UseandAvailabilityCharges704.102 . TheCityCouncilmay, asauthorized by statute, impose justandequitable chargesfortheuseandfor theavailability ofthe City facilities andforconnectionwiththem. Feejustificationstudies shallbepreparedto support changes inuseandavailability fee, exceptwherethefeesareestablished byMetropolitanCouncil. Annual FeeSchedule. 704.103 Usagecharges, connection charges, stormsewer, sanitary sewer andwateravailability charges, permitfeesandpenaltyfees, exceptthose imposedbyspecialassessments, shallbeset forthintheCity’sfeeschedule, adoptedannuallybytheCityCouncil. 704.200 CONNECTION ANDAVAILABILITYCHARGESDUEONDEVEOPMENT TheCitymayimposeutilityconnectionandavailability charges dueupon development. Allsuchfeesshallbeset forthintheCityfeeschedule andshall be inadditiontoanyconnectionandavailabilitychargesimposedbythe Metropolitan Council. 704.300 CONNECTION ANDAVAILABILITY CHARGES DUEWITHPERMIT ORWORK CityConnection Charges. 704.301 AllCitysanitarysewerandwater connection charges shallbepaidbeforeapermit toconnect tothepublicsanitarysewerorwater facilities will beissued, unlesspaymentisdeferred pursuanttothe City’sdeferral policy. Theamount oftheconnectionchargeshallbedetermined bythenumber of unitsthatwilloccupythe propertyasdefinedbytheMetropolitan Council andbased onthetypeof landusethatwillbeconductedontheproperty multiplied by theunit charge setforth intheCityfeeschedule. Uponanychangeinuseofthepropertythechargesshallberecalculatedandany additional chargeresultingfromthechange inuse oradditional unitsshallbepaid priortotheissuance ofbuilding orconnection permits. Metropolitan Council. 704.302 InadditiontotheCitycharges, thesanitarysewer availabilitycharge, asdetermined byMetropolitanCouncil, shallbepaidpriortothe issuance of anybuilding orconnectionpermits. WaterStorageAvailability Charge704.303 . Awaterstorage availabilitychargeshallbe determined bytheCityCouncilonanannualbasisand setforthintheCityfee schedule. Said feesshall beplacedin afundmaintained bytheCitytoaccumulate fundsfortheconstruction ofwaterstorage facilities. 704.400 WATER ANDSANITARY SEWERCHARGESANDRATES Minimum Charges. 704.401 Minimum charges fortheavailability ofpublic water and/or sanitarysewershallbeimposed onproperties wherewaterand/orsanitarysewer facilities areavailable, regardless of thevolumeofwaterused orsewage discharged orwhether thepropertyisconnectedto thefacilities. Forpurposes ofthisSection, the definition ofavailableinSubsection705.200 shallapply. Forpropertieswherewater and/orsanitarysewerbecomeavailable, theminimum chargeswillbeimposed beginningonthedate ofconnectionoroneyearfromthedatesuchfacilities become available, whicheveroccurs sooner. Theminimum charges shallbesetforth inthe Cityfeeschedule andshallbeimposedperbillingperiodperaccount. Rates. 704.402 Ratesandchargesfor thecollectionandtreatmentofsewage andforthe treatment anddistribution ofwater shallbeestablishedbytheCouncilandset forth intheCityfeeschedule. Therates maynotexceedanamount reasonably calculatedtocoverthe costoftheproper maintenanceandoperation ofthe Page2of14 facilities, including thecostofamortizationofanyindebtednessandareservefor capitalreplacement. UsersNotConnectedtoPublic Water704.403 . Ratesand chargesforthecollectionand treatmentofsewage for thosepropertiesnotconnected topublicwater shallbeset intheCityfeeschedule. Sanitary SewerRate Cap704.404 . Thechargefor sanitarysewerusagefor each billingcycle forbillsissuedinJune, August, October andDecember (actual usageMarch21 throughNovember 20) shall notexceedonehundred andfiftypercent (150%) ofthe averagecharge forsanitary sewerusageforthebillsissuedinFebruary andApril actualusage November21throughMarch 20). Thepurpose forthissanitarysewer cap isto provide considerationforlawnand gardensprinklingandotherrelated outsidewaterusage, whichdoesnotflowintothesanitarysewersystem. Metropolitan Council. 