RECOMMENDED ACTION:
Adopt a resolution ordering the preparation of the feasibility report and approving a work order
with WSB LLC for the Green Heights Reconstruction Project (2028-03).
BACKGROUND:
The City utilizes a Capital Improvement Program (CIP) to plan the timing and financing of its
infrastructure improvements. The 2026-2030 CIP includes street and utility improvements to 1.4
miles of roadway within the Green Heights area in 2028, as illustrated on the attached location
map.
The M.S. Chapter 429 process applies to all projects that will be financed in whole or part through
special assessments or bond proceeds. The first step in the process is for the Council to order
the preparation of a feasibility report for the improvement project. The feasibility report will address
options and costs for the street, utility, and storm sewer upgrades. City assessment policy will be
applied to the preliminary assessment calculation which is completed as a part of the feasibility
report. The feasibility report will provide the details needed for the city to make decisions on how
to proceed.
WSB LLC, a member of the City’s consultant pool, has provided a proposal in the amount of
$1,422,721 to provide the following services for this project:
• Preparation of the feasibility report
• Project management
• Topographic survey
• Plans and specifications
• Bidding administration
• Public engagement
• Construction services
• Project closeout
FINANCIAL IMPACT:
The 2026-2030 CIP includes $8,757,558 to complete this project, which includes the overhead
costs noted above. This work order represents 16.2% of the total project cost, which is in line with
the typical cost for engineering and overhead work on a project of this scope.

WHEREAS, the 2026-2030 Capital Improvement Program (CIP) includes $8,757,558 for the street
and utility improvements to 1.4 miles of streets within the Green Heights area; and
WHEREAS, a feasibility report is needed to determine the best options for construction and financing
for this project; and
WHEREAS, WSB LLC, a member of the City’s consultant pool, has provided a proposal in the
amount of $1,422,721 to develop the feasibility report and provide project management
and construction administration services for this project; and
WHEREAS, staff recommend executing a work order with WSB LLC in the amount of $1,422,721 for
the development of the feasibility report, project management, and construction
administration services.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Council hereby orders the preparation of the feasibility report for the Green Heights
Reconstruction Project (2028-03).
3. The Mayor and City Manager are hereby authorized to execute a work order with WSB LLC in the
amount of $1,422,721 for the development of the feasibility report, project management, and
construction administration services for the Green Heights Reconstruction Project (2028-03).
4. The funding for this project is included in the 2026-2030 CIP.

Public Works Consultant Pool Work Order
Green Heights Reconstruction Project (2028-03)
WSB & ASSOCIATES, INCORPORATED, dba WSB LLC
This work order (“Work Order”) is issued on this 10th day of March, 2026 by the City of Prior
Lake (“City”) pursuant to the Public Works Consultant Pool – Master Agreement dated April 20,
2020 and as amended February 24, 2025 (“Contract”) between the City and WSB & Associates,
Incorporated, dba WSB LLC (“Consultant”).
Based on the mutual promises and covenants set forth herein, the sufficiency of which are
hereby acknowledged, the City and Consultant agree as follows:
1.Scope of Work Order. Consultant agrees to provide, perform and complete all the services
requested by the City in this Work Order and attached Exhibit 1 (“Work”), which Work shall
be subject to the terms and conditions of this Work Order and the Contract.
2.Term of Work Order. All Work requested by this Work Order shall be completed in
accordance with the project schedule set forth by the City Engineer.
3.Compensation for Work Order. City agrees to pay the Consultant an amount not to
exceed $1,422,721 as full and complete payment for the Work requested by this Work
Order.
4.Consultant Representative. Consultant has designated Monica Heil to manage the Work
Order subject to the supervision of Consultant’s representative.

