AGENDA ITEM: Resolution Approving Public Improvements for the Aspen Ridge
Development (2024-20)
STRATEGIC WELL MANAGED GROWTH
PRIORITY: 3. $0 in development costs transferred to taxpayers.
RECOMMENDED ACTION:
Adopt a resolution accepting the public improvements for the Aspen Ridge Development.
BACKGROUND:
This action is called for as part of the development agreement between the developer and the
city. It is the process through which privately installed improvements come into public ownership
pursuant to the development agreement. The development agreement outlines the mechanisms
for city acceptance of the developer-installed improvements, requiring City Council authorization
to accept the improvements in addition to the final written acceptance by the City Engineer.
The developer has now completed the improvements as outlined in the development agreement.
The improvements have been inspected by the city for compliance with city standards and the
approved drawings. In some cases, minor field changes were necessary during construction.
These improvements, including any field adjustments, were documented in the as-built drawings
that were completed by the developer and reviewed by the city.
Public Works staff have reviewed the improvements and have written the acceptance letter for
this development. It is now appropriate for the City Council to accept the improvements for this
project.
FINANCIAL IMPACT:
Acceptance of the improvements by the City Council will initiate the 2-year warranty period. A
financial security will be held by the City until the completion of the warranty period.
ALTERNATIVES:
1. Motion and second as part of the consent agenda to adopt a resolution accepting the
public improvements for the Aspen Ridge Development.
2. Motion and second to remove this item from the agenda for further discussion.

RESOLUTION 25-
A RESOLUTION ACCEPTING THE IMPROVEMENTS FOR
THE ASPEN RIDGE DEVELOPMENT
Motion By: Second By:
WHEREAS, on April 8, 2025, the City Council adopted Resolution 25-052 which authorized
the City to enter into a development agreement with Distinctive Land
Development, LLC for the Aspen Ridge Development; and
WHEREAS, the development agreement outlined the improvements the developer was
responsible for installing; and
WHEREAS, these improvements are now complete to the satisfaction of the city; and
WHEREAS, the city has received the as-built drawings; and
WHEREAS, Public Works staff have reviewed the improvements and have written the
acceptance letter for this development.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the improvements for the Aspen Ridge Development.
3. Any remaining escrow dollars for construction inspection will be returned to the developer at
the conclusion of the warranty period.