704.405 Inaddition tothe Citycharges, thesanitaryseweruse rates, asdetermined by Metropolitan Council, shallbeimposedperbillingcycle. Bulk WaterRate704.406 . Charges forbulkwatershallbesetforthintheCityfeeschedule. 704.500 STORM SEWERCHARGES ANDRATES Stormwater Management FeeCalculation. 704.501 TheStormwater Management Fee isbasedonresidential equivalencyfactorsfor various landuses. Theresidential equivalency factoristheratioofrunoffvolume, ininches, foraparticularlanduse, to therunoffvolume, in inches, foraone-third acreresidential lot, assuming afourandtwo-tenths inches (4.2”) 10-yearfrequency rainfall andUSDAHydrologic SoilGroup B. Thefactorsforvarious landusesare asfollows: Classification LandUse REFactor 1 Single-FamilyResidential 1.00 2 Multiple-dwellingunits (residential) 1.65 3 Business / Commercial 2.07 4 Industrial 1.82 5 Institutional (schools, churchesandgovt. 1.38 buildings) Special Circumstances. 704.502 1) Agricultural andconservationzonedareas whichhavearesidential or commercialbuildingontheproperty willbeconsidered asinglefamily residential classification andbecharged thesinglefamilyresidential parcelrate. 2) Property thathasbeenplattedorsubdivided andhas astructureonitwillbe charged thesinglefamilyresidential parcelrate. Page3of14 3) Planned unitdevelopmentzoningandgovernment agency parcels other than theCitywillbe charged attheratedeemedmostappropriateforeachindividual parcel. 704.503 TheStormwaterManagement Feeshallbedetermined bythefollowingsteps: 1) Thestormwater ratewillbeperiodically determined andsetby theCityCouncil. 2) TheStormwater ManagementFee forallsinglefamilyresidentialparcelsshall betheproductof stormwater rate, theREfactor, andone-thirdofanacre. 3) TheStormwater ManagementFeeforallindividual parcelsother thansingle family residential parcels shallbedefined astheproduct ofthe stormwaterrate, the RE, andthetotalacreageof theparcel. 4) Aminimum ofone-thirdacreshallbecomputedfor commercial sitelocations withinagricultural andconservationlandareas. CREDITS. 704.504 TheCityCouncil, initsdiscretion, may adoptpoliciesforadjustment of thestormwater managementfee. Information tojustify afeeadjustmentmust be suppliedbythepropertyowner. EXEMPTIONS. 704.505 Thefollowing landusesare exempt fromthestormwater management fee: Publicrightofway. Lakes. Wetland (witheasements dedicated totheCity). Municipal ownedproperty. Open space (cemeteries, golfcourses). Property whichhasbeenplattedorsubdivided butdoesnothaveastructureon it. Propertywhichhasnotbeenplattedorsubdividedandwhichdoes nothavea structure onit, suchasagricultural andconservation zoned land. 704.600 OTHERCHARGES Capital FacilityCharge704.601 . Acapital facilitychargemaybe imposedforthepurposeof payingfortheoperation, construction, reconstruction, maintenance, repair, enlargement, improvement, use andadministrative expensesofthe City’scapital facilities. Industrial UserExtraStrengthCharges. 704.602Each user receiving waste treatment serviceswithinorserved bytheCityforindustrialstrength wasteshallbecharged anindustrial strength chargeinorder topaythechargesallocatedtotheCitybythe MetropolitanCouncil. Thestrength charge shalleither bebilleddirectlybythe MetropolitanCounciltotheuser, orshallbebilledbytheMetropolitanCouncilto theCityandbytheCitytotheuser. WaterMeter Charges704.603 . Priortoissuanceofawater meterfor initialinstallationor for replacementorrepairduetodamage causedbytheowner, occupant ortenant, Page4of14 awater metercharge, andif appropriateapressure reducer charge, shallbe imposed intheamount setforthintheCityfeeschedule. Meter Testing704.604 . Charges fortesting ofwatermetersshall besetforthintheCityfee schedule. WaterShutOffandDoor Hanger704.605 . Chargesforshuttingoffor restoring water servicesandfordoor hangersshallbesetforthin theCityfeeschedule. Metropolitan Council. 