RESOLUTION NO. 25- 120 A RESOLUTION AMENDING JEFFERS POND PUD FOR OUTLOT A, JEFFERS POND 10th ADDITION

WHEREAS, WHEREAS,
Rachel Development, on behalf of the property owner, Ripley Land Co LLC, requested a Major Amendment to the Jeffers Pond Planned Unit Development (PUD) Plan; and Outlot A of Jeffers Pond 10th Addition is being replatted to create Lot 1, Block 1 and Outlot A of Jeffers Pond 11th Addition, which are the subject of this PUD amendment; and
WHEREAS,
WHEREAS,
the City Council approved the original PUD Final Plan for Jeffers Pond per Resolution 05-107 on June 6, 2005; and
the applicant now seeks to amend the PUD to allow for:
• C-2 General Business District permitted and permitted with conditions
uses within the PUD overlay;
• Construction of an 11,320 square foot commercial building on Lot 1, Block 1, Jeffers Pond 11th Addition (formerly Jeffers Pond 10th Addition
Outlot A);
• Allowance of up to 24,000 square feet of commercial use on Outlot A, Jeffers Pond 11th Addition; and
• Shared parking and driveway improvements across Lot 1, Block 1 and Outlot A to serve the new commercial development WHEREAS,
WHEREAS,
the Prior Lake Planning Commission conducted a public hearing on August 11, 2025, to consider the Major Amendment to the Jeffers Pond PUD and
recommended approval to the City Council; and notice of said public hearing was duly published and posted in accordance with
the applicable Minnesota Statutes and Prior Lake Ordinance; and WHEREAS, WHEREAS, WHEREAS,
the City Council has reviewed the Major Amendment to the Jeffers Pond PUD
according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said Major Amendment to the Jeffers Pond PUD to be consistent with the provisions of said Ordinances; and
on August 26, 2025, the Prior Lake City Council considered and approved a Major Amendment to the Jeffers Pond PUD Plan on Outlot A, Jeffers Pond 10th
Addition; and the City Council finds the PUD is compatible with the stated purposes and intent of the Section Chapter 10, Article 4, Division 4 Planned Unit Developments of the Zoning Ordinance.

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The Jeffers Pond PUD, is hereby amended to include the following:
LEGAL DESCRIPTION:
Lot 1, Block 1, Jeffers Pond 11th Addition
Outlot A, Jeffers Pond 11th Addition
Outlot A, Jeffers Pond 10th Addition (PID 255750020)
The PUD Overlay District amendment shall apply to Lot 1, Block 1 and Outlot A, Jeffers Pond 11th Addition, which are being replatted from Outlot A, Jeffers Pond 10th Addition.
3. The Preserve at Jeffers Pond Planned Unit Development includes the following elements:
a. Up to 35,000 square feet of commercial uses are allowed across Lot 1 Block 1, and Outlot A as follows:
• 11,320 square feet on Lot 1, Block 1
• Up to 24,000 square feet on Outlot A
b. Permitted uses shall follow the C-2 General Business zoning district, including those permitted and permitted with conditions, subject to the PUD.
c. Shared parking facilities may be constructed across the boundaries of Lot 1, Block 1 and Outlot A to serve approved commercial development.
d. All development shall substantially conform to plans dated 7/11/2025, as revised by City
staff recommendations.
4. It hereby adopts the following findings:
a) Provides a flexible approach to development which is in harmony with the purpose and
intent of the City's Comprehensive Plan and Zoning Ordinance. The proposed PUD Amendment is in harmony with the purpose and intent of the Zoning Ordinance and consistent with the Comprehensive Land Use Plan designations for this
area. b) More creative, efficient, and effective use of land, open space, and public facilities through
mixing of land uses. The joint access to Fountain Hills Drive from the roundabout maintain the vehicular efficiency of the high-density residential site.
c) Create a sense of place and provide more interaction among people. The proposed PUD amendment proposes commercial uses that provide for community needs and services and for future commercial uses that will provide services to the area. d) Increase transportation options, such as walking, biking, or bussing. Trails/sidewalks are currently in place along the Fountain Hills Drive area. A sidewalk connection into the site will be provided as well.
e) Provide opportunities for life cycle housing to all ages. The proposed PUD amendment provides opportunities for current and future residents of
Prior Lake that are seeking services and amenities.

f) Provide more efficient and effective use of streets, utilities, and public facilities that support
high quality land use development at a lesser cost. The proposed PUD amendment will utilize existing street and utility infrastructure which
was designed and installed previously to accommodate land uses in the areas of Outlot A.
g) Enhanced incorporation of recreational, public, and open space components in the
development which may be made more useable and be more suitably located than would otherwise be provided under conventional development procedures. The PUD district also
encourages the developer to convey property to the public, over and above required
dedications, by allowing a portion of the density to be transferred to other parts of the site. The proposed PUD amendment is consistent with previously approved high density
residential designations and commercial designations in this area of the Jeffers Pond development.
h) Preserves and enhances desirable site characteristics and open space, and protection of
sensitive environmental features including, but not limited to, steep slopes, wetlands, and trees. Where applicable, the PUD should also encourage historic preservation, re-use,
and redevelopment of existing buildings. The proposed PUD amendment does not include any changes to the existing wetland near the Prior Lake outlet channel.
i) High quality of design compatible with surrounding land uses, including both existing and planned. The developer is proposing the use of architectural standards including but not limited to a variety of building materials and colors, varying wall heights, stone and lap siding, as
well as accent design features.
5. Final plans for Major Amendment to the Jeffers Pond Planned Unit Development are subject
to the following conditions:
a. The property owner shall obtain final plat approval for Outlot A. b. The property owner must obtain the required permits from any other state or local agency
prior to any work on the site. c. The developer shall revise the plans according to the August 5, 2025, City Engineering & Public Works Department Memorandum.
