Consider the Proposed Disposal of City-Owned Property in Spring Lake
Township
DISCUSSION: Introduction
The purpose of this agenda item is to consider the proposed disposal of several
City-owned parcels in Spring Lake Township and adopt findings as to
compliance of the proposed disposal with the Comprehensive Plan.
History
The City of Prior Lake obtained ownership of 18 parcels within Spring Lake
Township in 2010 via Conveyance of Forfeited Lands. The parcels were
forfeited to the State of Minnesota for the nonpayment of taxes. Pursuant to
Minnesota Statutes, Section 282.01, Subdivision 1, the City of Prior Lake
applied to the Commissioner of Revenue for the conveyance of lands to be used
for a public purpose.
The reason these parcels located in Spring Lake Township were conveyed to
the City of Prior Lake is because they were located within the Orderly
Annexation Area as identified in a 2003 Orderly Annexation Agreement between
the City and Township. As part of the 2003 Orderly Annexation Agreement, the
City agreed to develop and maintain public parks on these parcels because at
the time it was anticipated they would be annexed into the City of Prior Lake.
Current Circumstances
On September 10, 2024, the City Council approved a new Orderly Annexation
Agreement Spring Lake Township. The 2024 Orderly Annexation Agreement
removed a large number of residential parcels located in the Shore Trail and
Vergus Avenue neighborhoods south of Spring Lake from the annexation area,
including the 18 subject parcels. Which means these 18 parcels are no longer
eligible for annexation into the City.
As part of the 2024 Orderly Annexation Agreement, the City Council agreed to
transfer ownership of these 18 parcels to the Spring Lake Township for the
Township to continue to operate and maintain the public parks. Paragraph 11
of the 2024 Orderly Annexation Agreement states, within six months of approval
of [the Orderly Annexation] Agreement, the City will work with the Township to
transfer ownership of the following parcels from the City to Township.
• South Shore Park. Located at 2968 South Shore Drive, Prior Lake, MN
55372 (PID 119090270).
• Raymond Park. No Address. Located on the South Shore of Spring Lake
consisting of thirteen (13) Parcels (PIDs 110110140, 110110120,
110110110, 110110100, 110110090, 110110080, 110110070,
110110060, 110110050, 110110040, 110110030, 110110020, and
110110010).
• Raymond Avenue Natural Area. No Address. Located on the South
Shore of Spring Lake consisting of two (2) Parcels (PIDs 110110190 and
110110200).
• Stormwater Pond Parcel. 2255 Raymond Avenue, Jordan, MN 55352
(PID 110110220).
• Natural Area located south of Raymond Avenue. No Address. (PID
110110240).
The City of Prior Lake would be removing parks from the City park system as a
result of this action; however, the parks themselves would not be eliminated.
South Shore Park and Raymond Park will continue to operate as public parks
under the ownership and maintenance of Spring Lake Township.
Prior Lake City Code
Section 111 of Prior Lake City Code addresses disposal of City property and
establishes a process whereby the City may dispose of real or personal
property. Subsection 111.301 of Prior Lake City Code states, no interest in real
property shall be disposed of by the City until after the Planning Commission
has reviewed the proposed disposal and reported in writing to the City Council
its findings as to compliance of the proposed disposal with the Comprehensive
Plan. The City Council may, by resolution adopted by two-thirds vote, dispense
with the requirements of this subsection when in its judgment it finds that the
proposed disposal of real property has no relationship to the Comprehensive
Plan.
Although there currently is a relationship to the Comprehensive Plan, as the
parcels proposed to be transferred to Spring Lake Township are identified as
city neighborhood parks (Raymond Park and South Shore Park) in the Park &
Trail System Plan, City staff feels this action complies with the Comprehensive
Plan as the Park & Trail System Plan also addresses the elimination and
reduction in the number of City Parks.
There are several references in the Park & Trail System Plan related to
elimination or reduction in the number of city parks to avoid duplication of
amenities and reduce ongoing maintenance costs. Below are several examples
of this language in the Park & Trail System Plan.
➢ Chapter 2, Assessment of Need (page 30). Under the theme of
Sustainability, the plan states, consolidation of amenities to provide
more unique experiences while lowering the costs of ongoing
maintenance and replacement and include avoiding over-duplication of
amenities/facilities within service areas.
o The City of Prior Lake has two parks (Woodview and Sunset Hills)
within 2,000 ft. of South Shore Park.
o South Shore Park and Raymond Park are not proposed to be
eliminated; they will continue to operate as public parks under the
ownership and maintenance of Spring Lake Township.
➢ Chapter 2, Assessment of Need (page 32). Includes a table which
evaluates Prior Lake’s parks system compared to the National Park and
Recreation Association recommended standards. This table indicates
the number of parks, parkland acreage, playgrounds and other
amenities provided by the City of Prior Lake far exceed the minimum
recommended standards.
➢ Chapter 6, Implementation Plan (page 328) item 5 recommends the
identification of lower priority parks that would have existing
development phased out as amenities reach the end of their useful age
and as key neighborhood parks within the same service areas are
improved to ensure each of the service areas have quality outdoor
recreation opportunities.
o South Shore Park and Raymond Park are not proposed to be
eliminated; they will continue to operate as public parks under the
ownership and maintenance of Spring Lake Township.
City staff is working on a Comprehensive Plan amendment to remove all parcels
in the South Shore and Vergus Avenue neighborhoods (Identified as annexation
areas 24.1, 24.2 and 24.3 in the 2003 Orderly Annexation Agreement) from the
comprehensive land use plan and remove references to Raymond and South
Shore neighborhood parks from the Park & Trail System Plan. This action will
eliminate any relationship between these 18 parcels and the City’s
Comprehensive Plan.
Conclusion
City staff recommends approval of the disposal of City-owned property in Spring
Lake Township based on the following.
➢ The Orderly Annexation Agreement approved by the City of Prior Lake
in September 2024 requires the City to work with Spring Lake Township
to transfer ownership of these parcels to the Township.
➢ The Conveyance of Forfeited Lands transferring ownership of these
parcels to the City of Prior Lake included a condition that if the city
ceased to use the land for the public park purpose, the land shall revert
to the State of Minnesota. The City of Prior Lake is ceasing to maintain
ownership of these 18 parcels, which requires the parcels to revert to
the State of Minnesota, and ultimately to Spring Lake Township.
➢ This action complies with the Comprehensive Plan as the Park & Trail
System Plan addresses the elimination and reduction in the number of
City Parks.
➢ South Shore Park and Raymond Park are not proposed to be eliminated.
The City of Prior Lake would be removing these parks from the City park
system; however, the parks will continue to operate as public parks
under the ownership and maintenance of Spring Lake Township.
➢ A future Comprehensive Plan Amendment to remove the parcels in the
South Shore and Vergus neighborhoods from the land use plan as well
as remove references to Raymond Park and South Shore Park from the
Park & Trail System Plan will eliminate any relationship between these
18 parcels and the City’s Comprehensive Plan.