704.606 InadditiontotheCitycharges, feeandcharges as determined by Metropolitan Council shallbeimposed. 704.700 ACCOUNTSRESPONSIBILITY OFOWNER Allcharges, rates, finesandpenaltiesrelatingtoCity utilitiesare theresponsibility ofthepropertyownerregardless ofwhetherthepropertyissubjecttoalease or occupied byapersonother than theowner. 704.800 BILLS FORSERVICE BillingandDelinquency704.801: Utilities, includingwater, sanitary sewer, stormwater, and any otherutilityservices billablebytheCityshallbebilled intheformandat intervals determined bytheCity. Allchargesshall bedelinquent iftheyareunpaidbythebill duedate. Eachbillnotpaidbytheduedate shallbecharged alatepaymentpenalty of 1.5% permonth untilpaidor untilcertifiedtotaxes. Utilitycharges arealien against theproperty, andthepropertyownerremainsresponsible, at alltimes, forthe paymentofthechargesina timely manner. FaultyMeters: 704.802If ameter failsto registeroraccuratelymeasurethe waterusage, thewater andsanitarysewerchargesshallbepaidforattheestablished rate based uponpastaveragebillingsasdetermined bytheCity. 704.900 CERTIFICATION Allchargesandpaymentsprovided forhereinaretheprimaryresponsibility oftheowner ofthepremises servedandallsuch chargesandpaymentsshallbealienuponthe property. Delinquent charges, including latepayment penalties, shallbecertified to the County Auditor tobepaidwithproperty taxes. TheFinance Director shalldetermine the certificationamounts foreach property, includingtheapplicable interestrate asset forthintheSpecial AssessmentPolicy, and thedelinquent assessment administrative chargesetbytheCityfeeschedule. Theowneroftheproperty shall begivenwritten notice stating theamountdue, thedatebywhichpaymentshallbemadetoavoid certification, thetime, date, andlocation ofthehearing wheretheCityCouncilwill consider certification, andtheinterestrateonthecertification. Theamounts shall be certifiedtotheCounty Auditorforcollection, inaccordancewithM.S. § 444.075, as it maybeamended fromtimetotime, alongwithpropertytaxes. 704.1000 PENALTY Page5of14 704.1001 Civilpenalties forviolations ofSections 704, 705and706shallbe setforth inthe Cityfeeschedule. AnyviolationofSections704, 705, or706whichdoesnothave afee associatedwithit shallbecharged totheviolator atthe costincurredbythe Cityinrelationto theviolation. 704.1002 Inadditiontothefeessetforthin subsection 705.1001, anypersonviolating any provision ofthisSectionshall, uponconvictionthereof, beguilty ofamisdemeanor and bepunishable inaccordancewiththepenalties establishedbyMinnesotaStatute Section 609.02asmaybeamended. Aseparate offense shallbedeemedcommitted foreachdaytheviolationshallcontinue. Anypersonviolatinganyoftheprovisions of thisSectionshallbecomeliable totheCityforany expense, lossordamageincurred bytheCitybyreasonofsuchviolation. Section2. CityCodeSection705isherebydeletedinitsentiretyandreplaced withthefollowing: Section705 WATER ANDSANITARY SEWERFACILITIES SUBSECTIONS 705.100 GENERAL 705.200 CONNECTION TOCITYUTILITYFACILITIES 705.300 PERMITS 705.400 RESPONSIBILITY ANDMAINTENANCE 705.500 WATER METERS 705.600 BULKWATERANDBULKWATERMETERS 705.700 WATER USERESTRICTIONS 705.800 FAILURE OFFACILITIESANDDISCONTINUANCE 705.900 WASTES PROHIBITED 705.1000 TAMPERING PROHIBITED 705.1100 RIGHTOFENTRY 705.1200 CONTRACT 705.1300 PENALTY 705.100 GENERAL Purpose. 