DOCKS: RULES & REGULATIONS
DNR RESTRICTIONS WHICH APPLY TO PRIOR LAKE
(Dock permits are the responsibility of the Scott County Sheriff's Department)
Seasonal Docks and Floatinq Structures Must:
. be removed from water on a seasonal basis (before winter freeze-up).
. have components which are removable from lake or streambed by non-mechanical means.
. not be a hazard to navigation or endanger public health and safety.
. not be placed where site is a posted fish spawning area.
. not include fuel handling or sewage facilities.
. not be used or intended to be used for human habitation, as a boathouse or as a marina.
. allow for free flow of water beneath it.
NOTE:
Temporary structures which do not extend from the shore, such as: swim rafts, slalom
courses, ski jumps or buoys of any kind, may not be placed in waters of the state
between sunset and sunrise without a permit from the county sheriff. Those structures
not left in the water overnight are still required to be placed so that they do not create a
hazard on the water body or obstruct navigation. Contact the Scott County Sheriff's

Such disputes e best settled by first discussl your concerns with your neighbor. If your

WHEN IS A PERMIT REQUIRED?
RETAINING WALLS - A permit is required for retaining walls that are 4 feet or more in
height. If so, the plans must be designed and signed by a regiS~neer.

A CITY GRADING PERMIT IS REQUIRED FOR:
. With respect to uplands, grading operation shall mean the removal or deposition or a combination of
both exceeding the greater either of five hundred (500) sauare feet of surface area or a volume of
fifty (50) cubic yards.
. With respect to lakeshore property, the movement of more than 10 cubic yards of material on
steep slopes and in the shore impact zone.

INUTES OF THE LAKE ADVISORY COMMITTEE
November 20,2001
I. CAll TO ORDER
Chair Warner called the Lake Advisory Committee (LAC) Meeting to order at 6:31 p.m.
Members present: Shirley Gengler, Lauren Huntington and Rick Warner. Members
absent: Dale Braddy and Charles Gerlach. Others present: Lani Leichty and Scott County
Sheriff, Bill Nevin.
II. CONSIDER APPROVAL OF OCTOBER 16, 2001 MEETING MINUTES
MOTION BY WARNER, SECONDED BY HUNTINGTON TO APPROVE THE OCTOBER
16,2001 MEETING MINUTES. UPON A VOTE, MOTION PASSED UNANIMOUSL Y.
III. SURFACE WATER USE MANAGEMENT
Scott County Sheriff, Bill Nevin, was present to discuss issues relating to the danger of
large wakes created by boats leaving the 4th of July fireworks show from Lakefront Park.
Gengler said that people tend to speed up excessively after passing the no-wake buoys in
an effort to see who can get to the public access to be first in line to get off the lake.
Huntington suggested placing an article in the Prior Lake American telling people to take it
easy after the fireworks and possibly having warning lights on the lake.
Warner asked Sheriff Nevin if there have been any accidents on the night of July 4th.
Sheriff Nevin said that he did not know of any. For those patrolling the lake at this event
the issue was getting their boats from the shore, where the patrol boats were parked, out
in front of the boat traffic to control those leaving the fireworks show in boats.
Gengler asked if the entire lake could be placed in a no-wake zone after the fireworks.
Leichty said that this would probably have to be approved by the DNR, along with a public
hearing held by the City Council, in order for it to be enforceable.
Sheriff Nevin said that if had three boats on the lake, this would allow them to position a
boat at existing no-wake zone areas by the marina and Reeds Island, and turn the red
lights on to warn people as they were leaving.
Huntington suggested placing signs at the public accesses stating that this was a busy
night and to use extra caution while boating. In addition, she recommended placing an
article in the Prior Lake American the week before July 4th forewarning people about the
possible dangers of boating during and after the event.

Gengler brought up the speed limit issue and thought that part of the problem is speeding
on weekday afternoons.
Huntington asked how fast boats need to go in order for people to ski barefoot.
Warner said around 35-40 mph, depending on the weight of the person.
Sheriff Nevin said that in order for a weekday speed limit to go into effect it would have to
be approved by the DNR, City Council and a public hearing held.
Gengler said that noise produced by boats is also a problem on the lake. She also
mentioned that Minnetonka has a noise ordinance for watercraft.
Sheriff Nevin said that a decibel meter would have to be used to ticket offenders. If noise
violators are noticed on the lake, people need to call the department and report it. They
will check the decibel reading if boats are loud and someone has called to complain.
Gengler asked if the Sheriff's Department could do a speed study for the LAC.
Warner said that we need to first determine what the problem is, is it speed or noise?
Sheriff Nevin said that of the 144 tickets issued on Prior Lake this year, 63 of them had a
Prior Lake address.
Huntington brought up the issue of directional traffic on the lake.
Gengler said that the LAC discussed this at the October meeting and the committee
decided not to pursue the issue.
Leichty agreed to remind the Sheriff before the next fireworks show about the need for
additional patrol boats on the lake.
IV. REVIEW EDUCATION ARTICLES
The committee reviewed and discussed two articles that were written for future
Wavelength publications.
The first article reviewed was one about rules and regulations for docks. The committee
decided that the information regarding permanent docks was not relevant to Prior Lake
and that that portion of the article could be eliminated.
The second article reviewed was about permit requirements for grading and shoreline
work. The committee agreed that the retaining wall picture should be eliminated and the
riprap placement picture modified and reduced in size. In addition, City and DNR phone
numbers should be added at the bottom of the article for public information.
The LAC thought that placing City permit requirements on the web would make it easier
for the public to access this information.
V. BYLAW AMENDMENTS
There were two suggestions made for changes to the LAC bylaws.
The first was revIsing the preamble to recognize that the Comprehensive Lake
Management Plan had been adopted by City Council to replace the original report as the
LAC's guiding plan.
The second suggestion was to change the personal attendance record of least 75% to
read: "Annual personal attendance record of at least 75% with excused absences."
Several members have not been able to meet the 75% criteria due to personal reasons,
out-of-town work travel, or other legitimate excuses. The committee agreed that the
Water Resources Coordinator should be notified ahead of time of a planned meeting
absence.

Leichty mentioned that he would prepare an annual report of the LAC's activities as per
the bylaws. He also mentioned that he would contact Chuck Gerlach to ask him if he was
still interested in serving on the committee and remind him of the 75% attendance criteria.
VII. OLD BUSINESS
Gengler mentioned that she had spent several hours researching information about
shoreline erosion due to watercraft wave action. She found an article from the Army Corp
of Engineers that was presented at a 2001 convention on this topic. She will try to bring
the article to the January LAC meeting.
VIII. NEW BUSINESS
The committee decided to discuss and review the CLMP implementation schedule and
suggest changes to the schedule as appropriate at the January 2002 meeting.
Gengler suggested that follow-up letters be sent out in January to property owners who
had received letters regarding shoreline stabilization and the importance of protecting their
property. In general, the follow-up letter would ask if the City could be of any help with
this effort.
The committee discussed canceling the December LAC meeting.

RE: Proposed LAC Bylaw Changes
Following are the proposed changes to the Lake Advisory Committee Bylaws:
1) Due to the adoption of the Comphrensive Lake Management Plan, add to
the Preamble -
The Comprehensive Lake Management Plan was adopted by City Council
in June 2000. This plan replaces the report entitled "Water Resource
Management - A Guide For Balanced Future" as the guiding document for
the LAC to follow to help in preserving and enhancing the natural resource
called Prior Lake.