RE: Supplemental Agreement to Provide Professional Engineering Services to
complete a Feasibility Report, Final Design and Provide Construction
Administration Support for the City’s 2028 Green Heights Street and Utility
Improvement Project
Dear Mr. Monserud:
On behalf of WSB we are pleased to submit this Supplemental Agreement to our Public Works
Consultant Pool Master Agreement, dated April 20, 2020 to provide engineering services to the
City of Prior Lake. Specifically, our services will include supplemental geotechnical and survey
services, a preliminary cultural resource evaluation, wetland delineations, the preparation of a
Feasibility Report, a robust public engagement service for residents, business owners and
Home Owner Associations (HOAs), final design, bidding, preparation of final assessment rolls
and assisting the City with Construction Administration for the City’s 2028 Green Heights Street
and Utility Improvement Project.
PROJECT UNDERSTANDING
Streets within the City’s 2028 Green Heights Street and Utility Improvement Project are a
combination of public and private. There are two HOAs located within the project area that are
responsible for the maintenance of private streets, including any storm sewer facilities located
within the private streets. All watermain and sanitary sewer within the project is assumed to be
located within public right-of-way or public easements, making all water and sanitary sewer within
the project public. It is understood that all public roadways will be completely reconstructed (new
roadway section, new surmountable concrete curb and gutter (with some areas receiving barrier
curb) and replaced/rehabilitated public utilities. It is understood that for private roadways, public
utilities (water and sanitary sewer) will be replaced/rehabilitated. No improvements are proposed
for the private storm sewer system. No improvements are proposed for the private streets, roadway
surfaces will be patched and private infrastructure salvaged and reinstalled associated with the
public utility replacements.
At this time, it is understood that water service replacement is proposed to the existing curb stop
locations. Those limits shall be reviewed with the City during the feasibility report preparation for
impacts and also location relative to platted roadway/driveway/drive/walk easements. It is also
anticipated that sanitary sewer service replacement/rehabilitation will occur as a part of the project,
the limits of which to be defined with the feasibility report relative to platted
roadway/driveway/drive/walk easements.

Through discussions with City Staff and a field visit to the project site on October 14, 2025, we
have developed the following project approach and scope of service.
PROJECT APPROACH/SCOPE OF SERVICES
WSB’s project scope and proposed tasks are based on our understanding of the project, and
we propose the following scope of services:
Task 1 – Geotechnical
• WSB will obtain additional soil borings for the lift station location and private streets
identified, to supplement the 2017 soil boring work and geotechnical report produced
by Element Materials Technologies that evaluated public streets within the project.
WSB’s scope of services includes 9 borings to 10-foot depths. WSB will also:

• Obtain geotechnical report with pavement evaluation and recommendations for
patching the private streets at utility excavation points.
• Participate in a Gopher State One site meet.
• Perform Standard Penetration Test borings and sampling
• Perform lab testing for percent fines and organics for classification of subgrade
soils
• Complete routine lab tests (moisture content and P200 wash)
• Classify soils with USCS and prepare boring logs
• Preparation of a Geotechnical Report with recommendations for pavement
patching design
• Our Geotechnical Engineer will review samples, field notes, photographs and
readily available information from various web sources.
• WSB will provide recommendations on utility repairs based on an evaluation of
the soil compositions throughout the project areas.
Note: Traffic control is not included in the estimate. It is anticipated that all work
can be completed under traffic and that the City of Prior Lake will obtain permission
from the necessary HOAs to grant access to WSB to complete the work.
Task 2 – Supplemental Topographic Survey
WSB will complete topographic survey to supplement the 2017/2018 topographic survey
originally completed by WSB. Supplemental data to be collected with 2026 survey efforts
include:
• Updated Gopher State One Call private utility mapping
• Water service curb stop locations along all public and private streets
o WSB proposes to collect survey data over the course of 1-1.5 days for all curb
stop locations that City Public Works Staff will locate and mark in the field.
• Supplemental topographic survey information for the lift station and area surrounding
it.
• The 10’ “walk” easement area located between Ramsey Avenue and Dunkirk Avenue
(this area was not surveyed in 2017/2018).
• Private infrastructure constructed since 2017/2018, including the paved Charlie’s
parking lot adjacent to Green Heights Trail and the associated storm sewer
improvements.
Initially, survey controls will be set up for the project area followed immediately by the
topographic survey of the existing conditions outlined above. Storm sewer structures will
include measure downs and rim elevations for structures installed with the Charlie’s parking lot
improvements.
It is also proposed to complete the Gopher State One Call locate request for maps as a part of
the topographic survey work.
As a part of the supplemental topographic survey work, WSB also proposes to utilize drone
technology to create a 3D reality capture that will document existing conditions within the
project. It is proposed this reality capture work be completed in the spring of 2026 after snow
melt and prior to full tree canopy development. One additional drone flight is desired between
20206 and fall of 2027, ideally following a rain event, to capture existing drainage patterns.

