HomeMy WebLinkAbout4B Beach Street RLS Packet Report Phone 952.447.9800 / Fax 952.447.4245 / www.cityofpriorlake.com 4646 Dakota Street SE Prior Lake, MN 55372 PLANNING COMISSION AGENDA REPORT MEETING DATE:February 24, 2025 AGENDA #:4B PREPARED BY:PAUL MORETTO, PLANNER PRESENTED BY:CASEY MCCABE, DIRECTOR AGENDA ITEM:CONSIDER RECOMMENDATION OF APPROVAL FOR A REGISTERED LAND SURVEY AT 4931, 4913, AND 4893 BEACH STREET NORTHEAST DISCUSSION: The applicant, Roy Stromme, on behalf of property owners AJM&R Company LLLP, Marleen J Stromme Trust, and 4931 LLC, has applied for approval of a Registered Land Survey (RLS) on approximately 2.06 acres of land at 4931, 4913, 4893 Beach Street NE along the northern shore of Lower Prior Lake. Current Circumstances A Registered Land Survey is a survey performed for the identification of registered (or Torrens) lands in accordance with the requirements of Minnesota Statutes. The applicant is proposing to realign the property lines of three parcels currently identified as Tracts, C, D, and E, of RLS 162 to increase the size of the center parcel and decrease the size of the two outer parcels. Tract D contains a single- family home and Tract C and E are vacant. The applicant is proposing a realignment of existing side property lines, ceding land from Tracts C and E of the existing RLS to Tract D. The applicant is not proposing to create additional parcels. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS Total Site Area: The total site area consists of approximately 2.06 acres. Wetlands: No wetlands are located on the parcels. Access: Access to the property is provided from Beach Street NE. 2040 Comprehensive Plan Designation: The property is designated R-LD for Urban Low-Density Residential uses on the 2040 Comprehensive Plan Land Use Map. Zoning: The property is located within the R-1 Zoning District (Low Density Residential). Shoreland: The properties are located within the Shoreland District of Prior Lake and are subject to the City’s Shoreland Ordinance. The proposal conforms to the requirements of the shoreland district. PROPOSED PLAN Lots: The proposed registered land survey consists of three Tracts (lots). Tract A is 23,118 sq. ft., Tract B is 47,628 sq. ft., and Tract C is 18,961 sq. ft. All parcels will conform with minimum lot width and area requirements of Prior Lake City Code. Sanitary Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in place for all parcels. Shoreland Ordinance: The proposed registered land survey is located within the Shoreland District for Prior Lake and therefore the properties are required to meet the requirements of the Shoreland Ordinance including, but not limited to, a maximum impervious surface area of no more than 30% of the total lot area. Conclusion Prior Lake City Code Subsection 9-166 (c) states that all registered land surveys in the City shall be processed in the same manner as a combined preliminary and final plat application. In accordance with the standards set forth in the Subdivision Code for combined preliminary plat and final plat applications, the Planning Commission shall first approve the arrangement, sizes and relationships of proposed tracts in such registered land surveys, and tracts to be used as easements or roads should be so indicated. Unless a recommendation and approval have been obtained from the Planning Commission and City Council respectively, in accordance with the standards set forth in the Subdivision Code, building permits will be withheld for buildings on tracts which have been so subdivided by registered land surveys and the City may refuse to take over tracts as streets or roads or to improve, repair or maintain any such tracts unless so approved. The applicant is proposing to realign the side lot lines of three existing parcels of land. The modified parcels will meet the city requirements for the R-1 Zoning District. The proposed RLS will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. Therefore, City staff recommends approval of the RLS with the following condition of approval: 1. The registered land survey shall be recorded at Scott County within 90 days of approval by the City Council. ALTERNATIVES:1. Motion and a second recommending the City Council approve the registered land survey. 2. Table this item and provide the applicant with direction on the issues that have been discussed.
