HomeMy WebLinkAbout99-01 CITY OF PRIOR LAKE ORDINANCE #99-01 AN ORDINANCE AMENDING TITLE 4 OF THE PRIOR LAKE CITY CODE: The City Council of the City of Prior Lake does hereby ordain: 1. Sections 4-1-1 and 4-1-2 of Title 4, Chapter 1, of the Prior Lake City Code are hereby amended in their entirety to read as follows: 4-1-1: BUILDING CODE: The Minnesota State Building Code (Code), established pursuant to Minnesota Statutes sections l6B.59 through l6B.75, and as may hereafter be amended from time to time, three (3) copies of which are on file in the office of the Prior Lake Building Inspection Department, is hereby adopted as the Building Code for the City of Prior Lake. Such Code and such future amendments are hereby incorporated in this Chapter as completely as if set out in full. Chapter 1306 Chapter 1310 Chapter 1335 Special Fire Protection Systems with Option 8 Building Security Floodprooflng Regulations, Parts 1335.0600 to 1335.1200 (D) Section 109.1 of the 1997 Uniform Building Code (UBC) is hereby adopted, as amended below: 1. Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Official has issued a certificate of occupancy therefor as provided therein. EXCEPTION: Group U Occupancies 2. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of the UBC or of other ordinances of the City of Prior Lake. Certificates presuming to give authority to violate or cancel the provisions of the UBC or other ordinances of the City of Prior Lake shall not be valid. (E) All new coustruction in the 1-2 Light Industrial Zoning District shall be exempt from the provisions of subsection 4-l-l(C)1. (F) Any person applying for a building permit which may require removal or disturbance from the natural surface of the earth or sod, soil, sand, gravel, stone or other matter, shall submit an erosion control plan as outlined in the 1989 edition of "Protecting Water Quality in Urban Areas," published by the Minnesota Pollution Control Agency, or an equivalent set of standards. No permit shall be issued until the erosion control plan is approved by the City Engineer. r:\council\ordinanc\99\99-O I.doc 2 4-1-2: APPLICATION, ADMINISTRATION AND ENFORCEMENT: (A) The application, administration and enforcement of the Code shall be in accordance with Minnesota rule part 1300.2100 and as modified by chapter 1305. The Code shall be enforced within the extraterritorial limits permitted by Minnesota Statute l6B.62, subdivision 1. (B) The Prior Lake Building Inspection Division shall administer the Building Code for the City. A Minnesota certified "Building Official" will administer the Code.