705.101 ThepurposeofthisSection istoestablish regulationsfor the construction, management, operationandmaintenance ofwater andsanitarysewer facilities insideandoutsidethecorporatelimits oftheCity. Authority705.102 . Inaccordance withMinnesota Statutes 444.075, asmaybe amendedfromtime totime, theCitymaybuild, construct, reconstruct, repair, enlarge, improve, orinanyother manner obtainfacilities, andmaintainandoperate thefacilities insideoroutsideitscorporatelimits, andacquirebygift, purchase, lease, condemnation, orotherwiseany andalllandandeasementsrequiredforthat Page6of14 purpose. Theauthorityhereby grantedisinaddition toallother powerswith reference tothefacilitiesotherwisegranted bythelawsofthisstate. PoliciesandProcedures705.104 . TheCityManager, inconsultation withappropriateCity Departments, maydevelopandmaintainpoliciesandprocedures toimplementthe various provisions ofthisSection. Definitions705.105. . Thedefinitions inMinnesotaStatute Sections444.075applytothis Section, unlessspecifically statedotherwise. Ifthestatutedoes notprovide a definition, theplainandcustomarydefinitionofthe wordapplies. Forpurposes of thisSection, “facilities" means andincludes anyandallportionsofthe City’swater andsanitarysewersystems. 705.200 CONNECTION TOCITY UTILITYFACILITIES MandatoryConnection toPublic Facilities. 705.201 Every building, every separately ownedspace withinacommercial building, everyseparatelyowneddwelling unit withina residential building, andevery townhome unitshallhaveaseparately meteredwater connectiontothe publicwater facilities andaseparatesanitary sewerconnectiontothepublic sanitarysewerfacilities ifsuchfacilities are available, exceptasprovidedinthisSubsection705.200. Forpurposes ofthis Subsection, availablemeans that theprimarystructure ontheproperty iswithin200 feetofthefacility; provided however, thatthefacilityshallnotbeconsidered availableifthe CityPublicWorksDirector orCityEngineerdetermines thatthe connection isnot feasibleduetosystemcapacity, topography, financial considerations or uniqueengineering circumstances. Public FacilitiesUnavailable. 705.202 Theunavailability ofpublicwater and/orsanitary sewerfacilities maysupport the denial ofbuilding permitand/orcertificate of occupancy oradetermination bytheCitythatthesubdivision is premature. When making suchadeterminationtheCityshallconsiderthesizeoftheproposed development, existing publicorprivate facilities, andtheexpectedtimingofpublic facilities becomingavailable. PublicFacilities Available. 705.203 1) Connectionsshallbemadetothepublicwater andsanitarysewerfacilities withinoneyearofsuchfacilities becomingavailable, unlesstheCityPublic WorksDirector orCityEngineerdetermines thatanextensionisappropriate duetositeconditions. 2) Connectionstothepublic water andsanitarysewerfacilities maybedelayed for aperiodofthree years if theexistingsewersystemiscompliant withallcurrent State, CountyandCityregulationsasevidencedbythepropertyowner providingtotheCityproof ofcompliancefromtheCounty. Connectioncanbe furtherdelayedifthesewer system is re-certified everythree yearsfromthe originaldateofcertification. Ifthesewersystemisnotcompliant ortheproperty ownerfailsto re-certify thesystempriortotheexpirationofthethreeyear period, connectiontothepublicfacilities shallbemade immediately. Page7of14 HealthHazard. 705.204 Notwithstanding anythingelsesetforth inthisSubsection 705.200, owners, occupantsandusers shallcomplywith anyorderissuedinregardstothe publicwater facilities, the publicsanitarysewer facilities, aprivate welland/ora private sewersystembyanappropriateCity, StateorCounty officialwith jurisdiction, includingbut notlimitedto, anordertoconnect topublicfacilities immediatelyifthe private welland/orsewersystemcreatesanuisanceorhealth hazard. 705.300 PERMITS ConnectionandRepairPermits Required. 