BACKGROUND: On September 10, 2024, the City Council approved a new Orderly Annexation Agreement with Spring Lake Township. The 2024 Orderly Annexation Agreement removed a large number of residential parcels located in the Shore Trail and Vergus Avenue neighborhoods south of Spring Lake from the annexation area, including 18 parcels which at that time were owned by the City of Prior Lake. The City of Prior Lake obtained ownership of these 18 parcels within Spring Lake Township in 2010 via Conveyance of Forfeited Lands. The parcels were forfeited to the State of Minnesota for the nonpayment of taxes. Pursuant to Minnesota Statutes, Section 282.01, Subdivision 1, the City of Prior Lake applied to the Commissioner of Revenue for the conveyance of lands to be used for a public park purpose. As part of the 2024 Orderly Annexation Agreement, and with these parcels no longer eligible for annexation, the city council agreed to transfer ownership of these 18 parcels to Spring Lake Township for the Township to continue to operate and maintain the public parks.  South Shore Park. Located at 2968 South Shore Drive, Prior Lake, MN 55372 (PID 119090270).  Raymond Park. No Address. Located on the South Shore of Spring Lake consisting of thirteen (13) Parcels (PIDs 110110140, 110110120, 110110110, 110110100, 110110090, 110110080, 110110070, 110110060, 110110050, 110110040, 110110030, 110110020, and 110110010).  Raymond Avenue Natural Area. No Address. Located on the South Shore of Spring Lake consisting of two (2) Parcels (PIDs 110110190 and 110110200).  Stormwater Pond Parcel. 2255 Raymond Avenue, Jordan, MN 55352 (PID 110110220).  Natural Area located south of Raymond Avenue. No Address. (PID 110110240). On March 11, 2025, the City of Prior Lake approved a resolution authorizing the disposal of these 18 parcels and authorized the Mayor and City Manager to execute a Reconveyance of Forfeited Lands to the State of Minnesota. The subject parcels were reconveyed to the State of Minnesota and ultimately conveyed to Spring Lake Township for a public park purpose. City of Prior Lake | 4646 Dakota Street SE | Prior Lake MN 55372 Item 5P Page | 2 Conclusion The City of Prior Lake has public sanitary sewer and water utilities adjacent to or under these 18 parcels which required an easement document to ensure the city would have the ability to maintain and replace these utilities. Attached is a Grant of Permanent Easement for Public Drainage and Utility Purposes which was drafted by the Prior Lake City Attorney’s office and reviewed by Spring Lake Township staff. The easement document provides a standard 10 ft. drainage and utility easement along the public right-of-way for all parcels and a larger easement along Raymond Avenue to provide access to a city lift station and larger easement over South Shore Park to encompass the areas around existing sanitary sewer and water utilities. The Township Board approved the easement document during their February 12, 2026 town board meeting. FINANCIAL IMPACT: Minimal cost to record the easement document. ALTERNATIVES: 1. Motion and second, as part of the consent agenda, approving a resolution accepting permanent easements for drainage and utility purposes from Spring Lake Township and directing the City Manager to record the document. 2. Permanent Drainage and Utility Easement 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 26-____ RESOLUTION ACCEPTING PERMANENT EASEMENTS FOR DRAINAGE AND UTILITY PURPOSES FROM SPRING LAKE TOWNSHIP Motion By: Second By: WHEREAS, on September 10, 2024, the City of Prior Lake and Spring Lake Township entered into a Joint Resolution Providing for the Orderly Annexation of Certain Areas within Spring Lake Township to the City of Prior Lake Pursuant to Minnesota Statutes, 414.0325 (“OAA”); and WHEREAS, the OAA states the City of Prior Lake will work with Spring Lake Township to transfer ownership of the following parcels from the City to the Township:  South Shore Park. Located at 2968 South Shore Drive, Prior Lake, MN 55372 (PID 119090270)  Raymond Park. No Address. (PID 110110240) hereinafter the (“Subject Property”); and WHEREAS, on March 11, 2025, the Prior Lake City Council approved Resolution 25-035 approving the disposal of the Subject Property and authorized the Mayor and City Manager to execute a Reconveyance of Forfeited Lands to the State of Minnesota by a Governmental Subdivision under Minnesota Statutes, Section 282.01, Subdivision 1d and all other documents necessary to convey the Subject Property in accordance with the terms of Resolution 25-035; and WHEREAS, the City of Prior Lake has public sanitary sewer and water utilities adjacent to or under the Subject Property which require drainage and utility easements to ensure the city has the ability to maintian and replace these utilities as necessary; and WHEREAS, on February 12, 2026, the Spring Lake Township Board approved a Grant of Permanent Easement for Public Drainage and Utility Purposes over the Subject Property; and WHEREAS, on March 10, 2026, the Prior Lake City Council reviewed and accepted the Grant of Permanent Easement for Public Drainage and Utility Purposes over the Subject Property. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City of Prior Lake accepts the Grant of Permanent Easement for Public Drainage and Utility Purposes over the Subject Property as executed by the Spring Lake Township Board. 3. The City Manager is hereby directed to record the Grant of Permanent Easement for Public Drainage and Utility Purposes in the office of the Scott County Recorder.
