In the meantime if there are is anything you need please call me at 447-4230.

Dear Mr. Hokness:
I am the attorney representing the Kop family with regard to potential sale of the Kop
farm. I understand that the City is requesting a meeting with family members to discuss
purchase of the Kop farm by the City of Prior Lake. John and Meda Kop will be out of the state
during the month of February. We may want to schedule a meeting when they return.
In the meantime, you have probably heard that the Kops were extremely smprised by the
result of the formal appraisal. For a parcel of that size located along Main Street, in a busy area
ofa growing city, the value seems extremely low. For years and years. the Kops were told that
the property would have a great value to developers. Just to get some objective data, we had a
real estate agent make a list of some rough comparables. which I attach hereto.
[t is not the intent of the Kops to get every penny out of the City, and they intend to be
flexible. However, the number set forth in the appraisal is not even in the ballpark of the true
value of the property. I am told that the City of Prior Lake itself has sold comparable property at
a much, much higher rate per acre. The Kops only ask to get fair market value for their property
considering what they could get from other buyers.

When you have had a chance to review these comparables. please give us a call. Frankly,
I'm not sure a meeting would be helpful if the City is only offering the amount of the appraisal
Hopefully, significant additional funds are in your budget so we can do this deal. I look forward
to hearing from you.

Dear Mr. Radunz,
Thank you for responding to my letter regarding the Kop property. I hope that eventually
we can come to a mutual agreement between the City of Prior Lake and the Kop's family
for the purchase of the farm. The acquisition and preservation of this historical farm site
is a very important element in the development of Lakefront Park. We would like to
continue our discussions with the family, and as I have said before I do not want this to
become uncomfortable for either party.
Again, I realize that the family was disappointed with the appraisal of the property and
can only suggest that the family do another appraisal or perhaps give the Orion appraisal
to another company for reviewal. When I first suggested that we do an appraisal the
Kop's did not want the City to use our local appraisal company. I suggested that they
select a company that they would feel comfortable with, and the City would pay the
expenses. We agreed that this would be a fair and impartial way to get an accurate
appraisal. The Kop's suggested that I speak to Lee Heikens who is a Realtor with Burnet
Realty, she suggested that I contact Chase Brackett who in turn gave me the name of
Orion Appraisals, Inc..
One item that you must realize is that the Kop farm is currently zoned C-l (Conservation)
and the appraisal was based upon agricultural land comparisons which would be
equivalent to C-l. If the City were to consider rezoning this property for development it
could possibly be rezoned R-I (Single Family Residential). R-l is the zoning comparison
that Orion used when doing the development cost approach.

The list of comparison properties that you sent to me is property that is mostly zoned
Industrial or Commercial with some containing large expensive commercial buildings.
You mentioned in your letter that the City has sold property at a much higher rate, and I
can only assume that you are referring to our Industrial/Office Park. As you know
Industrial/Commercial property which is fully improved and has all roads and utilities
installed sells for a much higher rate than Agricultural or Residential property. In order
for an appraiser to make an accurate appraisal it is imperative that they compare like
properties.
At this point the City of Prior Lake has not made an offer on the property and in turn the
Kop family has not suggested a selling price. It has never been our intention to pay
anything less than fair market value for this property. I hope that we can agree upon a
selling price that is acceptable to the Kop family and the City, and we can continue our
discussions regarding a life estate.
