RESOLUTION 25-014 A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE A TERMINATION OF DEVELOPMENT CONTRACTS FOR DEERFIELD INDUSTRIAL PARK AND DEERFIELD INDUSTRIAL PARK SECOND ADDITION Motion By: Hellier Second By: Churchill
WHEREAS, WHEREAS, WHEREAS, WHEREAS,
the City of Prior Lake, a Minnesota municipal corporation (“City”) and Eagle Creek Development, LLC, a Minnesota limited liability corporation (“ECD”) entered into that
certain Development Contract for Deerfield Industrial Park dated August 16, 2004 and recorded as Document No. 675869 in the Office of the County Recorder Scott County, Minnesota on October 22, 2004 (“Development Contract One”); and the City and ECD entered into that certain Development Contract for Deerfield Industrial Park Second Addition dated October 4, 2004 and recorded as Document No. 161887 in the Office of the County Recorder Scott County, Minnesota on October 27, 2004 (“Development Contract Two”); and the City has confirmed that all work to be performed under Development Contract One and Development Contract Two is complete; and On January 28, 2025, the Prior Lake City Council Terminated Development Contract One and Development Contract Two.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth. 2. The Mayor and City Manager are hereby authorized to execute the termination of the Development
Contracts for Deerfield Industrial Park and Deerfield Industrial Park Second Addition. Passed and adopted by the Prior Lake City Council this 28th day of January 2025. VOTE Briggs Braid Churchill Lake Hellier Aye ☐ ☒ ☒ ☒ ☒
