BACKGROUND: On December 9, 2025 the City Council approved a final Planned Unit Development (PUD) plan, Development Agreement and Final Plat for the Residences at Crest Woods. The Final Plat consists of one developable lot for an existing residence (Lot 1, Block 1, Residences of Crest Woods), Right-of-Way for 138th Street and Outlots that will be reserved for future residential development (Outlot A and B). The subject property is located in the northeast corner of the CSAH 42 and CSAH 17 intersection (future 138th Street NE intersection). (PID is 259240025 and 259240023). Current Circumstances Following City Council approval of the Final Plat and Development Agreement, the developer communicated to the City concerns with some of the Development Agreement language, primarily related to financial security and warranty provisions. The developer’s financial institution raised concerns regarding the Development Agreement language and requested amendments. The developer is requesting additional time to work with the City and their financial institution to resolve outstanding issues. Final Plat Extension Prior Lake City Code Subsection 9.33 (Recording Final Plat And Development Agreement) states, if the final plat and development agreement are approved by the City Council, the subdivider shall record both documents with the County Recorder or Registrar within ninety (90) days after said approval. The final plat shall be considered void if not recorded within the ninety (90) days unless a request for a time extension is submitted in writing prior to the expiration of the ninety (90) day period and approved by the City Council. The original deadline for recording the Final Plat and Development Agreement is March 9, 2026. The applicant applied for the extension prior to the deadline. The developer is requesting a ninety (90) day extension to record the Final Plat and Development Agreement to June 7, 2026. CONCLUSION: City staff recommends approval of the recording extension to allow time for the developer, city staff and their financing institution to discuss potential amendments to the development agreement. Any proposed revisions to the development agreement would be brought back for city council consideration at a later date. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA AS FOLLOWS: 1. The final plat and all pertinent documents must be filed with Scott County by June 7, 2026. Failure to record the documents by June 7, 2026 will render the final plat null and void. Passed and adopted by the Prior Lake City Council this 10th day of March, 2026.
