RECOMMENDED ACTION:
Approve an Ordinance amending Sections 2 (2026 Fee Schedule) and approve adopting the
summary of ordinance and ordering its publication.
BACKGROUND:
The purpose of this agenda item is as follows:
1. Hold a public hearing for the proposed 2026 Fee Schedule,
2. Consider approval of an Ordinance adopting the 2026 Fee Schedule
3. Adopt a summary ordinance approving a Chapter 2 Fee Schedule summary for
publication.
Annually, staff reviews the fee schedule as part of the budget process and will make
recommendations to the City Council for changes or additions as needed. The Council is required
to announce the time and place of the council meeting at which the 2026 fee schedule will be
discussed and allow for citizen input. A public hearing is being held on December 9, 2025. The
fees are adopted in the current year, so the new fees will be in effect for the entire new (upcoming)
year.
Fee Schedule Changes:
During the 2026 budget process, staff presented significant changes to the fee schedule as part
of the budget workshops. The input received from the public hearing and City Council on
December 9 will be incorporated into the 2026 Fee Schedule. Shown below are a listing of all the
proposed fee schedule changes and the reason for the change. Attachment 3 is the 2026 Marked
Fee Schedule. It is labeled, and color coded as follows:
• Blue – Changes in heading/name of fee, specifying timeframe (i.e., per month, per billing
cycle). No new fees or changes to the amount of fees.
• Purple – New fees. Explanations are listed below.
• Orange – Changes in fees. Explanations are listed below.
• Red – Deleted fees. No longer applicable.

UTILITY CONNECTION AND PERMIT CHARGES:
City Water Tower Charge – With the annexation area now able to be developed, a third water
tower is necessary.
PARK FACILITY RENTALS:
Beach Special Use Daily Rate (Resident/NonResident) – For organized group meetings/utilizing
the beach for business.
Lakefront Park Pavilion Rental: Additional Park Space – For approved groups hosting large
outdoor events in the park that require more space (grass field, dry ice rink, parking lot).
EXPLANATION OF CHANGES TO FEES (ORANGE HIGHLIGHTED ITEMS)
UTILITY DEVELOPMENT FEES:
Acreage Charges for Trunk Water, Trunk Sewer, and Trunk Stormwater - Staff is recommending
an inflationary cost increase of 13.84% based on the construction cost index (CCI) for Sewer and
Stormwater. With the annexation area now able to be developed, a third water tower is necessary.
A water tower fee has been included in the fee schedule and the Water trunk fee has been re-
calculated to accommodate this fee.
UTILITY CONNECTION AND PERMIT CHARGES:
Connection Charges for Trunk Water and Trunk Sewer - Charges for Water Connection and
Sewer Connection: Staff is recommending an inflationary cost increase of 13.84% based on the
construction cost index (CCI).
UTILITY RATES AND CHARGES:
Utility Financial Management Plans
The 2026 budget reflects the utility rates included in the Capital Improvement Program (CIP)
adopted by the Council on August 12, 2025. Staff presented rate increases necessary to fund
operations as well as capital projects identified in the Capital Improvements Plan. The CIP
includes $12.1 million of water projects, $14.5 million of sewer projects, and $5.7 million of water
quality projects planned over the next five years.
Funding for utility funds is achieved through rates charged and/or debt issuance. Council directed
staff to plan for rates that achieve the City’s goals around rates and revenue sufficiency, while
ensuring the necessary funding for operations and capital projects identified in the CIP. To
achieve this, the following rate increases will be necessary for 2026:
• Water rate increase of 3.0%
• Combined sewer rate increase of 7.5% (City Sewer and MCES Sewer)
• Stormwater rate increase of 3.0%.
The estimated utility bill combined impact for a medium water user is a 5% increase with an annual
impact of $67 as shown in the table below.

MCES Sewer Rate
It should be noted that City utility bills also include a MCES Fee for Sewer. This fee does not
support City operations or the Capital Improvement Plan, but is a fee collected by the city from
residents to pay the Metropolitan Council’s Environmental Services (MCES) fee for regional
wastewater disposal and treatment. The fee will increase 3.5% for 2026, reflecting the increased
fee that the Metropolitan Council is charging Prior Lake.
The bimonthly 2026 rate increase impact on high, medium, and low volume water users is shown
in the table below.

PERMITS:
Excavation & Grading Permits & Escrows – Staff is recommending increases to cover staffing
costs and to cover minimum costs on residential and commercial permits.
Plumbing and Mechanical Permits – Current fees are not sufficient to cover processing, review
and inspection costs on residential additions and alterations.
SERVICE CHARGES:
Public Works Contracted Service – Staff is recommending an increase to capture the increases
in the hourly rate of the public works department.

Street Overlay/Resurfacing Assessment - Staff is recommending an inflationary cost increase of
13.84% based on the construction cost index (CCI).
POLICE, FIRE & RESCUE SERVICE CHARGES:
Police Contracted Rate – Staff is recommending an increase to capture increases in the hourly
rate of the police department.
PARK FEES:
Daily Admission (Sand Point Beach) - Staff is recommending an increase to help cover the City’s
annual cost increases.
EXPLANATION OF FEES REMOVED (RED HIGHLIGHTED ITEMS)
Cellular Provider Antenna Structural Review – Historically, the city has incurred costs for
consultant plan review, construction observation and inspection, as well as city staff and legal
time for antenna projects on city water towers. This work is for the cellular providers’ sole benefit,
so the city has collected an escrow for the estimated costs, paid the invoices directly from the
escrow account, then reconciled the escrow account at the end of the project by requesting
additional funds or refunding funds to cellular provider as applicable. There have been many
antenna projects that have been delayed for numerous reasons that have left the escrow balances
open for multiple years. To simplify this process and create efficiencies for Public Works, Finance
and the cellular providers, staff recommended that we charge the cellular providers a fee instead
of an escrow starting in 2025. After further research it was decided that we could not issue these
fees unless the antenna agreements were restructured. Therefore, no fees were charged in 2025
and the City continued collecting escrows as in the past.
FINANCIAL IMPACT:
The fee schedule identifies those types of service charges and license fees charged on a user
basis to recover City-associated costs. Charges for services, licenses and permits are a
significant part of the revenue stream supporting the City’s budgets. For example, the General
Fund budget receives about 6% of its support from charges for services, licenses and permits.
100% of the city’s water, sewer, and stormwater operations are funded by user charges/fees.
ALTERNATIVES:
1. Motion and second, to approve an Ordinance amending Section 2 (adopting the 2026
Fee Schedule).
2. Motion and second to approve a Summary Ordinance permitting summary publication of
the Ordinance adopting the 2026 Fee Schedule (requires a 4-5 vote to pass pursuant to
state law).
3. Delay action if the Council requires additional information.

Recommendation:
Council has indicated their support for pay-as-you-go funding in the utility funds
vs debt issuance to fund utility infrastructure projects.
The 2026 budget reflects the utility rates included in the Capital Improvement
Program (CIP) adopted by the Council on August 12, 2025. The council directed
staff to continue to plan for the 10-year projects identified in the pavement
management plan to ensure that roads are maintained at the appropriate point in
their life cycle.
