RESOLUTION 25-026 A RESOLUTION APPROVING THE FIRST AMENDMENT TO THE JEFFERS POND 10th ADDITION DEVELOPMENT AGREEMENT AND APPROVING AN EXTENSION TO THE FINAL PLAT RECORDING DEADLINE Motion By: Braid Second By: Lake
WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS,
on February 27, 2024, the Prior Lake City Council approved Resolution 24-024 approving the Jeffers Pond 10th Addition Final Plat and Development Agreement; and
the Development Agreement approved by the City Council in February 2024 was between the City of Prior Lake and Rachel Development, Inc.; and Rachel Development, Inc. has requested the Development Agreement be amended to identify the current property owner, Ripley Land Co. LLC as the “Developer” in the agreement; and Resolution 24-024 approving the Jeffers Pond 10th Addition Final Plat and Development Agreement stated, the final plat and all pertinent documents must be filed with Scott County within 12 months from the date of final plat approval. Failure to record the documents by February 27, 2025 will render the final plat null and void; and the Developer has requested a 60-day extension to the Final Plat and Development
Agreement recording deadline; and WHEREAS, on February 25, 2025, the Prior Lake City Council considered the request for
amendments to the Jeffers Pond 10th Addition Development Agreement and the request for an extension to the Final Plat and Development Agreement recording deadline. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The previous conditions of approval in Res. 24-024 outlined below shall be met by the Developer prior to release and recording of the final plat or issuance of a grading or building permit for any work on the site: a. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney.
b. Payment of all fees prior to release of the final plat mylars. c. Three mylar sets of the final plat with all required signatures are submitted. d. The Conservation Easement in favor of the Prior Lake Spring Lake Watershed District shall be
recorded at Scott County. e. All comments from the city engineering/public works memorandum dated November 10, 2023 and the Prior Lake Spring Lake Watershed District memorandums dated November 8, 2023 and
December 19, 2023 shall be satisfied.

f. A grading permit has been obtained from the City Engineering Department. g. All required permits from other state or local agencies as applicable have been obtained.
3. The final plat and all pertinent documents must be filed with Scott County within 60 days. Failure to record the documents by April 28, 2025 will render the final plat null and void.
4. The Mayor and City Manager are hereby authorized to execute the amended Development Agreement on behalf of the City. Passed and adopted by the Prior Lake City Council this 25th day of February 2025. VOTE Briggs Braid Churchill Lake Hellier
