RESOLUTION 25-118 A RESOLUTION APPROVING JEFFERS POND ELEVENTH ADDITION FINAL PLAT AND DEVELOPMENT AGREEMENT Motion By: Lake Second By: Hellier
WHEREAS, WHEREAS, WHEREAS,
Surmount and Rachel Development (the “Developer”), on behalf of the property owner, Ripley Land Co LLC, has submitted an application to the City of Prior Lake for approval of a final plat for Jeffers Pond Eleventh Addition; and
Jeffers Pond Eleventh Addition is a replat of Outlot A, Jeffers Pond Tenth Addition (PID 255750020) to create one commercial lot: Lot 1 Block 1, approximately 1.25
acres and one outlot A, approximately .77 acres that will be reserved for future development; and the Prior Lake City Council approved a final plat known as Jeffers Pond Tenth Addition on February 27, 2024; and WHEREAS, the City Council has found that the final plat of Jeffers Pond Eleventh Addition is in substantial compliance with the approved final plat for Jeffers Pond Tenth Addition.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of Jeffers Pond Eleventh Addition is approved subject to the following conditions,
which shall be met by the Developer prior to release and recording of the final plat: a. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney.
b. Payment of all fees prior to release of the final plat mylars. c. Three mylar sets of the final plat with all required signatures are submitted. d. The final plat and all pertinent documents must be filed with Scott County within 90 days
from the date of final plat approval. Failure to record the documents by November 28, 2025 will render the final plat null and void. 3. The following conditions shall be met by the Developer prior to issuance of a building permit or any grading or work on the site. a. The Developer shall obtain a grading permit from the City Engineering Department. b. The Developer shall obtain required permits from other state or local agencies as applicable. c. The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the Public Works Department dated August 8, 2025. d. The Developer shall obtain, provide and record access and maintance agreements to the satisfaction of the Community Development Director before the issuance of a building
permit. 4. The Mayor and City Manager are hereby authorized to execute the Development Agreement on behalf of the City.
