HomeMy WebLinkAbout114-08 Bluffs of Shady Beach final PUD 4646 Dakota Street SE Prior Lake, MN 55372 CITY OF PRIOR LAKE ORDINANCE NO. 114-08 AN ORDINANCE AMENDING SECTION 1101.700 OF PRIOR LAKE CITY CODE AND THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE Motion By: MCGUIRE Second By: SOUKUP WHEREAS: Copper Creek Development (the “Developer”) has submitted an application for a Planned Unit Development (PUD) to be known as the Bluffs of Shady Beach; and WHEREAS: The Prior Lake Planning Commission conducted a public hearing to consider the proposed Final PUD Plan on November 18, 2013; and WHEREAS: Notice of the public hearing on said PUD has been duly published in accordance with the applicable Prior Lake Ordinances; and WHEREAS: The Planning Commission proceeded to hear all persons interested in this issue and persons interested were afforded the opportunity to present their views and objections related to the PUD; and WHEREAS: The Prior Lake City Council considered the proposed Final PUD Plan for the Bluffs of Shady Beach on April 14, 2014; and WHEREAS: The City Council finds that the PUD is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance. The City Council of the City of Prior Lake does hereby ordain: 1.The above recitals are herein fully incorporated herein as set forth above. 2.The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1101.700, is hereby amended to designate the following legally described property as a Planned Unit Development for the Bluffs of Shady Beach. LEGAL DESCRIPTION: PID: 25-925-012-0 That part of Government Lot 6, Section 25, Township 115, Range 22, Scott County, Minnesota described as follows: Commencing at a point where the North line of said Government Lot 6 intersects the centerline of Meadow Lane of the plat of Shady Beach; thence South 00 degrees 38 feet West along said centerline 32.2 feet; thence South 85 degrees 18 feet West a distance of 344.5 feet ; thence South 34 degrees, 51 feet east a distance of 247.71 feet to the actual point of beginning; thence South 71 degrees 06’ West a distance of 278.98 feet; thence South 42 degrees 54 feet West a distance of 620.96 feet thence South 20 degrees 40 feet West a distance of 275.9 feet to a point on the extension Northwesterly of the Southerly line of Lot 9, Shady Beach Addition, distance 400.0 feet from the Southwesterly corner of said Lot 9; thence Southeasterly along said extended line 350.00 feet to the Northwesterly line of North Shore Drive of the plat of Shady Beach; thence Northeasterly along said Northwesterly line 50.0 feet; thence deflecting to the left 90 degrees 00 feet distant 175.00 feet; thence deflecting to the right 90 degrees 00 feet distant 190.49 feet; thence deflecting to the right 20 degrees 24 distant feet; thence deflecting to the right 28 degrees 12 feet distant 201.44 feet to the Westerly line of Meadow Lane; thence North 11 degrees 22 feet West Phone 952.447.9800 / Fax 952.447.4245 / www.cityofpriorlake.com along said Westerly line 171.92 feet; thence North 34 degrees 38 feet East along said Westerly line 19.96; thence North 34 degrees 51 feet West distant 10.1 feet; to the point of beginning. AND All that part of Government Lot 6, Sec. 25, Twp. 115 North, Range 22 West, described as follows: Beginning at a point where the Southerly line of Lot 8, Shady Beach Addition extended Northwesterly intersects the Northwesterly line of North Shore Drive; thence Southwesterly along said Northwesterly line 50.0 feet; thence deflecting to the right 90 degrees 00 feet distant 190.49 feet; thence deflecting to the right 20 degrees 24 feet distant 545.51 feet; thence deflecting to the right 28 degrees 21 feet distant 200 feet more or less to the Westerly line of Meadow Land; thence Southeasterly along said Westerly line to its intersection with the Northerly line of North Shore Drive; thence Southwesterly along said Northerly line to the point of beginning. Containing 3.56 acres. All in Scott County, Minnesota. ALSO DESCRIBED AS: That part of Government Lot 6, Section 25, Township 115, Range 22, Scott County, Minnesota which lies southeasterly of NDND SAND POINTE and SAND POINTE 2 ADDITION, northeasterly of GREEN’S FIRST ADDITION and SAND POINTE 2 ADDITION, northeasterly of SHADY BEACH and westerly of Meadow Lane as platted in SHADY BEACH, all in Scott County, Minnesota. 3.The Bluffs of Shady Beach Planned Unit Development (PUD) includes the following elements: a.The PUD is a low density residential land use development consisting of 21 single family residential lots and 3 outlots. b.The total number of units on the site will not exceed 21; a minimum of 7 units shall include 3-stall garages. c.The elements of the plan will be as shown on the plans stamp dated April 14, 2014, except for modifications approved as part of the Final PUD Plan. 4.It hereby adopts the following findings: a)Provides a flexible approach to development which is in harmony with the purpose and intent of the City's Comprehensive Plan and Zoning Ordinance. The proposed PUD is consistent with the Comprehensive Land Use Plan designations on the site. The PUD approach allows the development of smaller lots with reduced setbacks, which will minimize the impact on trees and the natural environment of the site. b)More creative, efficient and effective use of land, open space and public facilities through mixing of land uses. The proposed PUD plan allows for the preservation of open space by providing a plan that will preserve trees and the natural features of the site through the use of conservation easements and deeded land under public outlots. c)Support long-term economic stability by strengthening the tax base, job market and business opportunities; The new development will strengthen the City’s tax base. d)Provide opportunities for life cycle housing to all ages. The PUD plan will provide another option for housing and is appropriate for this location in order to protect the steep slope and wooded areas. e)Provide more efficient and effective use of streets, utilities, and public facilities that support high quality land use development at a lesser cost. The streets within the development will connect to existing streets that had been planned for vehicular access points. In addition two infiltration basins shall be installed which will treat storm water flowing from offsite areas and additional storm water volume capacity shall be accommodated in infiltration basin #2 for future offsite storm water needs in the surrounding area. f)Enhanced incorporation of recreational, public and open space components in the development which may be made more useable and be more suitably located than would otherwise be provided under conventional development procedures. The PUD district also encourages the developer to convey property to the public, over and above required dedications, by allowing a portion of the density to be transferred to other parts of the site. The PUD deeds areas for public storm water needs which allows for construction of a public storm water basins that improve existing drainage patterns from offsite storm water flows and provides volume capacity for future public storm water needs. g)Preserves and enhances desirable site characteristics and open space, and protection of sensitive environmental features including, but not limited to, steep slopes, wetlands, and trees. Where applicable, the PUD should also encourage historic preservation, re-use and redevelopment of existing buildings. The proposed development preserves wooded areas through the use of conservation easements and deeded public outlot areas. 5.Final plans for the Bluffs of Shady Beach Planned Unit Development are subject to the following conditions: a)The Developer must obtain the required permits from any other state or local agency prior to any work on the site. b)The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the City Engineering/Public Works Departments dated April 8, 2014. c)The Developer shall submit a security in an amount equal to 125% of the cost of the required replacement trees. This ordinance shall become effective from and after its passage and publication. Passed by the City Council of the City of Prior Lake this 14th day of April, 2014.
