BACKGROUND: On December 9, 2025 the City Council approved a Planned Unit Development (PUD), Development Agreement and Final Plat for Residences at Crest Woods. The Final Plat consists of one developable th lot for an existing residence (Lot 1, Block 1, Residences of Crest Woods), right-of-way for 138 Street and Outlots that will be reserved for future residential development (Outlot A and B). The subject th property is located in the northeast corner of the CSAH 42 and CSAH 17 intersection (future 138 Street NE intersection). (PID is 259240025 and 259240023). The original deadline for recording the Final Plat and Development Agreement was March 9, 2026. The applicant applied for and received a 90-day extension to the recording deadline on March 10, 2026. The current recording deadline is June 7, 2026. The developer is requesting a second extension prior to the deadline. The developer is requesting a ninety (90) day extension to record the Final Plat and Development Agreement to September 7, 2026. Current Circumstances The developer has requested a second 90-day extension to the recording deadline to work with their financial institution and city staff to resolve outstanding issues. Prior Lake City Code Subsection 9.33 (Recording Final Plat And Development Agreement) states, if the final plat and development agreement are approved by the City Council, the subdivider shall record both documents with the County Recorder or Registrar within ninety (90) days after said approval. The final plat shall be considered void if not recorded within the ninety (90) days provided for herein unless a request for a time extension is submitted in writing prior to the expiration of the ninety (90) day period and approved by the City Council. FINANCIAL IMPACT: No financial impact is anticipated as a result of this action. ALTERNATIVES: 1. Motion and second, as part of the consent agenda, approving a resolution for the extension to the final plat and development agreement recording deadline for Residences at Crest Woods. 2. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA AS FOLLOWS: 1. The final plat and all pertinent documents must be filed with Scott County by September 7, 2026. Failure to record the documents by September 7, 2026 will render the final plat null and void. Passed and adopted by the Prior Lake City Council this 9th day of June, 2026.