705.301 1) Nopersonmaymakeanyconnection, repair, oralteration toapublicsanitary sewerorwater facility, anypartthereof, oranyfacilityconnected toapublic sanitary sewerorwaterfacility without firstreceiving apermit fromthe City. Applications forpermitsshallbe made onforms providedbytheCity. a. Anyperson tapping intoaCity watermain, sanitarysewer orstormsewer shallobtainaRight-of-Way Permit fromtheCitypursuant toSection 701. b. Anyperson connectingtoacurbstopshallobtainasewer/water permit fromtheCity. Allapplications toconnect toacurbstopshallbemade, andallworkrelated toconnectiontoacurbstopshallbeperformed, by amasterplumberorpipelayer, whoshallbelicensedbytheState of Minnesota. c. Anyperson performingworkonawater metershallobtainapermit as requiredbySubsection 705.504below. d. Anyperson, includingpropertyowners, performingplumbingworkon private property, whichworkdoesnotinvolvetappingintoamain, connectingtoacurbstop, orworkonawater meter, shallobtaina plumbing permit fromtheCity. Work Includes butisnotlimitedtowater softenerinstallation, water heaterinstallation, water filter, general piping andfixture installation, etc. 2) Applicableconnectionandpermit feesshallbepaidpriortotheissuanceofa permit. 3) Issuance ofapermit maybeconditionedonthe City’sreviewofthesubject property. 4) Thepermit holdershallnotifytheCityuponcompletion oftheworktoallowthe Citytoinspect the work. Itisunlawful tocoverany workuntilthe Cityhas inspected andapproved thework. 5) TheCitymaydenyapermit ifthere areunpaidcharges, fees, taxes or delinquentspecialassessments ontheproperty. 6) Allworkunderapermit shallcomplywithallapplicable federal, stateand local regulationsincludingbutnotlimitedtotheState PlumbingCode andtheCity’s PublicWorks DesignManual. Private WaterandSewerSystems, CityCertificateandCounty Permit705.302 Required. Noperson mayinstallaprivate watersystemoraprivate sewersystem Page8of14 without firstobtainingconfirmation inwritingfromtheCitystatingCity facilities are notavailableandwritten approvalfromScottCounty. Theapplicantshallprovide theCitywithacopy oftheapprovalfromScottCountypriortobeginning installation. Allworkshallcomplywithallapplicablefederal, stateand local regulations. 705.400 RESPONSIBILITY ANDMAINTENANCE Service Lateral Liability705.401 1) WaterService: Exceptasotherwiseprovidedbywrittenagreementwiththe City, aftertheinitialconnectionofawaterlinetoaproperty hasbeenmade, the owner, occupant, oruserofthepropertyshall beresponsible forthe maintenance ofthe servicepipefromthebuilding tothecurbstop, excluding thecurbstop. Theowner, occupant, orusershallnotifytheCity ifacurbstop needsrepair oradjustment. TheCityshallperformallrepairsandadjustments oncurbstops, unlesstheCityPublicWorksDirector determines thatthe damage wascaused directlybythe owner, occupantoruser, ortheiragent or contractorinwhich casethe owner, occupantoruserisresponsible forthe repair. TheCityshallnotberesponsible foranydamage topersonsorproperty due tothecondition orheight ofthecurbstop. 2) CityRepairs: Uponcompletion ofworkthe Cityshallrestoretheproperty back togradeandshallrestorepublicinfrastructure. Theowner, occupantoruserof theproperty shallberesponsible fortherestorationofanyprivate improvements includingbutnotlimitedto driveways, landscaping, retainingwalls, etc. 3) Sanitary SewerService: Except asotherwise providedbywritten agreement withtheCity, aftertheinitialconnectionofasanitarysewerlinetoaproperty hasbeenmade, theowner, occupant, oruserofthepropertyshallbe responsible for thecleaning, maintenance, repairandreplacementofthe service linefrom thebuilding tothesanitarysewer main, includingthewye. 4) Locates: Itistheresponsibility oftheowner, occupantortenanttoensurethat the waterandsanitary sewerservicelateralscanbelocatedinaccordance with thePublicWorksDesignManual. Ifthe servicelateralscannotbelocatedany damage totheservicelateralsistheresponsibility oftheowner, occupantor tenant. 