AGENDA ITEM: Resolution Approving the Disposal of EDA-Owned Property at 4662 and
4664 Dakota Street SE
RECOMMENDED ACTION:
Approval of a resolution approving the disposal of EDA-owned property and dispensing with
statutory requirements for review by the planning commission.
BACKGROUND:
On June 12, 2023, the Prior Lake Economic Development Authority (EDA) held a public hearing
to consider the sale of EDA-owned property pursuant to Minnesota Statutes Section 469.105,
Subdivision 2. Following the public hearing, the EDA approved a resolution (Res. 23-03 EDA)
authorizing the EDA President and Executive Director to enter into a contract for private
development with Prior Lake B Squared Ventures, LLC for the sale of EDA-owned property at
4662 and 4664 Dakota Street SE.
Prior Lake City Code Sec. 2-232. Disposal of real property, states (a) disposal of real property
shall be by council approval, and (b) no interest in real property shall be disposed of by the city
until after the planning commission has reviewed the proposed disposal and reported in writing to
the city council its findings as to compliance of the proposed disposal with the comprehensive
plan. The city council may, by resolution adopted by two-thirds vote, dispense with the
requirements of this section when in its judgment it finds that the proposed disposal of real
property has no relationship to the comprehensive plan.
The sale of this property and the related redevelopment will conform with land use goals and
objectives of the comprehensive plan, including, maintaining a variety of residential densities;
allow higher density multiple dwelling housing in areas within close proximity of existing support
services and facilities, and where there is adequate access to collector and arterial streets; and
continue to actively pursue redevelopment. The subject property is guided in the Future Land Use
Map as Town Center. The planned redevelopment is proposing to eliminate two legally
nonconforming single-family homes and construct a multi-family residential apartment and
restaurant, which are both permitted uses in the TC, Town Center zoning district.
FINANCIAL IMPACT:
All proceeds from the sale of this property will be recorded in the EDA special revenue fund to be
used for future economic development purposes.
ALTERNATIVES:
1. Motion and second, as part of the consent agenda, approving a resolution approving the
disposal of EDA-owned property and dispensing with statutory requirements for review by
the planning commission.
2. Remove this item from the consent agenda for additional discussion.

A RESOLUTION APPROVING THE DISPOSAL OF EDA-OWNED PROPERTY AND
DISPENSING WITH STATUTORY REQUIREMENTS FOR REVIEW BY PLANNING COMMISSION

WHEREAS, on June 12, 2023, the Prior Lake Economic Development Authority (EDA) held a public
hearing to consider the sale of EDA-owned property located at 4662 and 4664 Dakota
Street SE, Prior Lake, MN pursuant to Minnesota Statutes Section 469.105, Subdivision
2; and
WHEREAS, the EDA-owned property is legally described as: All that part of Lot 2 lying East of the
West 5 feet as measured at a right angle, and Lot 3, all in Block 1, City Hall Plaza,
according to the recorded plat thereof, Scott County, Minnesota PIDs 255650020 and
255650030, the (“Subject Property”); and
WHEREAS, following the public hearing, the EDA approved a resolution (Res. 23-03 EDA)
authorizing the EDA President and Executive Director to enter into a contract for private
development with Prior Lake B Squared Ventures, LLC for the sale of EDA-owned
property at 4662 and 4664 Dakota Street SE; and
WHEREAS, Prior Lake City Code Sec. 2-232. Disposal of real property, states (a) disposal of real
property shall be by council approval, and (b) no interest in real property shall be
disposed of by the city until after the planning commission has reviewed the proposed
disposal and reported in writing to the city council its findings as to compliance of the
proposed disposal with the comprehensive plan; and
WHEREAS, Minn. Stat. § 462.356, subd. 2 states, no publicly owned interest in real property within
the municipality shall be disposed of until after the planning agency has reviewed the
proposed disposal and reported in writing to the governing body its findings as to
compliance of the proposed disposal with the comprehensive municipal plan. The
governing body may, by resolution adopted by two-thirds vote dispense with the
requirements of this subdivision when in its judgment it finds that the proposed disposal
of real property has no relationship to the comprehensive municipal plan; and
WHEREAS, the Prior Lake City Council considered approval of a resolution approving the disposal
of EDA-owned property and dispensing with statutory requirements for review by the
planning commission on November 12, 2025; and
WHEREAS, the City Council found the proposed disposal of the Subject Property has no relationship
with the comprehensive municipal plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prior Lake that:
1. The disposal of Subject Property has no relationship with the City’s comprehensive municipal
plan.
2. Review by the Planning Commission of the sale of the Subject Property is hereby dispensed
with.
3. All proceeds from the sale of the Subject Property will be recorded in the EDA special revenue
fund to be used for future economic development purposes.
