CALL TO ORDER and PLEDGE OF ALLEGIANCE 2. PUBLIC FORUM The public forum is intended to afford the public an opportunity to address concerns to the City Council. The public forum will be no longer than 30 minutes in length and each presenter will have no more than five (5) minutes to speak. Topics of discussion are restricted to City governmental topics rather than private or political agendas. Topics may be addressed at the public forum that are on the agenda. However, topics that are the subject of a public hearing are best addressed at the public hearing, not at public forum. Therefore, topics may not be addressed at public forum if: (I) the topic has been the subject of a public hearing before the City Council or any City Advisory Committee and the Council has not acted on the topic; or (ii) if the topic is the subject of a public hearing for which notice has been published in the City’s official newspaper, or a continued public hearing or public information hearing before the City Council or any City Advisory Committee. During public forum, a member of the public may request that the City Council consider removing an item from the Consent Agenda following the procedure set forth in Section 401.5. The City Council may discuss but will not take formal action on public forum presentations. Matters that are the subject of pending litigation are not appropriate for the forum. 3. City leadership will seek guidance from the City Council on the parameters for negotiating the City's upcoming labor agreements. The City has three labor unions, Law Enforcement Labor Services (Sergeants), Law Enforcement Labor Services (Police Officers), and American Federation of State, County and Municipal Employees (AFSCME). The terms and conditions for represented employees are set forth in each union's collective bargaining agreement. The current agreements for all unions expire on December 1, 2025, and new agreements for each will be negotiated this fall. The session will be attended by the City Manager, Assistant City Manager, Interim Finance Director, and the City's labor attorney, Chris Amundsen of Nilan Johnson Lewis. Recognition of the Retirement of Finance Director Cathy Erickson City Manager Wedel Presented the Item Lake: Worked with Cathy for three Years and its always been a positive experience. Never shied away from a challenge. Acknowledged the AAA bond rating. Thanked her for everything she has done for the city. Briggs: Met in 2017 and it has been an honor to work with you. Council saw a high growing debt and the need to pay as we go. You have walked councilors through nine tax levies. You have left the city in better shape than what was brought to you. Erickson: Wanted to thank the council and manager Wedel for the trust that was put into her with the public dollars. This is vital to the services we provide as a city. Noted that she has taken the 08 12 2025 City Council Meeting Minutes responsibility seriously as well as all of the finance department. Showed appreciation of the support from council and city manager has given with financial topics and feedback that was given. Enjoyed working with the city staff, kudos to the department head team that the city has built. Nicole Klekner will have the leadership to continue to move the city forward. Resolution 25-120 Approving a Major PUD Amendment for Jeffers Pond 11 Addition (Previous th Jeffers Pond 10 Addition, Outlot A) Community Development Director McCabe Presented the Item Briggs: What are the comments that planning commission commissioner had when the public hear- ing was held. McCabe: Overall planning commission felt the development fit in well. One comment regarding commercial square footage. Paul Robinson: Introduced himself and gave a brief statement on the company. Briggs: Thanked Robinson for bringing commercial growth into the city. The Economic Develop- ment Authority and City Council need mixed use in developments and certainly daycare does ex- actly that. Please give council your perspective on the future building where the required commer- cial square footage has been shifted. Robinson: Explained the difficulties of the building. There is a potential for businesses to want to have their headquarters here or even a healthcare facility. These are all viable options but not the most common. In the meantime, we are keeping the options open to be able to meet the demand of the marketplace. Hopeful that this will happen Briggs: Educate the council on what is the significance to approving the permitted conditions for the future lot if the uses are already allowed in the C2 district. Robinson: Currently zero uses are specified as it is zoned PUD. Getting the uses approved is to avoid one more hurdle in the sale process. Briggs: Any additional hurdles they might face that the city can help with? Robinson: Mentioned Casey and the Staff have been great to work with there are no further hur- dles. BACKGROUND: The purpose of this agenda item is to request approval of a Memorandum of Understanding to implement the findings of a compensation analysis as agreed to under the terms of the current AFSCME collective bargaining agreement (CBA). The City and AFSCME, representing Prior Lake non-exempt employees (excluding sworn peace officers), are under a CBA through December 31, 2025. One of the terms of the CBA included a 4% cost-of-living adjustment and completion of a compensation market analysis. Specifically, Article 34 of the CBA states: EMPLOYER will conduct a compensation study in 2025. Upon completion of the wage study, wages will be adjusted to bring the group to 100% of the 2025 mean/average