5) Frozen Pipes: Theowner, occupant, oruserofthe propertyshallbe responsible for therepairofallfrozenpipes exceptfor themain. TheCitymay assistwiththethawing offrozenpipespursuant tothe City’sWaterService LateralThawingPolicy. Notice ofService LeaksorFailures. 705.402 Anyowner, occupantoruserof apremise whoshalldiscover a leakorfailure inaservicelineshallnotifythe Citywithin twentyfour (24) hours. Anywater wastedduetofailureofapersontocomply with thisregulationmaybeestimatedbythe Cityandbecharged tothatpersonatthe currentrate. Page9of14 Private Water NotPermittedin Public Systems705.403 . Acomplete physicalseparation shallbemaintainedbetween the publicwater supplyandanyprivate water supply systemsothatitisimpossible forany waterproducedbyaprivate systemtobe introducedintothepublic system. ExcavationandRepairWorkintheRight ofWay. 705.404 Nodiggingmayoccurinthe street rightofwaywithoutfirstobtaining a Right-of-WayPermitfromtheCity pursuant to Section701.700Right-of-Way Managementandcomplying withall requirements ofsaidSection. 705.500 WATER METERS MeterReading System. 705.501 TheCityhasimplementedanAutomaticMeter Reading System (AMRS) tomeasure waterusage. Thesystemconsistsof awater meter connected tothepremisethatmeasures theamount ofwater consumedonthe premise, meter transmissionunitsalsoconnected onthe premisethatconvey the valueofwater measuredandDataCollection Unitsthatcompilethe usagedata from individual premisesforuse bytheUtilityBilling Department. WaterMeter Definition705.502. . As usedinthisSection, water metermeansthe components necessary tometerandtransmit water usagedatafromthepremiseto theCity. Thecomponents include butare notlimitedtothemeterhorn oryoke, meterbowl, register, pressurereducing valve, MeterInterface Unit (MIU) orMeter Transmitting Unit (MTU). WaterMeterRequired. 705.503 Nopersonmayusewaterconveyed throughthepublic watersystem withoutfirstinstalling awatermeterspecified bytheCity. Any unmeteredwater use shallbeestimatedbytheCityandbilled totheaccount atthe current rate. WaterMeterRegulations. 705.504 1) Watermetersshallbeinstalled onlybymasterplumbers, whoshallbelicensed bytheState ofMinnesota. Themasterplumbershall obtainthewatermeter from theCityandpaythefeeset forth intheCityfeeschedule prior toobtaining awatermeter. 2) Everywater meterconnected tothe publicwater facilities shallbeinstalledand sealed byorunder thedirection oftheCity. Noperson shallbreakthesealona watermeter except atthedirection oftheCity. 3) TheCityshallberesponsible forthe maintenance, repair and/orreplacement of water metersandthe related costs; unlesstheowner, occupantoruseris directlyresponsible forthedamage tothewater meterduetofreezing, hot water, neglect orother similar causes, inwhichcasethe owner, occupantor usershallberesponsible forthe costs. Theowner, occupantorusershallnotify theCityoftheneedforanysuchwork. 4) Whenever anysealattachedtoawater meterisfoundbroken thebrokenseal shallbeconsideredprimafacieevidencethatthesealwasbroken inviolationof thisSection. Page10of14 5) Allwatermetersconnectedto thewatersystem shallbeaccessible to the City itsemployees oragentsforinspectionandrepairuponten (10) days’ notice at anyreasonablehour ofanybusinessday. Testingof Meters705.505 . Whenever anypersonquestionstheaccuracyofameterand desiresthatthemeterbetested, theCityitsemployeeoragent shalltestthe meter. Ifthemeterisfoundtobeaccurate, thepersonwhorequested thetestshallpaya feetocover thecostofthetest, anyrelatedwork andanyadministrative costs. Such feeshallbesetbytheCityCouncilin theCityfeeschedule. 705.600 BULKWATERANDBULKWATERMETERS BulkWater. 705.601 Bulkwater may beobtainedfromtheCityuponpayment ofthe applicablefeesandcharges. BulkWaterfromHydrants. 