HomeMy WebLinkAbout95-06 Building PermitsCITY OF PRIOR LAKE ORDINANCE NO. 95-06 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, OF THE PRIOR LAKE CITY CODE. The City Council of the City of Prior Lake does hereby ordain: I. Section 4-7-1(A) is hereby amended to read as follows: (A) Building Permit: The application for a building permit, in addition to other information required, shall include exterior elevations of the proposed structure which will adequately and accurately indicate the height, size, design and the appearance of all elevations of the proposed building and description of the construction and materials proposed to be used therein. The exterior architectural design of a structure shall not be so at variance with the character of the applicable zoning district established by the Zoning Code of the City as to cause a substantial depreciation in the property values of said neighborhood within said district or elsewhere, or adversely affect the public health, safety or general welfare. Individuals, builders or groups of builders shall not construct a house design which has identical front elevations to any home or proposed home where a building permit has been issued with the following exceptions: . Identical from elevations may be allowed on no more than twenty-five percent (25 %) of platted lots within a block. However, identical front elevations shall not be allowed on adjacent lots or in cul-de-sac turnarounds. . The provisions of this Ordinance apply to PUD developments but may be modified with the consent of the City. 3. This Ordinance applies only to single family homes. II. Section 4-7-1(C) is hereby deleted in its entirety. III. Section 4-7-5 is hereby amended to read as follows' 4-7-5' ZONING CODE: This Chapter shall be deemed supplementary to the Zoning Code, Subdivision Ordinance and the Construction Code of the City and shall be enforced in harmony and in conjunction with each. IV. Section 4-7-6 is hereby amended to read as follows: 4-7-6: APPEALS: Any person aggrieved by a decision of the Building Inspector regarding the use of certain materials or regarding questions of architectural design shall be entitled to appeal the Building Inspector's decision to the Planning Commission and, if still aggrieved, he may appeal to the City Council. This ordinance shall become effective from and after its passage and publication. Passed by the City Council of the City of Prior lake this zo~:hday of March 1995.
