HomeMy WebLinkAbout88-10 CITY OF PRIOR LAKE ORDINANCE NO. 88-10 AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE; PROVIDING FOR ITS ADMINISTRATION AND ENFORCEMENT; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF PRIOR LAKE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AMENDING ORDINANCE NO. 72-16 OF THE CITY OF PRIOR LAKE AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. The City Council of the City of Prior Lake does hereby ordain: Ordinance No. 72-16, as amended, and Title 4, Chapter I, of the Prior Lake City Code are hereby amended as follows: I. section 4-1-1 is hereby amended to read as follows: 4-1-1: BUILDING CODE: The Minnesota State Building Code ("Code"), established pursuant to Minnesota Statutes Sections 16B.60 through 16B.73, and as may hereafter be amended from time to time, three (3) copies of which are on file in the office of the City Planning and Inspection Department, is hereby adopted as the Building Code for the City of Prior Lake. Such Code and such future amendments are hereby incorporated in this ordinance as completely as if set out in full. Such adoption of the Code shall include the following chapters: (A) Chapter 1300 - Code Administration (B) Chapter 1305 - Adoption of the 1985 Uniform Building Code ("UBC") by reference (C) Chapter 1310 - Building Security (D) Chapter 1315 - Electrical Code (E) Chapter 1320 - Elevators and Related Machines (F) Chapter 1325 - Solar Energy Systems (G) Chapter 1330 - Technical Requirements for Fallout Shelters (H) Chapter 1335 - Floodproofing Regulations, Parts 1335.0300 to 1335.1200, Sections 200.2 to 205.3 (I) Chapter 1340 - Facilities for the Handicapped (J) Chapter 1345 - Minnesota Heating, Ventilating, Air Conditioning and Refrigeration Code (K) Chapter 1350 - Manufactured Homes (L) Chapter 1355 - Plumbing Code (M) Chapter 1360 - Prefabricated structures (N) Chapter 1365 - variation of Snow Loads (0) Chapter 4215 - Model Energy Code Amendments Such Code, being adopted herein by reference, includes the adoption of the following optional Code provisions: (A) UBC Appendix Chapter I - Life Safety Requirements for Existing Buildings other Than High-Rise Buildings (B) UBC Appendix Chapter 7 - Covered Mall Buildings (C) UBC Appendix Chapter 35 - Sound Transmission Control (D) UBC Appendix Chapter 55 - Membrane Structures (E) Chapter 1300.1150 - Fire Suppression Systems; Option (F) Chapter 1305.6905 - Special Fire Suppression Systems However, section 307(a) of the Uniform Building Code is hereby amended to read as follows: section 307(a) - Use or Occupancy. No building or structure of Group A, E, I, H, B or R, Division 1 and 3 Occupancy, shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Official has issued a Certificate of Occupancy therefor as provided herein. II. New Sections 4-1-2, 4-1-3, 4-1-4 4-1-5 are hereby added to Title 4, Chapter 1 of Prior Lake City Code to read as follows: 4-1-2: ORGANIZATION AND ENFORCEMENT: (A) The organization of the Building Department and enforcement of the Code shall be as established by Chapter 2 of the Uniform Building Code, 1985 Edition, and as may hereafter be amended from time to time. The Code shall be enforced within the incorporated limits of the City and extraterritorial limits permitted by Minnesota Statutes. (B) The Planning and Inspection Department shall be the Building Department of the City of Prior Lake. The Administrative Authority shall be a State Certified "Building Official". (C) The Appointing Authority shall designate the Building Official for the jurisdiction of the City of Prior Lake. 4-1-3: PERMITS, INSPECTIONS AND FEES: Permits, inspections and collection of fees shall be as provided in Chapter 3 of the Uniform Building Code, 1985 Edition. 4-1-4: SURCHARGE: In addition to the permit fee required above, the applicant shall pay a surcharge to be remitted to the Minnesota Department of Administration as prescribed by Minnesota Statutes 1984, Section 16B.70. 4-1-5: VIOLATIONS AND PENALTIES: It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this Code. Any violation of the provisions of this Code is a misdemeanor. III. The present Section 4-1-2 is hereby renumbered as 4-1-6. This ordinance shall become effective from and after its passage and publication. Passed by the Council this ~hday of April , 1988.
