HomeMy WebLinkAbout05(O) - Ordinance Amending Chapter 5, Article VI of Prior Lake City Code Related to Portable Toilets Report ITEM: 5O CITY COUNCIL AGENDA REPORT MEETING DATE: March 10, 2026 PREPARED BY: Casey McCabe, Community Development Director PRESENTED BY: Casey McCabe AGENDA ITEM: Ordinance Amending Chapter 5, Article VI of Prior Lake City Code Related to Portable Toilets RECOMMENDED ACTION: Approval of an ordinance amending Chapter 5, Article VI of Prior Lake City Code Related to portable toilets BACKGROUND: A business located in the C-3, Business Park district has requested the City Council approve an amendment to City Code that would allow them to place a portable toilet on their property as a secondary bathroom facility for truck drivers and delivery drivers. Current Circumstances Prior Lake City Code currently only allows portable toilets to be used to provide temporary bathroom facilities for special events, seasonal bathroom facilities on public and private parks and open recreational spaces, or as part of construction projects as permitted by the Prior Lake City Code. City Code does not allow portable toilets to be used as a secondary facility on existing developed lots. City staff has been informed that some businesses do not allow truck drivers to utilize their indoor facilities and some businesses conduct shipments and receive deliveries after regular office hours. Proposed Amendments Staff has proposed the attached amendments for city council consideration which, if approved, would allow businesses in the C-3, Business Park and I-1, General Industrial Districts who regularly ship or receive deliveries outside of regular office hours to provide secondary bathroom facilities for businesses on existing developed lots provided the facilities meet the required structure setback for the zoning district and are entirely screened from view from any adjacent property with a solid wall that is constructed of the same primary material as the principal building. FINANCIAL IMPACT: No financial impact is anticipated as a result of this action. ALTERNATIVES: 1. Motion and second as part of the Consent Agenda to approve an Ordinance amending Chapter 5, Article VI of Prior Lake City Code Related to portable toilets 2. PORTABLE TOILETS The City Council of the City of Prior Lake, Minnesota, ordains: Section 1. City Code Article VI., Section 5-170 is hereby amended as follows: Sec. 5-170. Allowable use of portable toilets. Portable toilets may only be used to provide temporary bathroom facilities for special events, seasonal bathroom facilities on public and private parks and open recreational spaces, or as part of construction projects, or to provide secondary bathroom facilities for businesses on existing developed lots in the C-3, Business Park and I-1, General Industrial Districts who regularly ship or receive deliveries outside of regular office hours. In no other case shall portable toilets be used as permanent sanitary facilities for residential or nonresidential uses or as secondary sanitary facilities on existing developed lots. Section 2. City Code Article VI., Section 5-171 (d) is hereby amended as follows: (d) Screening. Any portable toilet located within parks and open space as defined herein and located less than 50 feet from a dwelling unit must be screened by a solid fence at least six feet in height. Any portable toilet located within the C-3, Business Park or I-1, General Industrial District shall meet the required structure setback for the zoning district and shall be entirely screened from view from any adjacent property with a solid wall that is constructed of the same primary material as the principal building. Section 3. Summary approved. The City Council hereby determines that the text of the summary marked "Official Summary of Ordinance No. 126-___” a copy of which is attached hereto clearly informs the public of the intent and effect of the ordinance. The City Council further determines that publication of the title and such summary will clearly inform the public of the intent and effect of the ordinance. Section 4. Filing. A copy of the ordinance shall be filed in the office of the City Clerk. This copy shall be available for inspection by any person during regular office hours. Section 5. Publication. The City Clerk shall publish the title of this ordinance and the official summary in conformance with State Statute and City Code requirements with notice that a printed copy of the ordinance is available for inspection by any person during regular office hours at the Office of the City Clerk. Section 6. Effective date. This ordinance shall take effect upon its passage and the publication of its title and the official summary. PORTABLE TOILETS The following is the official summary of Ordinance No. 126-___ passed by the City Council of Prior Lake on March 10, 2026. Prior Lake City Code Sec. 5-170 and Sec. 5-171 (d) were amended to allow for portable toilets as secondary bathroom facilities for businesses on existing developed lots in the C-3, Business Park and I-1, General Industrial Districts who regularly ship or receive deliveries outside of regular office hours, provided proper screening is provided. A printed copy of the ordinance is available for inspection by any person during regular office hours in the Office of the City Clerk at Prior Lake City Hall, 4646 Dakota Street SE, Prior Lake, MN 55372.