705.602 Nopersonexcept anemployee orauthorizedagent of the Cityormember ofthePriorLakeFireDepartment mayoperateafire hydrant without apermit. Acontractor orindividual mayapplytotheCityforapermit to obtainabulkwater meter. Theapplicationshallbeona formprovidedbytheCity andbeaccompanied bythefeesetforth intheCityfeeschedule. TheCitymay issuethepermit, ifinhisorher solediscretionthe requested usewill notinterfere withornegatively affecttheCity’swatersystem. If thepermit is issued, a hydrant metershallbeissuedtothepermittee. Thepermittee shallberesponsible forany damage caused tothehydrant meteruntilitisreturnedtotheCity. Thecontractor orindividualshallberesponsible forpayingforthewater usageatthecurrentrate. 705.700 WATER USERESTRICTIONS Annual Water UseRestrictions705.701 . Thefollowing limitations shallbe imposed onthe useofthe publicwater supplytoconserve water resourcesandprovideflexibilityto meetpeakdemands: 1) An odd/evensprinkling restriction basedonstreetaddressesisineffectfrom May1toOctober 1eachyear. Residents withoddnumberedaddressesmay water onoddnumberedcalendardays; residentswithevennumbered addresses maywateronevennumberedcalendardays. 2) Homeowners' associationsand apartment complexeswitha common irrigation systemmaywateronlyeveryother day. Homeowners' associations and apartments northof160th Street maywater on oddnumbereddays and homeowners' associationsandapartments south of160thStreet maywateron even numbereddays. 3) Citywater cannotbeused forthepurposes ofirrigatingorwateringoflawns, sod, orseededareas orother non-essential outdoor usesbetweenteno'clock 10:00) A.M. andfiveo'clock (5:00) P.M. daily. Under thisexemption, theCitymay inspectthe propertytoensurecompliance. 4) Cityathleticfieldcomplexes. 5) Theuseofprivatewells for irrigation. 6) Residential pumpingfromthelake. Water Emergency705.703 . TheCityManager ordesigneemayimposeemergency regulationspertaining topublicwaterusewhenintheManager’s discretion such restrictions arenecessary toprotect thepublichealth, safety, andgeneral welfare. When determining ifthereis awater emergency theCityManager ordesigneeshall considerwhether: (i) production ofwater cannotmeetthedemand; (ii) water in storageisexpected tobedepleted withintwenty-fourhours; and (iii) thereisa serious malfunction of equipmentor facilities. 1) Therestrictions onwaterusemayinclude, butare notlimitedtoatotal prohibition ofwatering, sprinkling, orirrigationof lawn, grass, turf, orplantings. 2) Restrictions imposedduringanemergency shallcontinue ineffectuntiltheend oftheemergency and/or removedbytheCityManager orhis/herdesignee. 3) Notificationofrestrictions maybemade usinglocalmediaandanyother means availabletopublicize thewater emergency andtoinformthecitizensofthe waterrestrictions. 705.800 FAILURE OF FACILITIES AND DISCONTINUANCE Failureof Facilities. 705.801 TheCityshallnotbe heldliableatanytimeforanydeficiency orfailureinthe waterorsanitary sewerfacilities, includingbut notlimitedtosupply ofwater, watershut offsandsanitary sewer backups. Discontinuance. 705.802 1) WaterservicemaybeshutoffordiscontinuedwhenevertheCityPublicWorks Director orCityEngineerdetermines that: a) Theowneroroccupant ofthepremises servedoranypersonworkingon any connectionforthepremisesserved bypublicwaterandsanitarysewerfacilities hasviolated anyrequirement oftheCityCode relativethereto, oranyconnection therewith; b) Anychargeoranyotherfinancial obligationimposed bythis Part7onthepresent Page12of14 owneroroccupant ofthepremises servedisunpaid afterduenotice thereof; c) Thereisfraudormisrepresentation bytheowneroroccupant inconnection with anyapplicationforservice ordeliveryorcharges; d) Thereisahealthorsafetyconcern related tothewateror sanitarysewerfacilities; or