(612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER PARKS ADVISORY COMMITTEE MINUTES September 16, 1998 The Parks Advisory Committee Special Meeting was called to order by Ron Ceminsky at 6:33 p.m. on Wednesday, September 16, 1998. Members present were Chair, Ron Ceminsky, Thea Pluhrer, Bob Rykken, Pat Heaney and Tom Reddinger. Members absent were Tom Schutz and Kathy Smith. City Council members present included Jim Petersen and the Mayor, Wes Mader. Staff members present were Paul Hokeness, Director of Parks and Recreation and Nancy McGill, Parks and Recreation Secretary. Leanne Schutz from the Prior Lake American and members of the Menden family were also present. The purpose of this Special Parks Advisory Committee Meeting was for discussion with the Menden family as to why the Menden farm was chosen for the community park athletic complex. This was a special request by Francis Menden. Ron Ceminsky welcomed everyone to the meeting and indicated how the meeting would be conducted. Steve Menden introduced himself and introduced family members present. Family members present included Steve Menden, Rose Bauer, Delores Menden, Sharon Walters, Bonnie Menden, Pritz Menden, Robert Menden, Roxann Menden, Randy Walters, Mark Menden, Kevin Menden, Barb Bueggeman and Larry Bueggeman. The Committee and Staff members introduced themselves Steven Menden asked the Committee to explain the land selection process and to provide a chronological series of events from the beginning of the process to the selection of their property. Ron Ceminsky responded by saying that the 7.8 million dollar referendum passed in 1997 which included community park land acquisition and the development of approximately 100 acres. Twenty (20) + landowners were contacted for consideration; some suitable and some unsuitable. There were only two or three parcels that were suitable for development out of all the land that was identified. A listing was provided showing the property owners that were contacted, their responses, and suitability of each for this purpose. Paul Hokeness then filled in some history. This land search was started well over a year ago with Edina Realty assisting. Originally the Menden property wasn't on the list of locations that Edina Realty had sent out letters or talked to because the county plat map looked as though the Menden property was owned by 8-10 different land owners. It was felt that it would be difficult to deal with that many land owners. At that point there were discussions with the various landowners; some not very interested, some holding out for better offers. This was a very frustrating search as it was hard to find 80-100 acres of suitable land. In order to keep development costs to a minimum but keep all sports at one complex rather than splitting them up. Parking, lights, utilities, concessions would go up considerably if the com...plex was split up. Also, another problem with the county land was that there is a road running through it and wetlands in the middle of the property. There are a lot of difficulties with developing the county park besides the fact that Hennepin Parks was not interested and told us no at that time. It was at that time, February 2, 1998, that the land planners asked who owned the property next to Spring Lake Park which was the Menden property. This was the first time that Paul spoke with Rob Menden. The appraisal was authorized and discussions continued. Bonnie Menden stated that the Bylaws of the Parks Advisory Committee states that the committee represents of the citizens of Prior Lake. She felt strongly that this has not been the situation and that the citizens of Prior Lake are in strong support of the Menden family. Pat Heaney respectfully disagreed. Sharon Walters indicated that most people in the community did not agree with the PAC. Randy Walters indicated that he voted for the referendum and that he is in favor of the parks but would not have voted "Yes" if he would have know that it meant condemnation for the Menden farm. He felt that Prior Lake is growing south and east and that property should be looked at around County Road 82. Ron Ceminsky stated that with growth of our community certain demands need to be meant. There are very few large land parcels available in Prior Lake. Bonnie Menden disagreed. Ron said he would be happy to take names of property owners that would have land available. Fritz Menden would like to know how the Parks Advisory Committee would explain to kids how the property was acquired; that it was the last piece of property available and it was condemned. He felt that other available property was overlooked. An area on the map of the comprehensive plan was circled and in question. Paul indicated that the circles on the comprehensive plan identified neighborhood park and trail areas that would be considered when those areas were ready for development. Steve Menden indicated that after some discussion with Paul Hokeness he wanted to know what type of criteria was set in selection. Have we looked at transportation, population growth, accessibility, future development and have we conducted a community survey. He asked how this selection could be justified; if only with a gut feeling that doesn't cut it. He felt that the responses on the land search report were not adequate. He wanted the committee to prove to him that their property meets all the criteria in comparison to the other landowners mentioned on the report. Ron said to keep in mind that the committee was talking to those landowners that were receptive to selling their property. It was his understanding that by agreeing to the appraisal, that the Menden's were interested in selling. Pat Menden indicated that the City kept approaching Robert Menden. PAC998.DOC Robert Menden indicated that Paul Hokeness asked him once if he would be interested in selling his property and he told him "no". Bonnie Menden asked if it is necessary step in the condemnation process to ask for an appraisal. Paul Hokeness appraisals are a necessary step in acquiring land by any method. Ron Ceminsky said that the same procedure was followed with the Kop property before condemnation was considered. Bonnie asked how many years that the Kop farm has been considered. She knew it had been for years and that they are not in the same category. The group became emotional. Bonnie stated that the family was not interested in selling their property, and reacted by asking other family members ifthey agreed with her. Fritz Menden proceeded