CITY STAFF TO ACCEPT AND PROCESS AN APPLICATION FOR A
PRELIMINARY PUD PLAN FOR A PROJECT LESS THAN 10 ACRES ON
A PROPERTY LOCATED AT 4730 140TH STREET (PID 259260050)
DISCUSSION: Introduction
KJ Walk Inc., on behalf of the property owners, Shawn Garling and Linnette
Kes, is requesting the Planning Commission authorize the City staff to accept
and process an application for a Preliminary PUD Plan for a project less than
10 acres. The applicant is proposing a concept plan for a Planned Unit De-
velopment (PUD) consisting of 9 lots on a 5.3-acre parcel at 4730 140th
Street NW.
Current Circumstances
Section 1132.800 of the Zoning Ordinance relates to Planned Unit Develop-
ments (PUDs) and states the following regarding the minimum requirements:
1132.800: MINIMUM PUD ELIGIBILITY REQUIREMENTS. In order to
utilize a PUD the proposed site shall consist of a parcel or
contiguous parcels of land in common ownership 10 acres or
more in size. An owner(s) of a tract of land less than 10 acres
may apply to the Planning Commission for an exception to
the 10-acre requirement.
1132.801 Exception to 10-Acre Requirement. An applicant seeking
an exception to the 10-acre requirement shall, prior to
submission of a Preliminary PUD Plan submit a Concept Plan
for review and approval by the Planning Commission
pursuant to the procedure set forth in the Subdivision Code.
The Planning Commission shall decide, based upon the
criteria set forth below, whether to authorize the City staff to
accept and process an application for a Preliminary PUD Plan
for the proposed project:
(1) The proposed project meets all other criteria for a PUD except the
acreage requirement.
(2) There are unique circumstances that prohibit the applicant from
assembling 10 contiguous acres.

(3) The proposed project is consistent with the goals and objectives of
the Comprehensive Plan.
(4) The applicant intends to provide for greater parks, open space,
trails or public areas than required by the Zoning Code.
The property for the proposed PUD is slightly over 5.3 acres in size. The
Developer is proposing a 9-unit residential subdivision with a public street.
The modifications to the Zoning Ordinance include the reduction of lot widths
below the required 86 feet measured at the 25 foot front setback line.
The Developer is offering PUD public benefits which include 1) the connec-
tion of a local street (Bluebird Trail) that has existed as the longest dead-end
road in the City, and 2) the looping of City water services in the area. A
detailed determination of how much a benefit these items provide to the City
against the degree of requested modifications from the Zoning Ordinance
(lot widths) would be evaluated during the Preliminary PUD process by City
Staff as well as the Planning Commission and City Council.
Conclusion
In accordance with Section 1132.801 of the Zoning Ordinance the Developer
has submitted a 5.3-acre concept plan for consideration as a PUD. The site
is located in a developed area of the City; therefore, assembling more than
10 contiguous acres for the proposed development is not possible. The pro-
ject is consistent with the current R-LD Low Density Residential Comprehen-
sive Plan designation and R-1 Low Density Residential Zoning District for
the site. The Developer is proposing benefits of providing key street con-
nections and public water utilities. Therefore, City Staff recommends the
Planning Commission authorize the application be accepted for considera-
tion of a Preliminary PUD.
ALTERNATIVES: 1. Motion and second to approve a resolution authorizing the City staff to
accept and process an application for a Preliminary PUD Plan for a pro-
ject less than 10 acres at 4730 140th Street NW.
2. Motion and second to approve a resolution denying that the City staff
accept and process an application for a Preliminary PUD Plan for a pro-
ject less than 10 acres at 4730 140th Street NW.

APPLICATION FOR A PRELIMINARY PUD PLAN FOR A PROJECT LESS THAN 10 ACRES

WHEREAS, KJ Walk Inc., on behalf of the property owner, Shawn Garling and Linnette Kes,
has submitted an application for a concept plan for a residential planned unit
development (PUD) to be reviewed in accordance with Section 1132.801 of the
Zoning Ordinance at a property legally described as follows:
That part of the North one-half of the Northeast Quarter (N ½ of the NE ¼), of
Section Twenty-six (26), Township One Hundred Fifteen (115) North, Range
Twenty-two (22) West, Scott County, Minnesota, described as follows:
Commencing at a point on the North line of the Northeast Quarter (NE ¼),
Section 26, distant 960 feet East of the Northwest corner thereof; thence South
at right angles to said North line of NE ¼, Section 26, a distance of 410.89 feet;
thence deflecting to the left, at an angle of 64 degrees, 36 minutes, 20 seconds,
in a Southeasterly direction, a distance of 607.06 feet; thence in a Northwesterly
direction to a point on the North line of said Northeast Quarter (NE ¼), Section
26, a distance 440 feet East of the point of beginning; thence West along said
North line of Northeast Quarter (NE ¼), to the point of beginning. Containing 6.0
acres more or less.

WHEREAS, On June 12, 2023, the Prior Lake Planning Commission considered the concept
plan for possible future review as a Preliminary PUD Plan; and
WHEREAS, The Planning Commission found the concept plan to be acceptable for
consideration as a Preliminary PUD Plan under the criteria listed in Section
1132.801 of the Zoning Ordinance;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City staff is hereby authorized to accept and process an application for the concept plan
as a Preliminary PUD Plan.
