Consider approval of Registered Land Survey for Margaret Conroy

INTRODUCTION:
Ms. Margaret A. Conroy, 6320 Conroy Street, Prior Lake, has
petitioned for approval of a Registered Land Survey in Scott
County, Minnesota. The Adminstrative Plat application has been
approved at a staff level after the appropriate notification time had
expired with no objections. At this time, the applicant is requesting
the City to sign the Registered Land Survey, so that the appropriate
docwnents may be filed with Scott County.
BACKGROUND:
The Conroy sisters, Margaret and Eilee~ are the owners of the
parcels being shown on the Registered Land Survey. Originally,
these parcels were legally described as Outlot A, Lot 23, & Lot 24,
Conroy's Bay, Scott County, Minnesota. After the Registered Land
Survey is signed by the City and filed with Scott County, the new
legal descriptions will be as follows: Tract A, B, & C of Registered
Land Survey (#). This nwnber will be detennined after filing with
Scott County.
DISCUSSION:
The attached survey shows the Registered Land Survey and the
proposed new lot lines. After staff and agency review, only two
major issues arose. First, the DNR wanted appropriate utility and
drainage easements shown. Because this is an R.L.S., easements
cannot be shown on the plat. The legal descriptions of the desired
easements will be listed in an easement docwnent on file with the
City. Exhibit A shows the R.LS. with the proposed easements to
be docwnented. These easements are docwnented by legal
description in Exhibit B.
Second, the new proposed Tract C has access to sewer and water,
but no stub has been extended to the parcel. When Tract C applies
for a building pennit, the total cost of hooking up to City sewer
and water will be borne by the owner of the parcel. In additio~ the
owner will be required to pay a $200 tapping fee by City
personnel.
Upon receiving verification from the Scott County Auditors Office
of the approved property division by the City of Prior Lake, no
addtional special assessments will be redistributed against the
property.

Finally, the Adminstrative Land Division was approved on a staff
level on May 26, 1993 after the 10 day objection period had
expired. Agencies and departments that did comment had their
issues resolved at that time. A copy of the approval letter which
was sent the same day of approval is shown as Exhibit C.
RECOMl\fENDATION: To approve the Registered Land Survey (#) for Margaret Conroy,
6320 Conroy Street, Prior Lake, MN.
ACTION REQUIRED: The Adminstrative Plat was approved, thus the Registered Land
Survey needs to be signed by the City to facilitate filing with the
Scott County Auditol'S Office.

Dear Ms. Conroy,
This letter is to inform you that your application for Administrative Land Division as per
attached survey has been approved by the City of Prior Lake.
Upon receiving verification from the Scott County Auditors Office of the approved property
division by the Oty of Prior Lake, the remaining balance of special assessments for utility
improvements will be redistributed against the property on a unit basis, in the following manner.

After reviewing the proposal with the City Engineering Department, two additional issues were
addressed. First, Tract C has access to sewer and water, but no stub has been extended to the
parcel. When Tract C applies for a building permit, the total cost of hooking up to City sewer and
water will be borne by the owner of the parcel. In addition, the owner will be required to pay a
$200 tapping fee for watennain tapping by City personneL Second, all drainage and utility
easements must be dedicated adjacent to the boundaries of this plat
In order to implement this administrative land division, it is your responsibility to fIle all
pertinent documents with Scott County Auditors Office within sixty (60) days of approval. The
City will require that the attached CITY COPY materials be returned to the City with the newly
assigned PIO's indicated on each parcel, as evidence that the administrative land division has
been filed.
