Adjourn OPTION AGREEMENT KNOW ALL MEN BY THESE PRESENTS THAT, the Village o£ Prior Lake, a Municipal Corporation of the County of Scott~ State ol: Minnesota, party of the first part, for and in consideration ol: the sum Two Thousand and 00/100 ($2,000.00) Dollars, in hand paid at.or before the ensealing and delivery of these presents, to John Kop and Meda E; Kop, individually and as husband and wife, o£ Prior Lake, County of Scott, State of Minnesota, party ol: the second part, have agreed and do hereby agree to hold until the 1st. day of . l~ '' June, 1974 at 12:00 A.M., Central Standard Time being the essence and important part ol: this option, subject to the order o~ thesaid Village ol: Prior Lake or assigns, the following described property: Legal description and plat attached herewith. It is further understood it: the Village ol: Prior Lake accepts the option it must do so by notil:ylng the sellers, John Kop and Meda E. Kop, in writing by registered mail at their home address of Prior Lake, Minnesota and to consumate the sale within thirty days thereal:ter. Sellers will furnish an abstract ol: title at their expense. Buyer is to assume survey costs if any. It is further understood that any payment made for said option shall be applied to the purchase price of the property. · in the event said party ol: the first part exercises the option, said parties ol: the second part agree to sell and convey the property described herein on a Contract l:or Deed which shall be over a period ol: five years from date ol: exercise of option. Said contract will require payment ol: principal in equal installments over a five year period, the first installment shall be due on the date said option is exercised. The other four installments shall be due annually on the same date there- after. Interest shall be due and payable when principal payments are paid. It is agreed by and between the part[es that the interest rate on said Contract purchase shall be at the rate of five and three-quarters (5 3/4) percent, and in no event shall said interest rate exceed the interest rate the municipality would be paying or is paying on munlc[pal bond used to finance the project. It is £urther agreed that the total purchase price for said real estate the sum. of Two Hundred F[t:ty Thousand and 00/100 ($250,000.00) Dollar. Real estate taxes due and pay~.ble in 1974 and subsequent years and all of any spec]al assessments levied or pending shall be paid by Village of Pr[or Lake the buyer, th[s opt]on is exercised. It is further agreed and understood that the exerc]se of this opt[on shall be contingent upon the passage of a bond issue and referendum of the voters t:or sa[d project for park improvement purposes. it is further agreed and understood by and between the parties hereto that upon the transfer and conveyance of said property on contract and on warranty deed from the parties of the second part to the Village of Pr[or Lake that said conveyance will [nclude restr[ct[ons for use of the property, for park purposes for a per[od of fifty (50) years from the date of exercise of the opt[on. seals this IN WITNESS WHEREOF the parties hereto have set their hands and /~.~. .. dayof .~/~..~? , 1973.