Task 3 – Environmental
Archeological Assessment
An archeological assessment is recommended given the location of the project. Our proposal
includes scope to engage an archeological subconsultant in a Phase 1a literature review and
Phase 1 survey and report assuming the project will be 100% funded using local funds. Should
the City obtain any federal funding to complete portions of the project, additional Section 106
process requirements may apply and a separate proposal can be provided for the City’s
consideration to complete that work.
The Phase 1a literature review will focus on the project area and the surrounding 0.5 mile radius
using Minnesota State Historical Preservation Office (SHPO) files. Deliverables include a letter
report for SHPO compliance.
If warranted by the recommendations of the Phase 1a report, a Phase 1 survey and report will
also be completed. For the purposes of this proposal, it is assumed a Phase 1 survey and
report will be required and the Phase 1 scope assumes one on-site meeting with the Minnesota
Indian Affairs Council (MIAC) and the Shakopee Mdewakanton Sioux Community (SMSC) prior
to beginning work on the Phase 1 survey. Deliverables include a Phase 1 archeological report
completed in accordance with Minnesota SHPO guidelines.
Findings of the Phase 1a literature review and possible Phase 1 survey and report may impact
design and construction plans for the project. As such, it is recommended that the City
authorize work to commence for the Phase 1a literature review as soon as possible.
Wetlands
WSB will delineate aquatic resources along the project corridor, including wetlands and the
Ordinary High Water (OHW) elevation of Prior Lake at outfall locations. Delineation s will be
completed using the US Army Corps of Engineers Wetland Delineation manual and Midwest
Regional Supplement. Boundaries of wetlands will be flagged using pink pin flags and surveyed
using sub-meter accuracy GPS units. The OHW elevation of Prior Lake will be determined using
data from the MN Department of Natural Resources. Data collected will be summarized in a
delineation report and submitted to the city and then regulatory agencies for review. Once
approved, electronic files of the boundaries will be provided to the city and design team for use
in planning.
If impacts occur as a result of the proposed work, WSB will prepare permit applications for the
Wetland Conservation Act (WCA), US Army Corps of Engineers, and DNR, as applicable.
Based on our understanding of the proposed scope of work, impacts are expect ed to be minor
and will not require a replacement plan or mitigation. Upon receipt of permits, WSB will review
conditions and provide final approvals to the city and design team.
In addition to the work outlined above, this scope also includes administration of the Wetland
Conservation Act, including review of the delineation report, joint application, coordination of an
agency field review, and preparation of required notices.

Task 4 – Feasibility Report
WSB will prepare a Feasibility Report for the 2028 Green Heights Street and Utility
Reconstruction Project which will include:
• Pavement recommendations for new public streets
• Pavement patching and restoration recommendations for utility work proposed along
private streets
• Utility replacement/rehabilitation recommendations based on Public Works maintenance
histories, service needs and construction constraints
o This includes WSB review of the City’s most recent sanitary sewer televising
records for the project area to evaluate the potential for lining of the existing
system.
• Potential archeological impacts and construction requirements
• Lift station rehabilitation scope of work recommendations along Green Heights Trail
• Access and phasing considerations
• Feasibility Report text — Executive Summary, Existing Conditions, Proposed
Improvements, Special Considerations, Cost Estimate/Financing, and Recommendations .
• Preparation of the preliminary assessment roll
o It is assumed assessments will vary for residents located along public streets
and within an individual HOA
• Maps and figures as necessary
• Project schedule
WSB will attend a neighborhood meeting for the Project as a part of this Feasibility Report.
WSB will also attend two separate and individual meetings with the two HOAs located within
the project in advance of feasibility report completion. WSB will also prepare materials for, and
attend, the City Council meetings in which the Feasibility Report is presented to the City Council
and the Improvement Public Hearing is held for the Project as a part of this task.
Task 6 – Project Communication
WSB will support City Staff in developing meeting materials and will join City Staff for meetings
with the two HOAs and business owners within the project area following the presentation of the
feasibility report. WSB will serve as an extension of City Staff in these meetings, working with
members of the public to identify potential areas of concern and incorporating comments received
into the final design of the project.
WSB will also create a website, an email address and a project hotline for the 2028 Green Heights
Street and Utility Improvement Project. WSB will update the website content and monitor all
email and project hotline correspondence from the time the project is initiated with the public (Fall
2026) through completion of the improvements (Spring 2029). Third party website hosting fees
will be billed to the City as a pass-through expense.
Task 7 – Final Design
Project Management
Project management includes the development of the project plan through bidding. This task
includes the appropriation of necessary staff and resources at all stages of the final design process
to achieve project milestones and completion. This includes f requent communication and

