HomeMy WebLinkAbout89-06 CITY OF PRIOR LAKE ORDINANCE NO. 89-06 AN ORDINANCE AMENDING ORDINANCE NO. 87-15 AND PRIOR LAKE CITY CODE TITLE 3, CHAPTER 1. The Council of the City of Prior Lake does hereby ordain: Ordinance No. 87-15 and Title 3, Chapter 1 of Prior Lake City Code are hereby amended as follows: I. Section 3-l-5(C) is hereby amended to read as follows: (C) Off-sale intoxicating liquor licenses may be issued to exclusive liquor stores or to drugstores. No more than one off-sale intoxicating liquor license may be directly or indirectly issued to anyone person or for anyone place in the city. Off-sale licensees may provide samples of malt liquor, wine, liqueurs and cordials which the licensee currently has in stock and is offering for sale to the general public without obtaining an additional license, provided the malt liquor, wine, liqueur and cordial samples are dis~ensed at no charge and consumed on the licensed premises dur1ng the permitted hours of off-sale in a quantity less than one hundred (100) milliliters of malt liquor per variety per customer, fifty (50) milliliters of wine per variety per customer and twenty-five (25) milliliters of liqueur or cordial per variety per customer. The fee for an off-sale license shall be fixed by the City Council in an amount not to exceed the maximum allowed under state law, if so established. II. Section 3-1-9 is hereby deleted in its entirety, and the remaining sections shall be renumbered accordingly. III. Section 3-l-ll(C) is hereby amended to read as follows: (C) a person who within five years of the license application has been convicted of a willful violation of a federal or state law or any city ordinance, including this ordinance, governing the manufacture, sale, distribution or possession for sale or distribution, of an alcoholic beverage. IV. Section 3-l-ll is hereby amended by adding a new paragraph (K) to read as follows: (K) In addition, the City may refuse to renew the license of a person who within five years of the license application has been convicted of a willful violation of a federal or state law or any city ordinance, including this ordinance, governing the manufacture, sale, distribution or possession for sale or distribution, of an alcoholic beverage. V. Section 3-l-l4(B) is hereby amended to read as follows: (B) No on-sale of intoxicating liquor shall be made between 1:00 A.M. and 8:00 A.M. on the days of Monday through Saturday, after 1:00 A.M. on Sundays (except as provided in this chapter) and between 8:00 P.M. on December 24 and 8:00 A.M. on December 25. Section 3-l-l4(C) is hereby amended to read as follows: (C) No off-sale of intoxicating liquor shall be made on Sundays, before 8:00 A.M. on Monday through Saturday, after 8:00 P.M. on Monday through Thursdar and after 10:00 P.M. on Friday and Saturdar. No off-sale of 1ntoxicating liquor shall be made on Thanksg1ving Day; on Christmas Day, December 25; or after 8:00 P.M. on Christmas Eve, December 24. Off-sales of intoxicating liquor may be made until 10:00 P.M. on December 3l and July 3 unless otherwise prohibited. VI. The last paragraph of Section 3-1-15 is hereby amended to read as follows: Licenses shall be issued ~ursuant to M.S.A. section 340A.504 to hotels, restaurants, bowl1ng centers or clubs which have facilities for servin~ not less than thirty (30) guests at one time, and they may serve 1ntoxicating liquor between the hours of 12:00 noon on Sundays and 1:00 A.M. on Mondays in conjunction with the serving of food only. This ordinance shall become effective from and after its passage and publication.