to explain how he acquired his piece of property from his Dad. He said his Dads intention to sell 40+ acres of land in the back and he wanted to keep the front for himself. At this time a plat map of the land area was looked at. The Parks Advisory Committee should not have assumed that the land was being divided for sale to anyone outside of family members. Ron asked what Fritz's plans were when the land was subdivided. Fritz indicated that it was done to keep the property in the family. He said he had discussions with his Dad at time of the subdivision (10+ years ago) and his Dad asked ifhe would keep it in the family, and Fritz indicated that he would. Dave Menden spoke regarding the appraisal process. Sharon Walters said that she was present once when Paul came to see Rob. Rob did not want to talk to Paul but she indicated that Paul persisted until Rob did finally talk to him. Paul said that he was there to try to set up a meeting with the rest of the family members to discuss this matter and that was the only reason he was there. Rob Menden asked what we thought "No Response" meant. Paul Hokeness indicated that there was some criteria drawn up. The land planner had indicated that the Menden property was a beautiful piece of property, surrounded by lake, trees and wide open area and a good piece of land to develop. This aroused some interest, so Paul brought the information back to the P.A.C. and indicated that an appraisal would be done and perhaps assumptions were wrong because of the friendliness shown by Rob to Paul when he okayed an appraisal, and that he would try to get a family meeting together. Paul was under a lot of time constraints which was the reason for his persistence. Paul apologized for that. Many voice mail messages were left with no further response. Ron said that the committee felt this was great because the Menden property tied in perfectly with the Spring Lake Regional Park. PAC998.DOC Randy Walters asked if the Menden property was the only property that an appraisal was done on. Paul indicated that it was the only one. Paul proceeded to explain his method in talking with various landowners. He spoke to representatives from Shakopee and they were not real receptive in letting go of 80+ acres of Shakopee land to develop a Prior Lake Park. The Menden property and the Q'Loughlin property were really the only two pieces of property that really meant all of the criteria; open flat land and in Prior Lake. Someone asked about the Berens property, but Paul indicated that he was not interested. Also the terrain would be hard to develop. Dave Menden asked about the Jeffers property. Paul stated that Bob Jeffers intentions (as presented by his executor/attorney) were to preserve a portion of the property to develop an environmental learning center and Senior Citizens housing complex and to leave the rest in its natural state Ron Ceminsky asked if the family members would like to designate one family member to help locate suitable land. The Committee would be open to any suggestions. He indicated that Committee was willing to work with the Menden family. Dave Menden felt that good research was not done. He asked if the park would have to be located in Prior Lake. He asked why committee didn't investigate possibility of purchasing property in Highway 13 & County Road 282 area where he felt there was a lot of open land available that could be purchased at a reasonable price. Ron Ceminsky questioned the feelings of Prior Lake residents if property was purchased outside of Prior Lake. He felt that a consensus of citizen input would have to be taken. Sharon Walters felt that their farm area would be too dangerous to send children down to the park on their bikes. Bonnie Menden said that she felt that park would not be easily found. Randy Walters asked what could be done to change the Parks Advisory Committee and City Council minds. Ron Ceminsky once again stated that he would like to see the Menden family members would work with the committee to find necessary land. Bonnie Menden asked if each of the Parks Advisory Committee members had looked at the different parcels available on the list. The Parks Advisory Committee members stated that they had not all personally driven to each site. Steve Menden said that he knew of three possible sites and pointed those out to the committee. He indicated that the main reason we are present was "Communication vs Condemnation". Ron Ceminsky asked the Menden's what suggestions they would have for the committee. Steve Menden asked why the family wasn't verbally contacted. Ron Ceminsky responded by saying that was an action taken by the City Council and that the P.A.C. was not involved in that. Dave Menden stated that he felt that no moral or ethics were involved in the process and asked P.A.C. members how they felt if they were put in the same situation. He was amazed at the process taken. He said that referendum did not state that acquisition of park property stipulate action of condemnation. At this time the group got very emotional and Ron asked everyone to calm down. Dave Menden indicated that there probably would be a substantial cost difference between their property and property outside of Prior Lake. Ron once again stated that he wasn't sure how Prior Lake residents would feel about acquisition of land outside of Prior Lake. Randy Walters indicated he would do everything necessary to see that the Menden property stays in the Menden family. It was mentioned that voter turnout was low; however, Ron indicated that the City has no control over who comes to the poles. The percentage of voters that came is what determined the passage of the referendum; everything else was irrelevant. There was some discussion. Tom Reddinger, member of the Parks Advisory Committee and president ofP.L.A.Y. apologized for the controversy and hurt feelings that the Menden family has and that it was not the P.A.C.'s intention to "take" their farm. He felt that if the dialogue had been better perhaps things could have been resolved differently. As president of P.L.A.Y he is very much aware of the needs of athletic fields, and desperately would like to see that development take place in Prior Lake but not at the expense of the Menden's or the Kops. The P.A.C. members are all volunteers; not professional real estate people and do the best they can based on materials presented. He didn't personally visit a lot of the properties but based his decisions that the aerial photographs that showed that a lot