coordination with City staff and its agents governing all aspects of the project. Proper completion
of this task will allow for open lines of communication and routine updates on project issues, as
well as keeping the project on schedule and within budget.
Design, Specifications, and Plan Preparation
WSB will for each project:
• Complete the design and prepare the project plans consistent with City, ADA, and local
regulatory standards.
• Evaluate storm sewer inspection/maintenance needs identified by City Public Works Staff and
provide a recommendation regarding improvements.
• Facilitate a Utility Coordination Meeting for the project.
• Prepare the specifications consistent with City, ADA, and local regulatory standards.
• Calculate project quantities and prepare the project Bid Form.
• Prepare an Engineer’s Opinion of Probable Cost on the final design.
• Perform quality control reviews regularly throughout the duration of the design.
• Attend project meetings with City staff and design team (WSB staff) members as necessary.
The project plans will be generally organized as follows:
• Title sheet
• General layout
• SEQ and Tabulations
• Standard details
• Removals
• Improvement plans (plan and profile)
• Erosion control
• SWPPP
Deliverables:
• 60% Plan Submittal: Draft plan set for City review and comment
• 90% Plan and Specification Submittal: Draft plan set and specifications for City review and
comment
• 100% Plan and Specification Submittal: Three (3) 11” x 17” hard copy final plan sets and
three (3) specifications for your files
Permits
Prepare the following permits for each project:
• Minnesota Pollution Control Agency – NPDES permit
• Prior Lake – Spring Lake Watershed District Permit
• Wetland Conservation Act (WCA) – potential wetland impacts
• US Army Corps of Engineers (COE) – Potential outfall impacts
• Minnesota Department of Natural Resources (MDNR) - Potential outfall impacts
• SHPO and MIAC concurrence (if required) regarding any cultural resource findings
Bidding Assistance
Prepare the Advertisement for Bid in compliance with the City’s practices; facilitate project bidding
by answering contractor questions, prepare the Addenda if necessary, and host the virtual bid
opening for the project. The cost to advertise the projects will be paid by the City of Prior Lake.
WSB will submit the Advertisement for Bid to the local paper and to Finance and Commerce.

As-builts
WSB will prepare as-builts consistent with the City of Prior Lake standards for utility work associated
within each project. Deliverables will include a .pdf version of the as-builts.
Task 8 – Final Assessment Roll
Using as-bid unit prices, WSB will develop a final assessment roll for the 2028 Green Heights
Street and Utility Improvement Projects. WSB will assist with developing the Notice of
Assessment Hearing for Publication in the local paper, the letter to residents notifying property
owners of the assessment hearing and the presentation for the assessment hearing at the City
Council meeting. WSB will attend the assessment hearing as a part of this task and assist the
City with its delivery of the presentation as requested.
Task 9 – Assisting the City with Construction Management
Construction Staking
WSB will provide construction staking and survey for construction of the project. WSB assumes
one-time staking for all required staking needs. Any re-staking will be billed at a time and materials
hourly rate.
Construction Contract Administration
WSB will provide Contract Administration services through construction of the project and final
project closeout. This will include:
• Preparation of materials for and attendance at the preconstruction meeting for the project.
• Responding to all contractor requests for information (RFI).
• Responding to all City requests for information/clarification during construction.
Construction Observation
WSB will provide Construction Observation services through construction of the project and final
project closeout. This will include:
▪ Attendance at the preconstruction meeting for the project.
▪ Construction observation for an assumed single season thirty-two week (32) construction
schedule.
▪ Construction Observer attendance at weekly progress meetings with the contractor and
City.
▪ Assisting City Staff with the preparation of any contract modifications including Work
Orders, Change Orders, and Supplemental Agreements generated by the City.
▪ Responding to all contractor requests for information (RFI).
▪ For periods of multiple crew activities, it is assumed that in addition to a Lead full-time
observer, additional observation support will be required from a second observer.
▪ Provide all required erosion and sediment control inspections and reporting in conjunction
with the NPDES permit for the project.