of the compensation study group retroactive to 1/1/2025. As part of the study, the City also agreed to conduct a job description evaluation to confirm the appropriate grade level for each position based upon current duties, minimum requirements and other factors. The AFSCME union is comprised of twenty-two (22) job titles for a total of 44 full-time and 3 part- time employees, which is the largest union group in the City. Job titles in AFSCME range from Public Works Maintenance Workers to Utility Billing Clerks, Police Records Specialists to Recreation Programmers. On 3/11/2025, the City Council approved an agreement with the Keystone Compensation Group to conduct this compensation analysis and job study. Keystone interviewed employees from each job title to confirm their duties and reviewed changes, if any, to the job descriptions based upon the supervisor’s review and edits. Keystone then evaluated the City’s pay scale with those of sixteen (16) comparable cities with populations between 25,000 - 40,000, as well as the cities of Champlin and Shakopee. The findings from the study concluded that the pay range minimum, or starting pay rate, for all but one job grade were at or above market minimums and that the pay range maximum for most City of Prior Lake | 4646 Dakota Street SE | Prior Lake MN 55372 Item 5B Page | 2 AFSCME jobs were at or slightly above market maximums. Overall, City of Prior Lake pay range maximums lag the market slightly for jobs below grade 140 and lead the market for jobs higher than grade 150. As such, the maximum pay rate has been adjusted to 100% of the market for jobs in grades 140 and 130. Grade 120 was found to be below both the market minimum and maximum, so adjustments have been made accordingly. As for the job description evaluation and related market analysis, Keystone recommended the following grade changes:  Planner: Assign to Grade 180  Senior Public Works Operator-Water & Utilities: Assign to Grade 170  Investigative Aide/Evidence Tech (new position as a result of police staffing study): Assign to Grade 150  Utility Billing Clerk: Assign to Grade 140 To implement the study’s findings, Appendix A – Pay Ranges of the AFSCME CBA needs to be adjusted through a Memorandum of Understanding. Through this action, all AFSCME grade wages will be brought to at least 100% of the market maximum average, thereby fulfilling the City’s obligation under the terms of the CBA. Wages for positions eligible for an adjustment will be retroactive to 1/1/2025. FINANCIAL IMPACT: Pay adjustments, including retroactive pay, will be funded through savings from unfilled positions and other budgeted payroll items in 2025. There is adequate budget planned for wage increases as part of the 2026 preliminary budget. ALTERNATIVES: 1. BACKGROUND: In 2023, the Minnesota Legislature approved new state funding for housing, including a first- ever tax dedicated to affordable housing. The new 0.25% Metro Area Sales and Use Tax for Housing provides a separate funding source called Local Affordable Housing Aid (LAHA) to cities located within the seven-county metropolitan area with a population over 10,000. The City received two payments in 2024 totaling $109,824.66 and the first payment in 2025 of $133,448.99. These funds can only be used to support affordable housing. The Link Passageways property is located at 13780 McKenna Road NW in Prior Lake. They are an emergency shelter for youth ages 12 to 17 who are victims of sex trafficking. Youth staying at this location are provided on-site supportive services which include:  Case management  Mental health therapy  Chemical dependency counseling  Education programming including on-site school  Physical health care services  Life skills training  Survivor mentor program  Positive youth development activities  Victim services for youth interacting with law enforcement  Family reunification counseling and support Their facility is aging and in need of a significant remodel. Per their attached request, they are looking to make essential upgrades to the property to ensure it can fully support the programming and services offered at the site. This includes both necessary renovations and deferred maintenance. They anticipate the completion of this work by the first quarter of 2026. Enjoy celebrating the signing of the U.S. Constitution every September during Constitution Week, which is September 17-23. The aims of the Constitution Week celebration are to:  Emphasize citizens' responsibilities for protecting and defending the Constitution.  Inform people that the Constitution is the basis for America's great heritage and the foundation for our way of life.  Encourage the study of the historical events which led to the framing of the Constitution in September 1787.  Constitution Week is a great time to learn more about this important document and celebrate the freedoms it gave us The Constitution established three co-equal branches of government, creating a separation of powers and a system of checks and balances. This system of checks and balances ensures that no one branch of government has too much power. The Constitution, often revered as the supreme law of the land, is not just a document outlining the powers of the federal government but also establishes a framework for governance at the local level. If it were not for the Constitution, we would not be celebrating the 250th anniversary of our United States on July 4, 2026. Therefore, let’s make shining a light on the study of our Constitution, a priority. SCA (primary location is in Holy Trinity United Methodist Church on Arcadia Avenue in Prior