e) Theowneroroccupantofthepremisesserved bytheCity’smunicipalwater service fails (a) within3daysafterwritten requestbythe Citytotheowner or occupant, toprovidea time, within7days ofthewritten request, topermit entry intothepremises bytheCity, itsemployeesor contractors, duringnormalworking hours, forthepurposeofrepairing, replacing, modifying orequipping the premises’ watermeterortheequipmentforthereadingofthemeter, or (b) fails topermit entry intothepremisesbythe City, itsemployees orcontractors to repair, replace, modifyorequipthewater meter ortheequipment forthereading ofthemeter atandduringthetimeprovided bytheowneroroccupant. 2) Waterserviceshallbe shutoff atthe stopbox. TheCityshall givetheoccupant ofthepremises writtennotice, deliveredbymail, stating thereasonfortheshut- off, therequired cure, andthatifthecureisnotcompleted beforethedaystated inthenotice, butnotless thanfivedaysafterthedateonwhichthenoticeis given, thewater tothepremiseswillbeshutoff. If water serviceisterminated bytheCityforanyreason, thewater shallnot beturnedonuntilthe Cityhas inspected andapprovedthework and/or allapplicablefees havebeenpaid. 705.803 EmergencyDiscontinuance. Whenreasonably necessary toprotectpublic health, safety, orwelfare, the publicwater supply, orprivate property, theCity PublicWorks DirectororCity Engineermaydiscontinuewaterservicetoaproperty immediately. When determiningifanemergency exists, the CityPublicWorks Director orCityEngineershallconsiderthe following: 1) If theproperty isvacant; 2) If theproperty isunsecured; 3) Ifheproperty isdeterminedtobeuninhabitableorunsuitableforoccupancy; 4) Ifother utilitiestotheproperty providingheatorlight havebeenshutoff; 5) Iftheproperty hasplumbingthatis failingor unsafe; 6) Ifwater servicetothepropertycreates orcontributestoanunsanitaryorunsafe condition foranyonewhoenterstheproperty; 7) Ifwater service tothe propertyhasthe potentialtoadverselyaffecttheCity's watersystem; or 8) Ifthe propertyowneroroccupanthasrefusedaccesstoaCityrepresentative asauthorizedbythiscode. 705.900 WASTESPROHIBITED Itisa violationofthisSectionforany persontodirect intoorallowanystormwater, surfacewater, waterfromairconditioning systems, oilorothersimilar material, includingbutnotlimited toallmaterials prohibitedbytheMetropolitanCouncil Page13of14 Environmental Services, todrainintothesanitarysewersystem. 705.1000 TAMPERINGPROHIBITED No person may install, modify, alter, bypass, tamper or in any manner interfere with the public wateror sanitary sewer facilitiesincludingbutnot limited to hydrants, water meters and related components, unless permitted bythisSection. 705.1100 RIGHT OF ENTRY The City’semployees andagentsshallhavetheright, afterobtainingasearch warrant if awarrant is demanded, to enterany lands, property, orbuildings inthe City for the purpose of inspection, maintenance and repairofitswater metersand inspection of materials, plumbing work and fixtures of all kinds used by orin connection with the water or sanitary sewer facilities. 705.1200 CONTRACT Provisions of this Sectionrelating to water and sanitarysewer facilities shall constitute portions of the contractbetween the City and all consumers ofmunicipal utility services, and every suchconsumershallbedeemed toassenttothesame. All contracts between publicutilities andconsumers ofutilityservices otherthan municipal shallbe in strict accord with the provisions of this Section. 705.1300 PENALTY Any person violating any provision of this Section shall, uponconviction thereof, be guilty of a misdemeanor and bepunishable inaccordance withthepenaltiesestablished by Minnesota Statute Section 609.02as may be amended. A separateoffense shall be deemed committed for each day the violation shall continue.