of the land was not good for an athletic complex. The Menden property was the last piece looked at. His question to the Menden family was that, setting differences aside, is there a possibility that a portion of the property could be kept in the family and a portion would go to park development. Rob Menden answered with a "No". At this time Bob Rykken introduced himself as a P.A. C. member and resident of Prior Lake since 1991. When he moved into the area he felt that parks were needed and joined the P.A.C. to improve the situation. He stated that his mission was to see a referendum implemented. He felt bad at how the situation has developed and wished that the Menden's wanted to sell, or he wished that we could find PAC998.DOC another piece of property but he's not aware of another piece of property available that will be suitable. He feels its' important to the kids to have these facilities available. Pritz Menden said that he respected the idea to buy parks but condemnation was not a good process. Pat Heaney introduced himself as a P.A.C. member since 1989, one of the original members. He indicated that the land search has been going on for years and feels that the committee has done their homework. He said that each step of the referendum has been fighting, contradictions, exaggerations, gross misinterpretations. Land acquisition was a tough decision. Condemnation is not a good thing but after talking to other council members from other communities sometimes its' only answer. He knew that Fritz really loved his land when he spoke at the City Council meeting but asked Fritz how he would feel about selling his land in five years. He had heard from other people in the community that the issue was about money. Would this be the case in the future; would Pritz be willing to sell his land if he was offered two or three million. Pritz responded by saying No that he was not willing to sell at any price. Pat continued by saying that we still need land desperately for field expansion, and being a coach, kids will be turned away from sports because of the shortage of fields. He stated that he is very upset that "We're bad - you're good". Pat also explained that the land acquisition and search did not happen overnight. Thea Pluhrer introduced herself as a P.A.C. member and indicated that she wanted to be a member of the committee because she has a passion for park development and each member has their own special interest areas. She feels for the situation and would like to resolve it in a nicer way and would welcome any suggestions. Kevin Menden stated that other farmers are afraid of condemnation and felt that if they came forward showing some interest that they would be nailed right away. Thea Fluhrer indicated that the land acquisition question has been discussed for a long time Ron Ceminsky said that the population has grown substantially, and understands where the family is coming from based on his own personal family, but wished the family would not portray the P.A.C. members as "evil individuals". Bonnie Menden said that its been a living hell since August 17th. Dave Menden once again stated that he felt it would not be a problem to go outside of city limits for land acquisition. Ron indicated that they couldn't assume that there wouldn't be any problems with land outside of Prior Lake; he personally owns land outside of Prior Lake and transportation was a definite problem. Bob Rykken stated that he would personally like to help work with the family to locate another property and make recommendations to the City Council. PAC998.DOC Dave Menden said that he felt that Prior Lake will keep annexing and moving further south of town. Larry Bueggeman stated that if a business is set up in the City there are certain procedures that are required and he couldn't understand why the City is exempt from following these same procedures whereby residents in the area are notified. The City seems to be going in the back door. Rob Menden.asked how they could get on the City Council Agenda. Dave Menden asked why Menden family members were not notified and asked to come to a P.A.C. meeting. Ron Ceminsky said that the committee owed the family an apology but that the P.A.C. meetings are held monthly and are public meetings, and that the agendas are printed in the Prior Lake American. But he felt someone should have had some indication that the property was being looked at. Randy Walters said that the bottom line is that "the property is not for sale". Ron Ceminsky indicated that at this time the P.A.C. can't do any more without further discussion with the City Council and thanked them for coming.. Bonnie Menden would like to be allowed to get on the City Council agenda. TOM REDDINGER MADE A MOTION TO ADJOURN THE MEETING. THEA FLUHRER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. It is anticipated that the proposed facility will include four to six outdoor fields, an indoor facility, office space and dorm facilities. The estimated value of the buildings to be constructed would be in excess of $1 ,000,000. The intent of this proposal is to establish a positive partnership that will leverage both public and private funds to construct a facility that will be of great value to the community and our youth. The facility will also provide for an on-going operating business venture for me and my family. For discussion purposes, the basic tenns of our partnership might include the City acquisition of a site large enough to accomodate our basic site development package. A portion of the site would be acquired by Mr. Bunbury at a below market rate price in exchange for the construction of certain facilities. (Le. office space, dorms, site development costs) A subsequent operating agreement would then be drafted that would clarify maintenance responsibities for the fields and a shared use schedule. Where: In Prior Lake at a site to be selected by the City. When: As soon as possible. Why: To provide an ongoing business venture for me and my family. To have the opportunity to work in my community and give something back to my community. To impart excellent training ideas, proper health habits, and a sense of fun and accomplishment for youth interested in learning and participating in the sport of soccer. To create employment opportunites in the City of Prior Lake. To attract soccer enthusiasts to the Prior Lake community who will in turn purchase goods and services and enhance the overall business climate. To increase the tax base of the community.