Construction Materials Testing
WSB will provide the following construction materials testing services for the project:
• Perform soil sampling proctor evaluations (where applicable).
• Perform test rolling of materials as required.
• Perform density and moisture testing by nuclear gau ge on fill and backfill placed during backfill
and earthwork operations.
• Perform dynamic cone penetrometer (DCP) testing on granular, reclaimed and aggregate base
materials.
• Perform gradations for reclaimed aggregate, topsoil and bituminous mix.
• Perform bituminous density testing.
• Perform concrete testing for curb and gutter, driveways and private sidewalk.
• Coordination with City inspection staff to determine testing frequency and locations.
• Communicate verbal testing results to the City inspection staff as soon as results are available.
• Provide written testing reports to the City within two weeks of testing.
• Utilize City survey stationing for all testing results.
Schedule
Based on our discussions with City Staff, we are proposing the following schedule for the 2028
Green Heights Street and Utility Improvement Project to be completed in a single construction
season. However, as construction methodology and discussions with the HOAs advance, this
schedule may be subject to change.
• February 2026: Authorize the contract with WSB and the preparation of the feasibility
report for the project

Assumptions
We have prepared this proposal using the following assumptions:
• The City will perform all necessary research and will provide legal interpretations of
where the City has the rights and obligations to complete the work. This includes
private streets/walks/drives/driveways within the Inguadona Beach and Green Heights
plats and public drainage and utility easements obtained after the plats were recorded.
• The City will provide WSB will copies of all recorded public easements for the area.
• The City will obtain and coordinate all necessary Right of Entries (ROEs) for the project
from property owners and/or the HOAs. This includes work associated with:
o Geotechnical evaluations,
o Topographic survey,
o Drone flights, and
o Construction
• No public retaining wall replacement requiring engineered design is anticipated.
• Private retaining walls disrupted by construction will be salvaged and replaced by the
contractor; no engineering plans/designs are required.
• The 10’ wide “walk” easement (alleyway) between Ramsey and Dunkirk Avenues is not
anticipated to be paved/improved as a part of the project. The easement area appears
to be occupied by mature trees and sheds. Access to this “walk” easement area is
limited and it is unclear if easement exist to facilitate mainline or utility service
installations in this area.
o For the purposes of this proposal, it is assumed utility main line lining, only, will
be completed for this area.
o It is assumed the City will negotiate and obtain the necessary permissions for
contractor access to complete the work.
o It is assumed the City will negotiate restoration requirements with the property
owners in exchange for granting ROEs to complete the work.
o Service utility replacement will require significant tree removal. If utility service
replacement is desired, WSB will provide a separate fee estimate for
engagement and planning purposes for this work.
• It is anticipated that the existing Green Heights lift station manhole will be lined and all
pumps and piping within the manhole will be replaced. The control panel for the lift
station will also be replaced as a part of this project.
o The City will order the control panel (from Total Control) and the pumps
themselves and provide to the contractor for install.
• Stormwater and water quality infrastructure improvements are proposed for public
streets, only.
o No new/additional drainage infrastructure will be installed within private streets.
• WSB anticipates the neighborhood will be asked if midblock street light additions are
desired by the neighborhood, but has not included a price for coordination with the
private utility company should the neighborhood desire to move forward with additional
streetlights. WSB can provide an estimate for these services in a separate proposal.
• WSB anticipates the neighborhood will be asked if undergrounding of existing overhead
utilities is desired by the neighborhood, but has not included a price for coordination
with the private utility companies should the neighborhood desire to move forward with
undergrounding. WSB can provide an estimate for these services in a separate

• WSB assumes no large scale clearing and grubbing activities will be required to
complete the street and utility improvements, and therefore, has not included an

evaluation of tree covered areas for natural resource habitat disruptions nor in public
engagement scope.
• As the project spans 3+ years, WSB hourly billing rate increased have been assumed
and rates blended for cost estimating purposes.
• This proposal assumes the project will be substantially constructed in 2028. However,
as access and phasing plans for the construction are developed, there is a strong
likelihood the project will be partitioned into two separate construction seasons.
o If the project is partitioned into multiple-year construction contracts, WSB will
provide a revised proposal related to construction service needs in 2028/20209
associated with the project.
PROPOSED FEE
WSB will provide the services as outlined in Project Approach/Scope of Services. Our budget
was developed based on our understanding of the scope and experience with past street
improvement projects in the area. We have assumed that the 2028 Green Heights Street and
Utility Improvement Project will include street and utility replacement/rehabilitation for all public
streets within the project, and that public utilities located within private streets will be
replaced/rehabilitated, but private infrastructure disrupted by public utility replacement will be
salvaged and reinstalled and private street surfaces patched. Our proposal has considered
estimated year-over-year increases in our annual fee schedule, construction completed in 2028.
We estimate an hourly not to exceed fee of $1,422,721.00.
