APPROVING A CONDITIONAL USE PERMIT TO ALLOW PRIVATE ENTERTAINMENT IN THE C.5 (BUSINESS PARK)

The Prior Lake Planning commission conducted a public hearing on April 24, 2006, to consider an
application from RJ Ryan Construction company for a condiiional use Permt (cUP) io allow private
entertainment ; and
Notice of the public hearing on said CUP was duly published in accordance with the applicable Prior
Lake Ordinances; and
The Planning commission proceeded to hear all peBons interested in this cUP and persons
interested were afforded the opportunity to present their views and objections related to the cuP; and
The Planning Commission approved the CUP with specific conditions; and
The Planning commission flnds the proposed cuP is compatible with the stated purposes and intent
of the Zonini Ordinance as they rel;te io conditionally permitted uses, and further, that the proposed
cuP meets the criteria for approval of cuP as contained in section 1108 202 ol the Zoning
Ordinance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE:
1. The recitals set forth above are incorporated herein.
2. The Planning Commission hereby adopts the following findingsl
(1) The use is consistent with and supportive of the goals and policies of the comprehensive Plan'
Two of the objectives of the Comprehensive Plan is lo "maintain high standatds in the promotion and development of
commerce ard industry.' A policy supporting this objective islo "maintain ptoper physical site screening and landscaping

(2) The use will not be detrimental to the health, safety, morals and general welfare of the community as a whole'

i,r The use is conslstent with the intent and purpose of the Zoning Ordinance and the Use Distric-t in which the
Conditional Use is located.

The use will not have undue adverse impacts on the use and enjoyment of properties in close proximity to the
conditional use.
The Zoning Odinance places conditions on private enlertainment in the C-5 use district to plotect adjacent uses. Provided
all conditio-ns are met, tire use will not have undue advese impacts on the propedies in close prcximity.
The use is subject to the design and other requiremenb of slte and landscape plans pretared by or under the

to protect the general welfare, public safety, and neighborhood character'

a) The applicant shall record the Conditional Use Permit at Scott County no later than 60 days affer City Council
apprcvar.
b) A sign permit application must be submifted to the City prior to the installation of any signage on the site.
c) The applicant shall submit revised plans showing details of the entrance construction on Industrial Lane. The
entrance needs to be constructed with a curb radius retum extending to the easl property line.
d) The applicant shall submit a revised landscape plan that provides scrcening for at least 60% of the perimeter of the
parking area.
e) Revise the plans to address comments detailed in the City Engineers April 11' 2006 memo.
fl prior to site plan approval the applicant shall submit recorded easements allowing vehicular access and snow stot'age
on the site,g) The applicant must provide documentation of the recoded Deerfield Industrial Park 6h Addition Final Plat prior to site
plan approval.
h) Frior io site plan approval, the applicant shall submit revised plans reflecting plan changes and conditions as
indicated.
i) Allconditions listed in Section 1102 1403(9) of the Zoning ordinance shall be met

Based upon the Findings set forth above, the Planning Commission hereby grants a Conditional. Use Permit for private
entertainment in the GSlistrict. The contenb of Planning Case Files # EP06-125 are hereby entered into and made a part of
the Dublic recod and the recod of the decision for this case.
