RESOLUTION APPROVING THE DISPOSAL OF CITY-OWNED PROPERTY IN SPRING LAKE TOWNSHIP

WHEREAS, the City of Prior Lake obtained ownership of 18 parcels of land within Spring Lake Township in 2010 via Conveyance of Forfeited Lands to be used for public park purposes; and
WHEREAS, the City of Prior Lake has maintained two public parks in Spring Lake Township known as Raymond Park and South Shore Park; and
WHEREAS, on September 10, 2024, the City of Prior Lake and Spring Lake Township entered into a
Joint Resolution Providing for the Orderly Annexation of Certain Areas within Spring Lake Township to the City of Prior Lake Pursuant to Minnesota Statutes, 414.0325 (“OAA”); and
WHEREAS, the OAA states the City of Prior Lake will work with Spring Lake Township to transfer ownership of the following parcels from the City to the Township:
•South Shore Park. Located at 2968 South Shore Drive, Prior Lake, MN 55372(PID 119090270)
•Raymond Park. No Address. Located on the South Shore of Spring Lakeconsisting of thirteen (13) Parcels (PIDs 110110140, 110110120, 110110110,
110110100, 110110090, 110110080, 110110070, 110110060, 110110050,110110040, 110110030, 110110020, and 110110010)
•Raymond Avenue Natural Area. No Address. Located on the South Shore ofSpring Lake consisting of two (2) Parcels (PIDs 110110190 and 110110200)
•Stormwater Pond Parcel. 2255 Raymond Avenue, Jordan, MN 55352 (PID110110220)
•Natural Area located south of Raymond Avenue. No Address. (PID 110110240)hereinafter the (“Subject Property”); and
WHERES, Spring Lake Township will continue to operate and maintain the public parks on the Subject Property; and
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires the Planning Commission review the disposal of any publicly owned interest in real property and report in writing to the City Council its findings as to compliance of the proposed disposal with the Comprehensive Plan, or the
City Council may, by resolution adopted by two-thirds vote, dispense with the requirements of this subsection when in its judgment it finds that the proposed disposal
of real property has no relationship to the Comprehensive Plan; and
WHEREAS, the Prior Lake Planning Commission considered the proposed disposal of the Subject
Property on February 24, 2025 and adopted resolution No. 25-01PC finding the disposal of the Subject Property is in compliance with the Comprehensive Plan.

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.2.The Orderly Annexation Agreement approved by the City of Prior Lake in September 2024requires the City to work with Spring Lake Township to transfer ownership of the Subject
Property from the City to the Township.3.The Conveyance of Forfeited Lands transferring ownership of the Subject Property to the Cityof Prior Lake included a condition that if the city ceased to use the land for a public park purpose,the land shall revert to the State of Minnesota. The City of Prior Lake is ceasing to maintainownership of the Subject Property, which requires the parcels to revert to the State of Minnesota,and ultimately to Spring Lake Township.4.The disposal of Subject Property complies with the City of Prior Lake Comprehensive Plan asthe Park & Trail System Plan addresses the elimination and reduction in the number of CityParks.5.South Shore Park and Raymond Park are not proposed to be eliminated. The City of Prior Lakewill be removing these parks from the City park system; however, the parks will continue to
operate as public parks under the ownership and maintenance of Spring Lake Township.6.A future Comprehensive Plan Amendment to remove the parcels in the South Shore and Vergusneighborhoods from the land use plan as well as remove references to Raymond Park and
South Shore Park from the Park & Trail System Plan will eliminate any relationship between theSubject Property and the City’s Comprehensive Plan.7.The Mayor and City Manager are hereby authorized to execute a Reconveyance of Forfeited
Lands to the State of Minnesota by a Governmental Subdivision under Minnesota Statutes,Section 282.01, Subdivision 1d and all other documents necessary to convey the SubjectProperty in accordance with the terms of this Resolution.