Lake) is a member of the National Diaper Bank Network, which has been actively raising awareness and addressing diaper need across the country. The National Diaper Bank supports a network of over 240 active diaper banks which support diaper distribution programs located in nearly every state in the United States. Along with the National Diaper Bank Network, individual diaper banks will hold events and work with their local and state governments to raise awareness of this need and the good work that diaper banks do to help parents obtain this basic necessity for their children. City of Prior Lake | 4646 Dakota Street SE | Prior Lake MN 55372 PROCLAMATION DECLARING SEPTEMBER 15-21, 2025 AS DIAPER AWARENESS WEEK IN PRIOR LAKE WHEREAS, diaper need, the condition of not being able to afford a sufficient supply of clean diapers to keep babies and toddlers clean, dry, and healthy, can adversely affect the health and well-being of children and their families; and WHEREAS, national surveys and research studies report that nearly one in two families struggles with diaper need, and 48 percent of families delay changing a diaper to extend the available supply; and WHEREAS, a daily or weekly supply of diapers is generally an eligibility requirement for babies and toddlers to participate in childcare programs and quality early-education programs that enable children to thrive and parents to work; and WHEREAS, many parents struggling with diaper need report missing an average of five days of work each month due to an insufficient supply of diapers; and WHEREAS, without enough diapers, babies and toddlers risk infections and health problems that may require medical attention resulting in medical costs, and parents may be prevented from accessing childcare needed to go to work or school, thereby destabilizing the family’s economic prospects and well-being; and WHEREAS, the people of Prior Lake in Scott County recognize that diaper need is a public health issue, and addressing diaper need can lead to economic opportunity for the state’s families and communities and improved health for children, thus ensuring all children and families have access to the basic necessities required to thrive and reach their full potential; and WHEREAS, Prior Lake in Scott County is proud to be home to trusted community-based organizations including SCA that recognize the importance of diapers in ensuring health and providing economic stability for families and thus distribute diapers to families through various channels; and WHEREAS, through their important work of addressing diaper need, diaper banks play a critical role in supporting families, improving infant health and wellbeing, and advancing our local and state economic growth. NOW, THEREFORE, I, KIRT BRIGGS, MAYOR OF THE CITY OF PRIOR LAKE do hereby proclaim September 15-21, 2025, as Diaper Awareness week in the City of Prior Lake. ____________________________ Kirt Briggs, Mayor ITEM: 9A CITY COUNCIL AGENDA REPORT MEETING DATE: September 09, 2025 PREPARED BY: Jason Wedel, City Manager PRESENTED BY: Jason Wedel AGENDA ITEM: Resolution Approving an Amendment to the Local Intergovernmental Aid Agreement Between the City of Prior Lake and Shakopee Mdewakanton Sioux Community (SMSC) for Years 2025 - 2027 RECOMMENDED ACTION: Adopt a resolution approving an amendment to the Local Intergovernmental Aid Agreement with the SMSC for the years 2025 - 2027. BACKGROUND: For many years the SMSC and the City of Prior Lake have had a collaborative relationship. The original Local Intergovernmental Aid Agreement (LGA) dates back to July 30, 1993. These agreements include providing mutual aid for each other. Over the years the SMSC has made increasing annual contributions to the City as part of these LGA agreements. The current agreement was approved by the City Council on December 10, 2024. Since the agreement was finalized there have been two key developments that have significantly impacted the City's police department operations and budget: a comprehensive staffing study and a compensation analysis. In 2024, the City engaged Berry Dunn to conduct an independent operational and staffing review of the Police Department. This year-long study, presented in February 2025, recommended eight additional full-time positions to better meet current and future service demands, including patrol officers, a sergeant, an investigator, and a records specialist. For 2026, the City plans to implement two of these positions, including the sergeant and records specialist, as well as hire an IT manager to support police operations. Additionally, a market compensation study completed in early 2025 revealed that police salaries in Prior Lake were below median levels when compared with 14 peer cities. In order to remain competitive and attract and retain high-quality personnel, we have begun to implement adjustments to bring compensation to a fair and sustainable level. These two developments were presented to the SMSC Business Council earlier this month with a request to increase the annual contributions by $125,000 in 2026 and an additional $125,000 in 2027. The SMSC Business Council agreed to the increased contributions and prepared an amendment to the existing agreement which is attached. These additional funds are greatly appreciated and will assist the City in meeting our shared goals with the SMSC of providing excellent public safety services while honoring the spirit of collaboration that continues to guide our relationship. Under the proposed amendment the LGA contributions will increase to $1,525,000 in 2026 and $1,650,000 in 2027. ALTERNATIVES: 1.
