HomeMy WebLinkAbout114-15 Crystal Bay PUD Ordinance Amendment 4646 Dakota Street SE Prior Lake, MN 55372 CITY OF PRIOR LAKE ORDINANCE 114-15 AN ORDINANCE TO AMEND THE PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN FOR CRYSTAL BAY TOWNHOMES Motion By: MORTON Second By: SOUKUP WHEREAS, DBOW Properties and Crest Exteriors LLC (the “Developer”) submitted an application for a major amendment to the Planned Unit Development Final Plan for Crystal Bay Townhomes; and WHEREAS, The Prior Lake Planning Commission held a public hearing to consider the proposed amendment to the Final PUD Plan on August 4, 2014 and found it to be consistent with the purpose of a PUD and in substantial compliance with the approved preliminary plan; and WHEREAS: Notice of the public hearing on said PUD has been duly published in accordance with the applicable Prior Lake Ordinances; and WHEREAS: The Planning Commission proceeded to hear all persons interested in this issue and persons interested were afforded the opportunity to present their views and objections related to the PUD; and WHEREAS, The Prior Lake City Council considered the proposed Final PUD Plan on September 8, 2014; and WHEREAS, The City Council finds the amended Final PUD Plan to be in substantial compliance with the approved Preliminary PUD Plan, and is further compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance. The City Council of the City of Prior Lake does hereby ordain: 1.The recitals are fully incorporated herein as set forth above. 2.The amended Crystal Bay Townhomes Planned Unit Development Final Plan is hereby amended subject to the following conditions: a.The Developer must obtain the required permits from any other state or local agency prior to any work on the site. b.The Developer shall comply with a request by CenterPoint Energy to provide suitable easement rights for location of a nearby gas main. c.Heating and cooling units may encroach into the required side yard setbacks and building separation.