A RESOLUTION FINDING THE PROPOSED DISPOSAL OF CITY-OWNED PROPERTY IN SPRING
LAKE TOWNSHIP IS WITHIN COMPLIANCE OF THE CITY COMPREHENSIVE PLAN

WHEREAS, The City of Prior Lake obtained ownership of 18 parcels of land within Spring Lake
Township in 2010 via Conveyance of Forfeited Lands to be used for public park purposes;
and
WHEREAS, The City of Prior Lake has maintained two public parks in Spring Lake Township known
as Raymond Park and South Shore Park; and
WHEREAS, On September 10, 2024, the City of Prior Lake and Spring Lake Township entered into a
Joint Resolution Providing for the Orderly Annexation of Certain Areas within Spring Lake
Township to the City of Prior Lake Pursuant to Minnesota Statutes, 414.0325 (“OAA”); and
WHEREAS, As part of the OAA, the City of Prior Lake agreed to transfer ownership of the following 18
parcels to the Spring Lake Township:
• South Shore Park. Located at 2968 South Shore Drive, Prior Lake, MN 55372 (PID
119090270)
• Raymond Park. No Address. Located on the South Shore of Spring Lake
consisting of thirteen (13) Parcels (PIDs 110110140, 110110120, 110110110,
110110100, 110110090, 110110080, 110110070, 110110060, 110110050,

hereinafter the (“Subject Property”); and
WHERES, Spring Lake Township will continue to operate and maintain the public parks on the
Subject Property; and
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires the Planning Commission review the disposal of
any publicly owned interest in real property and report in writing to the City Council its
findings as to compliance of the proposed disposal with the Comprehensive Plan, or the
City Council may, by resolution adopted by two-thirds vote, dispense with the
requirements of this subsection when in its judgment it finds that the proposed disposal of
real property has no relationship to the Comprehensive Plan; and

WHEREAS, On February 24, 2025, the Prior Lake Planning Commission considered the proposed
disposal of Subject Property as to compliance with the Comprehensive Municipal Plan;
and
WHEREAS, The Planning Commission found disposal of the Subject Property complies with the City’s
Comprehensive Plan.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING COMMISSION OF PRIOR
LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The disposal of Subject Property complies to the City’s Comprehensive Plan based on the
following.
a. The Orderly Annexation Agreement approved by the City of Prior Lake in September 2024
requires the City to work with Spring Lake Township to transfer ownership of the Subject
Property to the Township.
b. The Conveyance of Forfeited Lands transferring ownership of the Subject Property to the
City of Prior Lake included a condition that if the city ceased to use the land for the public
park purpose, the land shall revert to the State of Minnesota. The City of Prior Lake is
ceasing to maintain ownership of the Subject Property, which requires the parcels to revert
to the State of Minnesota, and ultimately to Spring Lake Township.
c. This action complies with the Comprehensive Plan as the Park & Trail System Plan
addresses the elimination and reduction in the number of City Parks.
d. South Shore Park and Raymond Park are not proposed to be eliminated. The City of Prior
Lake will be removing these parks from the City park system; however, the parks will
continue to operate as public parks under the ownership and maintenance of Spring Lake
Township.
e. A future Comprehensive Plan Amendment to remove the parcels in the South Shore and
Vergus neighborhoods from the land use plan as well as remove references to Raymond
Park and South Shore Park from the Park & Trail System Plan will eliminate any
relationship between the Subject Property and the City’s Comprehensive Plan.
3. This finding shall be provided to the City Council in writing for their consideration of a potential
disposal of City-owned property in Spring Lake Township.
